She was most likely a daughter of one of the Quaker families who resided in the area.

On 21 June 1751 Jacob Banker purchased the Hill Spring tract from Thomas Bentley of Frederick Co., MD. His wife, Hannah, relinquished her dower rights to the said land.

On 5 June 1767 Thomas Bentley of "Roan" [Rowan] Co. NC sold land to Jacob Banker. Hannah again relinquished her dower rights.

In the 1790 Lincoln County census, Hannah Bentley was listed as the head of household with three other females in her house which are probably the younger daughters, or grand-daughters, which are not yet married, and one slave. Thus it can be determined Thomas died between the dates of May 4, 1789, and the census of 1790. Hannah sold to her "daughter," Margaret Bentley, all her goods, chattels, and plantation for "natural love and affection" on April 1, 1793.

To all People to whom these Presents shall come, I, Hannah Bentley, of Lincoln County in the State of North Carolina and on the first day April in the year of our Lord one thousand seven hundred and ninety three send greeting know ye that I, Hannah Bentley for and in consideration of the natural love and affection I bear and have unto my daughter Mergert Bentley and also for other causes and considerations met hereunto moving have given and granted and by these presents do give grant & confirm unto the said Mergret Bentley all my goods & chattels my land & plantation my debts plate, jewels working tools one negro man named Saul and all my other substance whatsoever moveable & immoveable of what kind Nature & Quality soever the same are and in what place or places. During the January 1795 court session for Lincoln County, the court ordered that "Hannah Bentley be notified to attend our next County court to administer on the Estate of Thomas Bentley her late husband otherwise Letters [of administration] will issue accordingly." At the April 1795 court session letters of administration were issued to Hannah, "?widow & relict," with Jacob Ricard and Jacob Bollinger as her securities in the sum of 400 pounds.

Hannah Bentley, acting as administrator of her deceased husband's estate, stated in a document to the Lincoln County Court dated 8 July 1795 that Thomas Bentley, in his life, had at different times given parts of his property to his children to provide for and to advance them and that also before his death had made a deed of appointment for the purpose of supporting her in the event that she survived him. She knew of no debts due from the estate.

Hannah proceeded to name the articles that had been conveyed to her, consisting of livestock, household articles, a negro boy named Saul, one big Bible, and other farm and clothing articles. Hannah signed her mark upon the document.

On 1 September 1795 the widow Hannah Bentley and her son, Daniel, sold to George Savage and Catherine Bollinger the plantation on which Hannah lived.

Hannah Bentley & Daniel Bentley of Lincoln County to George Savage & Catherine Bollinger, both of Lincoln County, for 20 pounds, a tract of land that Thomas Bentley bought of Thomas Welch in Lincoln County on the waters of Indian Creek on the south side of the creek, it being the plantation she [Hannah Bentley] now lives on. It being the land [25 acres] that was accepted [excepted] in the deed that Daniel Bentley made to Jacob Bollinger [doesn't give boundaries] Signed: Hannah Bentley (her mark), Daniel Bentley. Hannah seems to have lived with son, Benjamin, in Alexander County, NC after Thomas' death. 

Hannah was approximately 70 -75 years old when she sold this land. She had sold all her possessions to her daughter, Margaret Bentley, two years earlier. It is possible Hannah sold her goods and land so she could migrate with the families of her son Daniel Bentley and son-in-law Richard Whitaker to Washington County, Virginia, where they appear in the personal property tax lists for the years 1803, 1804 and 1805. Hannah probably died in Washington County, Virginia. She was not enumerated in the 1800 Lincoln County, NC, census.

Hannah married Thomas BENTLEY 1746, Maryland. Thomas was born Abt 1716, most likely in England; died Aft 4 May 1789, Lincoln Co. NC. [Group Sheet]

On 17 December 1769, Thomas Bentley wrote a letter requesting that his son be permitted to sign the Rowan County marriage bond, issued by Thomas Frohock, allowing Aaron Freeman to marry his daughter, Mary Bentley, as follows:

Sr [Sir] if you please to let Aaron Freeman have licence for my daughter Marry [sic] Bentley I am Sattisfied so far let my son sign the licence bond I hope you are in better health then when I saw you last No more at present but your humb servt [humble servant]

The Forks of the Yadkin was a hotbed of Tory, or Loyalist, activity during the Revolutionary struggle for independence. Here Benjamin Bentley was appointed Constable of the "lower end of the forks of the Yadkin" by the Rowan County Court to serve from 16 February 1771 until 7 February 1772.

An excerpt from James W. Wall's Davie County: A Brief History, page 24, details the following concerning sentiments in the forks of the Yadkin during the struggle for independence:

Extreme cruelties, persecution, murder, and looting were practiced by members of both philosophies. The Moravian records note that in 1776 "We heard that up on the Yadkin many who sided with the King were driven from house and home by persecution; and that these people were hiding in the woods in our neighborhood." This is the first mention of "Outlyers," as they were called. The year 1780 seems to have been the worst. The Moravian records refer to "infrequent acts of robbery and murder" in that year. On October 4, 1780, the Moravians reported, "We hear that on the Atkin [Yadkin] a party of Tories has fallen on the people, but only on those who had formerly done the same to them."

Thomas and his son, Benjamin, sold supplies to the revolutionary cause as can be found the Revolutionary Army Account is the State Archives in Raleigh, NC. Thomas'son, Daniel, received a pension for serving as a soldier.

In the 1778 Rowan tax list of Capt. Lyon's District, Benjamin Bentley, is listed with property valued at 336 pounds.

On 7 December 1779 Thomas Bentley made entry for 100 acres of vacant land lying on the water of the South Yadkin River adjoining Benjamin Bentley, Anthony Peeler, and Carson's [James Carson] land, which he made over, or assigned, to Alexander Carons [Cairns/Carnes].

On 30 June 1778 Benjamin Bentley, Thomas' son, made an entry for 640 acres of vacant land on Bear Creek adjoining Adam Hall, Abraham Welty, [John] McElhaney, Anthony Peelor [Peeler], Carson, Wm. Frohock, and Thos. Bentley. Benjamin received State Grant number 97 for this tract on 21 March 1780.

1782 Benjamin Bentley moved his family to land he had purchased in Iredell (later Wilkes/now Alexander) County, settling in the Cedar Run area of the South Yadkin River.

Iredell County, North Carolina, was formed in 1788. During the first term of court on 25 March 1789 a road jury was appointed by the court to lay out the Cove Gap Road [leading from Rich land Cove Gap to Joseph Sharpe's] , viz: Samuel Smith, Joshua Davis, James Davis, Lat Hudson, Hugh Campbell, Benjamin BENTLEY, Adam Hall, John Meadows, Will Stevenson, James Stevenson, Will Cowan, Nat Pairs, Ford Fortner, John White, Will Brown, David McQuen, Edward Carter, Howel Barker, Will Hughs, Will Campbell, Joe Nableton, James Patterson, Samuel Williams, Jo Millsaps, Will Millsaps, Joseph Millsaps, Henry Revis, John Gortney, John Smith, Edward Griffith, Solomon Kelly, John Arrington, Abner Davis, Thos. Campbell and John Kelly. That is almost a complete roll call of the settlers of northwest Iredell and northeast Alexander. Hannah seems to have lived with son, Benjamin, in Alexander County, NC after Thomas' death.

Benjamin Bentley and his family are listed in the 1790 Iredell County, North Carolina, census as follows: four white males over the age of sixteen years including the head of the household, and 4 free white females. This would appear to be Benjamin, his wife, three sons and three daughters. The name of Benjamin's wife can be found in an Iredell County power of attorney dated 23 March 1837 wherein James Bentley names "my Father and Mother Benjamin & Jane Bentley," James Bentley also names his sons John, Ambros, Joel, and William R. Bentley.

On 17 April 1795 Daniel Bentley and Benjamin, the only "two sons and heirs" of Thomas Bentley, deceased, sold both of the tracts of land Thomas had purchased in 1783, withholding 25 acres for the use of Hannah Bentley, "widow & relict of Thomas Bentley." This land was sold to Jacob Bollinger. Witnesses were sons-in-law of Thomas Bentley who were Meshack Davis and William Yonts. This is a very important deed for it establishes the fact that Thomas and Hannah Bentley were the parents of Daniel and Benjamin Bentley.

Know all men by these parents; that this indenture made this 17th day of April in the year of our Lord 1795 between Daniel BENTLEY and Benjamin BENTLEY both of the county of Lincoln and State of North Carolina of the one part and Jacob Bullinger of the county and State aforesaid of the other part. Witnesseth for and in consideration of the sum of 80 pounds to the said Daniel and Benjamin BENTLEY in hand paid the said Jacob Bullinger the receipt whereof is hereby acknowledged and they the said Daniel BENTLEY and Benjamin BENTLEY have bargained sold and aliened enf_____ and confirmed and by these presents doth bargain sell align enf _______ and confirm unto the said Jacob Bullinger his heirs and asigns forever under the condition and exceptions hereafter mentioned two parcels and tracts of land joining each other one situated lying and being in the county and state aforesaid on both sides of Indian Creek between two tracts of land formerly granted to Francis Beatty including a shoal beginning at a black oak thence east 126 poles to a hickory thence south 127 poles to a black oak thece west 126 poles crossing the creek to a white oak then north to the begining containing by survey 100 acres being a tract of land granted to Francis Beatty by a patent bearing date December 22 AD 1768 and by Robert Armstrong and Hugh Beatty executor of the said Francis Beatty deceased and by a virtus of a power given then by the will of the said Francis Beatty conveyed to Thomas BENTLEY by a deed bearing date January 1, 1783 and the said Thomas BENTLEY dying intestate the aforesaid tract of land by due and regular course of law descended to the said Daniel BENTLEY and Benjamin BENTLEY the only sons and heirs of the said Thomas (BENTLEY) deceased. ABOUT THE BENTLEY HOUSE

Mr. Armand T. Daniel purchased the former Bentley property in 1945. His research and remodeling efforts of the log house were featured in the Davie County Enterprise Record, August 7, 1975, page 1B, as follows:

The Bentley House Over 200 Years Old

For over two years Armand Daniel tried to sell what he thought was just an old frame house on his property.

It wasn't until years later he discovered underneath the exterior of boards and paint was an old log house dating back more than two centuries.

Benjamin Bentley, according to Daniel's research, was apparently in this vicinity when the Boone expedition first came this route through Davie County. His research shows this location as being the first known community in the county and it was named "Bentley."

Daniel says there was the Bentley School, Post Office trading post, and in fact it was the community for the entire group of our first settlers.

Archibald G. Carter lived in this old log house. He purchased Bentley around 1823 and the school was then known as the "Baldy Carter School."

The original house was two 20 ft. x 20 ft. square rooms downstairs separated by a 10 foot wide entrance way and they were studded together by four 50-foot long logs. The upstairs floor space was the same.

Daniel, who is in the process of restoring the old house, recently moved one of the 50-foot logs with the help of nine other men. "It took ten of us to get that log down," Daniel said, "and I just wonder how many men it took to put it up there."

And after more than 200 years, these logs are just as solid as ever.

Daniel has a map of the entire farm, dated in 1800, which has helped him considerable in his research.

He has also found on the land an old ice pond, where ice was frozen then cut into blocks and stored in the ice house, located near-by. He is in the process now of filling in the pond.

Behind the main house is what he called a summer house.

"This is where the kinds slept in the summertime because it was too hot upstairs in the main house." he explained.

The summer house was three stories, including a basement and two stories above.

When Kerr Clement purchased this tract of land in 1929, he remodeled the house and it has since been remodeled again. In the original portion of the house the double rafters are significant of the remodeling. The old rafters of the log cabin are easily detected.

When Daniel bought this property 35 years ago and even rented the house, he had no idea it was an original log cabin built over two hundred years ago. Daniel's research shows this to be the best house in Davie County when it was built in the 1700s and remains today one of the better built houses, he says.

Daniel has now torn away all except the original log cabin and when the renovation is complete he says it will be good for another 200 years.

His remodeling plans include building seven bedrooms and seven bathrooms along with the other necessary rooms.

"And I'm gonna build an outdoor kitchen, he said, with a patio between it and the main house."

Daniel plans to invest a great deal of time and money into this project. Upon completion he says he will move his family here from their present location, which was formerly the John Wilcoxson House featured in another edition.

Mr. Daniel was never able to complete his remodeling of the Bentley House before he passed away in 1979. During the four years he worked on the house he was able to add a two-story addition to the rear of the house, plus adding a brick facade to the exterior, three dormers across the front roof, and a slate roof on the entire house. The house sat empty for 26 years until 2005 when it was lost to an unforgivable act of arson.

Teens Charged With Setting Fire To House

Two students at South Davie Middle School were charged with arson after they confessed to burning down a 200-year-old house in Cooleemee. Police have not released their names because of their ages.

The boys, ages 14 and 13, cut school last Thursday and during the morning hours entered the Family Dollar Store on Wilkesboro Street, said Davie Sheriff's Detective Robert Trotter. They were charged with larceny of one cigarette lighter and a box of cigars, which the boys smoked after breaking into the unoccupied house at the corner of Daniels Road and Carter Lane, the detective said.

At 11 a.m. neighbors reported seeing smoke billowing from the structure and called the fire department. "I could see the smoke all the way from the firehouse. It was coming up pretty good," Chief Wayne Williams of the Jerusalem Fire Department said. Jerusalem is approximately three miles from the scene.

William's unit was the first to respond, and he immediately noticed the fire had spread to the woods behind the house. Williams knew he had to call in back up.

"We were concerned with the way the wind was blowing that day." Williams said. "Plus, it was difficult to put the fire out because the house was being used to store hay for feed."

Cooleemee and Mocksville departments assisted. Lt. Andy Lipscomb of the Mocksville Fire Department said there was not much left of the house when they arrived.

"It was burned up pretty good," Lipscomb said. "The house was a total loss."

Trotter and Detective Stuart Parker investigated. Trotter said that neighbor's reported seeing two boys in the area. After driving around, Trotter said they spotted the boys who matched the description.

"We asked a few questions, then brought all the parents in for a complete interview at the sheriff's department," Trotter said, "they admitted to starting the fire and stealing a lighter from the store. It was no accident."

According to court records, one of the suspects has a prior arson conviction, and is on probation for that offense. The other child has no prior convictions.

Firefighters Tried to Save Historic Structure

To the editor:

With life moving at the speed of light, sometimes it's easy to overlook the simple acts of kindness and bravery. Like the dedication, commitment and work ethics of our volunteer firefighters. On Thursday, Feb. 17, one of the oldest homes in Davie County was destroyed by fire. My family has owned the old log "Bentley House" since 1945. According to the historical records and genealogical research done by my late father, Armand T. Daniel, the home was constructed between 1780 and 1784. Benjamin Bentley is credited with the original construction of one grandest and largest homes in the area now called Davie County. The original house consisted of two rooms, 20x20 ft. each, constructed of hand hewed forest pine logs spanning 20 feet each. The rooms were spaced 10 feet apart leaving a total of 50 feet of width. Two 50-ft. pine logs were then laid on top of the structure across the front and back. An upstairs story, called a garret, of the same size was placed on top with addition 50-ft. logs spanning the width. The original Bentley House was 2,000 square feet, a very large home for the period. In the early 1800s, a 20x20 kitchen was added 15 feet away and later enclosed for a dining room. Other floors and rooms had been added throughout time. My father, during his period of restoration before his death in 1979, had added more rooms for a total of 8,500 square feet. Unfortunately, he was never able to complete his dream but he had uncovered the history of the home and had the major architectural designs on display.

The log framing in the house and the enormous additions made it a unique place. Although restoration had to be abandoned after my father's death, it held many memories of my childhood while he worked on it in his final years. Many historians have come from as far away as Ohio just to view the home. The 225-year-old logs went up in a flash. The slate roofs came crashing down. The volunteers of the Jerusalem Fire Department and others spent the entire day pumping water and foam on the remains. We knew the structure could not be saved, but hoped the surrounding buildings, trees and land could be spared. The wind made for a terrible day to fight a fire. The smoke was horrendous, yet the firefighters stood among the rubble for more than eight hours. They had to cut a very old burning oak tree near the structure along with employing the use of a bulldozer. All of this was a very dangerous job. I did mention a volunteer job. Most fire departments in the county were involved in some way, either assisting or on backup call. The refilled water and foam trucks just kept coming. As I understand it, at least 55,000 gallons of water, that's more than 42 tanker truck loads, plus 25 gallons of concentrated foaming solution at a cost of over $650 were used in the containment of the fire. We especially want to thank the brave men and women of the Jerusalem, Mocksville and Cooleemee departments for the majority of the work. There may have been other departments that I failed to see, but we want to thank any and everyone who assisted in controlling the calamity. The sheriff's department, the EMTs, the US Forest Service, the Fire Marshall, the NC Wildlife, we had them all. Everyone worked well together, and we understand the responsible parties have been detained. It's a sad day when we lost part of our history to such a senseless act perpetrated by two teen-age boys.

The moral here is, please support your local fire departments. Let them know you are thankful for their dedication and humbled by their unselfish donation of their own time to help someone in need. Buy their chicken pie dinners or whatever else they sell. Or, lend a hand, it's the least we can do.

Mary Bentley married Aaron Freeman.  Benjamin signed the bond for Mary to marry Aaron Freeman.

On 17 December 1769 Thomas Bentley wrote a letter requesting that his son be permitted to sign the Rowan County marriage bond, issued by Thomas Frohock, allowing Aaron Freeman to marry his daughter, Mary Bentley, as follows:

Sr [Sir] if you please to let Aaron Freeman have licence for my daughter Marry [sic] Bentley I am Sattisfied so far let my son sign the licence bond I hope you are in better health then when I saw you last No more at present but your humb servt [humble servant]

It is believed Rachel is also a daughter, due to Richard Whitaker signing as witness to the Bentley land deed.

About 1782 Rachel Bentley married Richard Whitaker while her parents were yet living on Bear Creek in the Forks of the Yadkin.

Rachael Bentley married Richard Whitaker. No record of this marriage has been found either in North or South Carolina, however the proof of their marriage comes from a statement made by their son, Benjamin Whitaker, taken from "The History of Oregon", where he states his parents were Richard Whitaker and Rachel Bentley. In later years, a great-great granddaughter stated Richard and Rachel were married in North Carolina about 1781. Recent research shows the marriage date is probably much earlier as the older sons would have been born by ca 1774. In this same report, Benjamin Whitaker states he was born in North Carolina.

In 1782 Thomas, his wife Hannah, and some of the children moved to the Indian Creek area of eastern Lincoln County, North Carolina. Accompanying Thomas and Hannah were Daniel and Nancy (Lewis) Bentley; Meshack Davis, who had married Thomas and Hannahâ's daughter Lydia about 1774 in Rowan County; Richard Whiteaker, and his wife Rachel Bentley; and Thomas and Hannah's daughter, Margaret, who would later marry William Yonts in Lincoln Co. NC.

The Rowan County court minutes dated 8 August 1778 lists those persons who "refused or neglected" to take the Oath of Allegiance to the Sate. Included in the list for Capt. Lyon's District is the name of Daniel Bentley, and the names of Bentley neighbors: Mesheck Davis, John Willcockson, Snr., Mark Whitacre, Adam Hall Snr., Samuel Willcoxson and Israel Willcoxson being also on the list. Evidently Daniel Bentley and his future brother-in-law, Meshack Davis, neglected to take the oath for they both would later apply for Revolutionary War pensions.

Thomas's son, Daniel, received a pension for serving as a soldier.

After having served as a soldier and returned home, Daniel married Nancy Lewis, their Rowan County marriage bond dated 8 February 1782. Daniel Bentley and Peter (his mark) Lewis signed the bond. Nancy Lewis was a member of the family who established the Lewis Quaker Meeting House that existed as early as 1771 about two miles north-northeast of the Bentley homestead. Shortly after their marriage, Daniel and Nancy left Rowan County in 1782 with Thomas and Hannah Bentley and the rest of the family to settle in the Indian Creek area of eastern Lincoln County, North Carolina. Daniel and Nancy would later remove to Washington County, Virginia, for a few years and then on to Perry County, Kentucky.

On 17 April 1795 Daniel Bentley and Benjamin, the only "two sons and heirs" of Thomas Bentley, deceased, sold both of the tracts of land Thomas had purchased in 1783, withholding 25 acres for the use of Hannah Bentley, "widow & relict of Thomas Bentley." This land was sold to Jacob Bollinger. Witnesses were sons-in-law of Thomas Bentley who were Meshack Davis and William Yonts. This is a very important deed for it establishes the fact that Thomas and Hannah Bentley were the parents of Daniel and Benjamin Bentley.

The deed states as follows, "Know all men by these parents; that this indenture made this 17th day of April in the year of our Lord 1795 between Daniel BENTLEY and Benjamin BENTLEY both of the county of Lincoln and State of North Carolina of the one part and Jacob Bullinger of the county and State aforesaid of the other part. Witnesseth for and in consideration of the sum of 80 pounds to the said Daniel and Benjamin BENTLEY in hand paid the said Jacob Bullinger the receipt whereof is hereby acknowledged and they the said Daniel BENTLEY and Benjamin BENTLEY have bargained sold and aliened enf_____ and confirmed and by these presents doth bargain sell align enf _______ and confirm unto the said Jacob Bullinger his heirs and asigns forever under the condition and exceptions hereafter mentioned two parcels and tracts of land joining each other one situated lying and being in the county and state aforesaid on both sides of Indian Creek between two tracts of land formerly granted to Francis Beatty including a shoal beginning at a black oak thence east 126 poles to a hickory thence south 127 poles to a black oak thece west 126 poles crossing the creek to a white oak then north to the begining containing by survey 100 acres being a tract of land granted to Francis Beatty by a patent bearing date December 22 AD 1768 and by Robert Armstrong and Hugh Beatty executor of the said Francis Beatty deceased and by a virtus of a power given then by the will of the said Francis Beatty conveyed to Thomas BENTLEY by a deed bearing date January 1, 1783 and the said Thomas BENTLEY dying intestate the aforesaid tract of land by due and regular course of law descended to the said Daniel BENTLEY and Benjamin BENTLEY the only sons and heirs of the said Thomas (BENTLEY) deceased. The other tract joining running into and intersecting the above described land on both sides of Indian Creek begining at a white oak on the east side of the creek abnd runs north 42 degrees west 180 poles to a white oak then south 42 degrees # 180 poles to a hickory thence crossing the creek to the begining containing by estimation 200 acres but only 120 acres is intended to be conveyed or so much thereof as may remain after the claim or interference of the above described land is satisfied which runs into a big tract of the title older and better whereby a part is lost being a tract of land surveyed for Thomas Welch and granted to him by a patent bearing date May 5, AD 1769 and conveyed by the said Thmas Welch to Thomas BENTLEY by a deed bearing date January 1, AD 1783 and at the decease of the said Thomas BENTLEY who died intestate left to his two sons and heirs Daniel BENTLEY and Benjamin BENTLEY and now by them conveyed in manner and form aforesaid excepting notwithstanding 25 acres out of what remains on the south side of the creek for the purpose and to the use of Hannah BENTLEY widow and relict of the said Thomas Bentley deceased and to be left and remain to her the said Hannah BENTLEY her heirs and asigns forever being the land on which the said Hannah now lives and improves and the said Daniel BENTLEY and Benjamin BENTLEY heirs of Thomas BENTLEY aforesaid for themselves and Thier heirs doth hereby set over and convey to the said Jacob Bullinger his heirs and assigns together with the before mentioned premises as there described and the aportenances and hereditaments thereunto belonging or appertaining and also all woods ways waters and water courses and all the right interest profits and estate of then the said Daniel BENTLEY and Benjamin BENTLEY in any manner or sort appertaining to belonging to the premises to have and to hold the said lands tenements and hereditaments hereby dold with their appurtenances to the said Jacob Bullinger to the only proper use and behoof of him and the said Jacob Bullinger his heirs and assigns forever and the said Daniel BENTLEY and Benjamin BENTLEY for themselves and their heirs doth hereby promise covenant and agree to and with the said Jacob Bullinger his heirs that they the said Daniel BENTLEY and Benjamin BENTLEY and Thier heirs executors and administrators shall and will warrant and defend the said premises to the said Jacob Bullinger his heirs and assigns forever against the lawful claim or claims of all persons whatsoever which might in any manner affect or incumber the premises contrary to the true intent and meaning of these presents provided nevertheless that this warranty shall not extend and it is hereby expressed and declared to be the true intent of the parties contracting that it does not extend so as to make the said Daniel and Benjamin BENTLEY any way liable to the said Jacob Bullinger or his heirs or assigns for the before mentioned deficiency or loss in the last describes tract or as to the 25 acres intended to be reserved for the use of Hannah BENTLEY aforesaid and it is also expressly provided to be the meaning and intention of the parties contracting that the 25 acres as aforesaid referenced for the use of Hannah BENTLEY is not included neither shall it by any possible construction either in law or equity by considered as included in this deed of conveyance made in manner and form as aforesaid. "1 September 1795. Hannah Bentley & Daniel Bentley of Lincoln County to George Savage & Catherine Bollinger, both of Lincoln County, for 20 pounds, a tract of land that Thomas Bentley bought of Thomas Welch in Lincoln County on the waters of Indian Creek on the south side of the creek, it being the plantation she [Hannah Bentley] now lives on. It being the land [25 acres] that was accepted [excepted] in the deed that Daniel Bentley made to Jacob Bollinger [doesnâ??t give boundaries] Signed: Hannah Bentley (her mark), Daniel Bentley. Witnesses: Benj. Moore, Richard Whiteakker, William Yonts. Lincoln Co., NC, Deed Book 18, page 146."

Daniel Bentley moved to KY after 1800.

On the first day of January, 1830, Daniel Bentley, seventy-eight years old [born 1752], appeared at the Perry County, Kentucky, Court in order to make application for a Revolutionary War pension. He declared on oath that
"the year forgotten at Rowan County CH [Court House] N Carolina he enlisted for 2 years in the company commanded by Burris in the 7th Regiment..he supposes in N Carolina line on continental establishment but it may have been the 7th Regiment on Virginia line on continental establishment either Regiment was commanded by Col. Campbell..that he continued to serve in the said corps until the expiration of his term of service when he was discharged from the service by Capt. Burris at the place of his enlistment aforesaid.."

Daniel also made oath that "he resides a considerable distance from the court house and for several years has been confined at home by disease besides he was told that he had no chance to succeed unless he had a discharge or could prove his service." Continuing Daniel swore "That he is by occupation a farmer but so old and diseased he is unable to work he has no family but his wife Betsey ___ years of age unable to support herself they are supported by the charity of their children grown and left them and kind neighbors."

Anthony Hall and Thomas Stuart gave oath before the court they knew from their own knowledge that the statement of Daniel Bentley as to his enlistment under Capt. Burris in the 7th Regiment North Carolina line on continental establishment was true having seen him enlist and they knew he served in the continental line for about two years. Stuart was present and saw Bentley discharged by Capt. Burris at the place stated and they "have long known said Bentley and that he is to be relied upon as a man of strict integrity."

Daniel and Nancy (Lewis) Bentley are buried in the hilltop Bentley family cemetery located near Neon Junction in Letcher County. His tombstone reads "Daniel Bentley Born in England Died Jan. 15, 1839." Nancy's tombstone reads "Nancy Wife of Daniel Bently Born in England Died Oct. 4, 1843."

There has been heavy discussion among descendants as to the phrase "Born in England" which is found on both Daniel and Nancy's tombstones. In looking at the stones of Daniel, Nancy, John, and Margaret one notices all the stones are similar in appearance with a rounded top and the picture of a flying dove within the circumference of a circle at the top of the stone. An ascending dove, or flying bird, represents rebirth; the transport of the departed's soul to Heaven.

One would venture to guess these stones were all erected within a close time period of each other; thus perhaps offering an explanation the place of birth on Daniel and Nancy's tombstones was given by a descendant and erected at a later date. Land records seem to confirm Daniel's parents, Thomas and Hannah Bentley, were in Maryland at the time of their marriage, so it seems more reasonable to think Daniel was born in the Frederick County area of Maryland.

On 1 April 1793 Hannah Bentley sold all her earthly goods to her daughter Margaret Bentley.

To all People to whom these Presents shall come, I, Hannah Bentley, of Lincoln County in the State of North Carolina and on the first day April in the year of our Lord one thousand seven hundred and ninety three send greeting know ye that I, Hannah Bentley for and in consideration of the natural love and affection I bear and have unto my daughter Mergert Bentley and also for other causes and considerations met hereunto moving have given and granted and by these presents do give grant & confirm unto the said Mergret Bentley all my goods & chattels my land & plantation my debts plate, jewels working tools one negro man named Saul and all my other substance whatsoever moveable & immoveable of what kind Nature & Quality soever the same are and in what place or places. Soever the same shall be found as well as in my custody of possessions as in the possession or hands power & custody of any other person or persons whatsoever, or all those goods & chattels land & plantation, debts and all the other aforesaid premises unto the said Margaret Bentley her heirs Executors & admrs [administrators] to her and their own proper use forever and I the said Hannah Bentley all & singular the aforesaid goods & chattels & premises to the said Margaret Bentley her executors admrs I assign against all persons & do warrant and do forever defend and by these presents. This would appear to be Benjamin, his wife, three sons and three daughters. The name of Benjamin's wife can be found in an Iredell County power of attorney dated 23 March 1837 wherein James Bentley names "Father and Mother Benjamin & Jane Bentley," James Bentley also names his sons John, Ambros, Joel, and William R. Bentley.

Giles Whitaker does not appear in Lee Co., VA after 1800.  On Sept 25, 1800  Giles Whiteaker of Lee Co., VA sells one hundred ninety two acres of land in Lee  Co, located on the north side of Carrs Old Survey to John Davis of Lee Co., VA for eighty  pounds.  [Ref: Lee Co., VA Deed Book 1, page 197.]

1822 Washington County VA: Richard and John Whitaker witnessed the will of Rev. Isaac Chapman in 1822, the year Chapman died. Richard went bond to settle his estate which was settled in 1825.

When Isaac Chapman died c 1823, his will was witnessed by Richard Whitaker and John Whitaker. 

John Whitaker is listed in the Washington Co., VA Personal Property Tax  List 1782-1840 for the years 1810, 1811, 1812, 1813,1816, 1818, 1819, 1820, 1823, and 1839.

John Whitaker son of Richard Whitaker and Rachel Bentley, married Hannah Yaunch about 1824 in Perry Co., KY.  [Ref: Portrait & Biographical Album, Ogle Co., IL, 1886, page 616/617.

There is a town in Letcher Co., KY named "Whitaker" and just to the west of this town is "Bentley Hollow" and a couple of miles northeast of this town in "Yonts" Creek, according to Weldon Whiteaker.

James processed and sold salt from his property on the Elk Horn Branch of the North Fork of the Holston River, three miles east of Saltville. Apparently Alexander inherited the farm. James, Sr.'s land extended toward other Whitaker property which included Broadford to Big Tumbling, a stream cascading down from Laurel Bed Lake to end up in the town of Saltville. Professor J. Williams of Emory and Henry College, said the Whitakers operated a barge from Smyth Co. VA to Kingsport, TN carrying salt.

James Whitaker and Solomon McReynolds by virtue of part of a land office exchange treasury warrant for 20,000 acres No 2622, dated Dec 19, 1832, which warrant was obtained in exchange for Warrant No 1089 and issued to John McKettera Jan 3, 1795 enters 420 acres of land in Smyth Co. on Beaver Creek, a branch of the North Fork of the Holston River adjoining a 1600 acre survey made in the name of William King on the east; a 425 acre survey in the name of the Robert Preston on the south and southwest; a 100 acre survey made in the name of William King and the lands of Issac Poston on the north.

1840 ..James Whitaker named executor of Richard Whitaker's will. He and his son-in-law, John P. Ayres were at the sale of personal property of Richard Whitaker, Jr. [Will Book 8, page 194/195.]

Sept 28, 1841 Smyth Co, VA Deed Book 3, page 134..An indenture made bet. John Scott of the first part and James Whitaker, Jr of the second part and James Whitaker, Sr of the third part. Whereas the said John Scott is justly indebted to the said James Whitaker, the sum of $100. to be paid Jan 1, 1842, the same being for two hundred bushels of salt, the said John is willing and desirous to secure. Debt is paid with one black horse, 3 years old, one rifle gun and crop of corn & oats. [Recorded Smyth Co. Virginia.]

WILL AND ESTATE

At the time of his death he was living on the Elkhorn Branch of the North Fork of the Holston River in Smyth Co., a few miles east of Saltville, in Rich Valley. 

His will is dated Aug 4, 1854, with Codicil #1, dated Dec 7, 1854 and Codicil #2, dated Jan 18, 1856.

Children named in his will probated 19 Feb. 1856, recorded in Will Book 2, pp. 9-12, Smyth Co., VA, were Alexander, John, James, Jeremiah, Joseph, Thomas C., Polly, Jane, Elizabeth, and Susannah. Feb 19, 1856. In his will another child is listed: Rachie D. Johnston, who is probably a daughter of third wife, Elizabeth from a previous marriage.

March 29, 1856, Book 2, page 60, Smyth co., VA  Sale Bill of James Whitaker's estate is dated Mar 29, 1856 and the Appraisement dated May 21, 1856. VA for $600. containing 113 acres, patent bearing date of 10 Sept 1787 and 50 acres, patent bearing date of 5 Nov 1798, lying on both sides of the North Fork of the Holston River.  The 113 acres begins at a beech tree in an island corner to John Lee and crossing the river and a corner to John Lee on the south side of Little Mountain. p.6

Moses and his father bought the first 113 acres which lay on both sides of the North Fork of the Holston River a few miles from Hayters Gap near present-day Tumbling Creek.

This cause came on the 15th day of May 1839 to be heard upon the bill, the answer of Uriah Bowman and the verdict of the jury rendered upon the issues to ascertain whether the paper in the bill mentioned is the last will and testament of Esaias Bowman, deceased, and was argued by counsel, and it appearing to the satisfaction of the court that the specifications and conditional order has been returned executed on Samuel Bowman, Benjamin Bowman, Esaias Bowman and Aaron Bowman more than four months before the commencement of this term, and they still failing to appear and answer, the bill as to them is taken as confessed..and it also appearing to the satisfaction of the court, that the order of publication, awarded at the rules in the Clerk's office against the defendants, Absalom Bowman and George Washington Bowman, has been duly posted and published, and they still failing to appear and answer, the bill as to the, is taken for confessed..and Wm. S. Logan, Sheriff of Washington County, to whom the estate of Esaias Bowman, deceased, with the bill annexed, was committed to be administered having consented that this cause might be heard and determined at this term..it is therefore adjudged, ordered and decreed, that the paper in the bill mentioned purporting to be the last will and testament of Esaias Bowman, deceased, and which bears date on 24 Aug of 1837, and which was admitted to record in the county court of Washington County on 23 day of Oct 1837, is the true last will and testament of Esaias Bowman, deceased, and therefore, it is further ordered and decreed the plaintiffs ill be dismissed and that the defendants recover their costs by them about their defense in this behalf expended.

Moses purchased land with his father, Richard from Charles Thurman and his wife, Barbara. In 1855, Moses purchased 200 acres of land from Andrew J. Hayter, Washington County, Virginia. Deed Book 22, page 345.  This land in Poor Valley, on the south side of Clinch Mountain to the top of Piney (Little Mountain). This was land Andrew Hayter and his wife  Talitha Fullen had inherited from her father, James Fullen, Sr.

VA DB 24..Moses Whitaker and Calvin Whitaker $40.00, both sides of NFHR, 95 acres about, being a tract of land which formerly belonged to James Fullen, Sr., deceased..descended to his children and heirs, 9 of them..Land conveyed to Moses Whitaker by James C. Hayter and Tebitha, wife Oct 27, 1852. 16 Sept 1858 adm. to record.

1860 WASHINGTON CO. VA Census..HH #62.. Moses, 61, Polly, 55, Rufus, 25, Elizabeth, 20, Caroline, 4, Jane 8 months. They are living next door to daughter, Lydia Whitaker Litton.

The Whitakers lived on his property and farmed until his death on September 14, 1875. He is buried in a cemetery on his property, now called the Hayter-Litton Cemetery near Hayters Gap, Virginia. His stone is marked Moses Whitaker, "Father."  Next to Moses is buried his daughter, Lydia E. Whitaker Litton.  Her stone reads Lydia E. Litton, daughter.

Joye Boardman notes she knows nothing of Thomas Whitaker except he was named as a son of Richard Whitaker in the bible of Absolom Rufus Whitaker.  She does not find him in the Personal Property Tax Lists of WASHINGTON CO.VA 1782-1840.

[Note: I don't believe this Thomas is Thomas Hargis Whittaker born Jan. 16, 1788 in Virginia and died Jan. 16, 1869 in Greene Co. TN who married Jemima Edgemon. Washington County, Virginia Deed Book 20, page 26 In 1827 Polly Hayter, Richard Whiteaker and Adam Fudge, Jr. went bond for the estate of William Hayter, deceased, with Polly Hayter as the administrator. We know Richard Whitaker was the father-in-law of Adam Fudge, Jr. More than likely this Polly Hayter was the daughter of Richard and widow of William Hayter.

MIGRATION

1836...Benjamin and his family left Virginia and moved to Lee County, Illinois, staying in this country for eleven years where three more children were born.

1848...The family left Lee County, Illinois, and crossed the plains in a covered wagon to Oregon, taking with them eight yoke of oxen, three wagons and his carpenter tools, two plows and harrow teeth that were made of inch square iron. They also took with them the family bible and a few books and some of the family relics, which they prized. The family also brought with them the staples for some months provisions, and thus equipped the pioneer, Benjamin Whitaker, and all he held dear on earth cut loose from civilization to cross the plains, which were infested with savage beasts and little less savage Indians (Ref: History of Oregon, Page 886). They found a home for themselves in the mild climate of the beautiful and rich Willamette Valley in Oregon. They arrived at Foster's Farm on October 5th and on the 11th reached Polk County and the following spring purchased the Dr. Boyle donation claim of 640 acres of choice land. The price paid was $250.00 which was less that forth cents an acre. On the property Benjamin raised his family and resided until his death in his seventy-sixth year.

Will of Benjamin Whitaker and Probate

July 16, 1872...Polk County, Oregon...In the name of God amen, I Benjamin Whitaker of the County of Polk and the state of Oregon and of the age of seventy five years and being of sound mind and memory do make, publish and declare this my last will and testament in names as falls to wit.
 
First, I give and bequest to my wife, Polly Whitaker the sum of $100.  Second, It is my will that the farm that I now own in Walla Walla County, Washington Territory inherited by me from my son William and the south half of my half of my donation land claim in Eight South Rouge in the County of Polk, and state of Oregon shall be sold and the proceeds equally divided among all of my heirs to wit. David, Whitaker, Rachel McGee, Benjamin Whitaker, Joseph R. Whitaker, Elen Levens, Mariah Ogden, George Whiter and Ellen Collins. Third, it is also my will if there should be any other property at my death it be divided among my heirs.  Fourth, it is my will that if Elen Collins is not of age at my death, that my executors shall hold in trust for said Ellen Collins, all that she may inherit from my estate until she is of lawful age and then pay it over to her taking her receipt and if she should die before she is of age her share shall be equally divided between my lawful heirs. Will witnessed July 16, 1872.

July 2, 1873..County Court of Polk County, State of Oregon..In the matters of the last will and testament of Benjamin Whitaker, deceased... To the Hon. Court of said County, Isaac Levens respectfully show unto the court that Benjamin Whitaker, a resident of said Polk Co., Oregon, died in said county and state on the second day of July AD 1873., that said deceased left a last will and testament; and that he therein appointed and designated  Levens and George Whitaker his exec.  The estate consists of real estate and personal property of about $3180.00 dollars and the legal heirs are David J. Whitaker, aged 48, Rachel McGee, age 41, Ellen  Levens, age 40, Joseph R. Whitaker, age 37, Benjamin Whitaker, age 35, Mariah Ogdon, age 33, George Whitaker, aged about 30 and Ellen Collins, aged 10 years.  David Whitaker, residence, Walla Walla County; Rachel's residence, same place; Ellen Levens residence Polk Co., Joseph Whitaker, residence Polk Co.; Benjamin Whitaker, Polk Co.; Mariah Ogdan residence, Rice County, Minnesota; George Whitaker, Polk Co.; Ellen Collins, Polk Co.  Ack. in court July 7, 1873.

OBITUARY

Obituary (published in a paper in about 1882)

"Never having noticed anything relative to the death of "Old Mrs. Whiteaker" in the papers, I thought it due to herself and her friends that something of her domestic history should be given publicity, while yet some of her old pioneer associates still survive her, and some of whom regarded her with that high esteem which respected worth always merits. This thought was suggested by my wife, who in years past has been the recipient of Mrs. Whiteaker's unbounded hospitality, and who frequently recalls to mind one incident in early life, when that hospitality was most generously extended, and most thankfully accepted. The remembrance of those pioneer days can never be obliterated from the memory, either by time or circumstances. Let the pioneer retrospect the past; call to mind his early associates, and attempt to number his survivors. He will find but few living of the many with whom he was familiar in those early days, and with whom he felt a degree of intimacy amounting almost to that of consanguinity.

In 1852, now about thirty years ago, my wife and self, with our two little ones, were coming from Yamhill, when we were caught in a very heavy rain storm. We were in an open wagon and pretty well drenched when we stopped at Mr. Whiteaker's house. Driving up to the fence, we were met by Mr. Whiteaker, who in loud tones exclaimed: "Hello! What the devil are you doing here? Get out of the wagon and come in the house; you are as wet as the devil." Well, we did as requested, and soon a blazing fire restored warmth to our chilled frames. Mrs. Whiteaker took my wife in charge, and she was quickly clothed in habiliments more congenial to the female sex than a water-saturated piece of calico. And now, after the lapse of thirty years, the kindly feelings manifested upon that occasion by Mr. and Mrs. Whiteaker are remembered by us with the most lively emotions of respect and regard; and more, not only the kindness and hospitality manifested upon that occasion entitled them to our highest regard, but during many years thereafter we received many manifestations of their kindly disposition towards us, that makes the remembrance thereof pleasing reminiscences of the past. But today where are they? Gone to that mysterious realm from which there is not return, and to which we are all hastening.

Mr. Whiteaker was a man of very jovial and merry disposition. Upon one occasion ex-Gov. Whiteaker called upon him and made inquires to ...whether or not there was any relationship between them. Mr. Whiteaker remarked: "I do not claim kin with every scalawag that comes along, but as you are a pretty good looking man, and appear to have some sense, if you can show that we are kin, I'll acknowledge the corn." This was many years ago, and it occurs to my mind as one of the many incidents that go to show the natural tendencies of his disposition, for upon many occasions have his sallies of wit caused much merriment. For his associates: yet, withal, he was a man of strict integrity, of unbounded hospitality, and his rule was to do as he would be done by. How often do the hearts of the old settlers, when calling to mind the struggles and toils incident to pioneer life, bound with a fresh impulse at the remembrances of the social equality, the generous dispositions and disinterested sympathy which characterized them in the intercourse with each other. Almost isolated from civilized life, bound together in a common destiny, each felt the other a warmer friendship that is much of the characteristic of society of the present day. The onward march of time is fast removing from the scenes of active life the "Old Pioneers." Soon the last one will have obeyed the dreaded summons, and the recollection of their hardy toil and struggles in the advancement of civilization will be but a matter of history.

In the death of Mrs. Whiteaker the ranks of the pioneers number one less of that noble band of women who braved the dangers of the wilderness with a heroic devotion to life's duties, worthy a remembrance in the hearts of all who survive her. There is naught in the remembrance of her domestic life but what should bring consolation to all her surviving friends and relatives.

Mrs. Whiteaker was born in Washington County, Virginia, in 1808. Her maiden name was Mary B. Hayter, she married to Benjamin Whiteaker in 1823. They went to Illinois in 1836, where they resided about eleven years. They then came to the conclusion that they would cross the plains to Oregon. In 1848 they bade adieu to friends and started on the perilous trip with sanguine hopes, that with patience and perseverance they would reach the goal of their desires and build upon them up a happy home, where peace, plenty and contentment might bless them through life's pilgrimage. In October,1848, they settled in Polk County where they made a continued residence up to the time of their death, known and respected by all their neighbors as kind , genial, and hospitable in all life's associations.

On the 1st day of December, 1882, Mrs. Whiteaker yielded up her spirit, to God who gave it, serenely and calmly, with the precious hope of ascending. ... She leaves seven children, to whom she leaves the priceless legacy of an honored name, and whose memory will be long cherished by all who knew her, for to have known her was to have formed a deep-seated friendship, and her friendship was indeed a boon, as was indicated by the warmth of her heart and a generosity that was without limit. She is gone and we are left to linger for yet a brief hour before we join the vanished numbers of the pioneers that were."

The Whiteaker Cemetery is located on the Bengamin Whiteaker D.L.C.in Township 8S, Range 5W, Section 11. It is a private family cemetery about .01 of an acre in size. All known burials are related to the Whiteaker family. It is about three miles northwest of Monmouth, Polk,County, Oregon. The cemetery has been abandoned to nature. It was last read by Addie Dyal Rickey in 1973.

Benjamin Whitaker reported in the above report that he was from a family of nine [9] children.  Five sons and four daughters.  Other research  by  John Weldon Whiteaker states the Bible of Absalom Rufus Whitaker, son of Moses Whitaker  lists in his handwriting "My grandfather, Richard Whitaker had 11 boys and three girls - Giles, Aaron, John, James, Moses, Benjamin and Thomas. [7 named] and Rachel [Catherine] who married Adam Fudge, Mary [Polly] who married Harry Webb and Elizabeth Whitaker who did not marry."

Never married. She had three children who were named in her father, Richard Whitaker's will.

Adam, Catherine and their children followed her brother, Benjamin Whitaker to Illinois.  In the Fall of 1835 they emigrated to Putnam County, Illinois where they
remained until the fall of 1836.  They stayed in this area until March 7, 1847, when they joined Benjamin and family and headed west on the Oregon Trail crossing the continent to Polk County, Oregon where Adam secured a farm and engaged in its operation.  Mr. Fudge took a donation claim on the Territorial road between Salem and Corvallis consisting of 640 acres. Their trip west began by crossing the Missouri River at St. Joseph and then proceeded by way of Platte River, Soda Springs, Green River, Snake River, the Barlow Toll Road through the Cascade Mountains, Grande Ronde Valley, across the Blue Mountains at the present site of Pendleton, and finally arrived in Polk County, Oregon.

Adam died in an accident in 1848.  Catherine is 45 years old and left with 10 children, ages from 20 thru 5 years.

Catherine made the donation claim her home and with the exception of two years spent in Washington, until her death in 1867 spent her time in Oregon.  Catherine died at the age of 62 years.
 
1860 Census of Polk County, Oregon Territory lists Catherine, age 54, along with her sons.  Catherine died after 1860 in Clatsop County, Oregon.

James enlisted, along with his sons William James and John to fight for the Confederacy. in Co. C of the 34th Virginia Cavalry under Col. W. A. Witcher. He is listed as Whitaker, Sr. J. with the rank of private.

James was killed by Union marauders or bushwackers at his gate. He lived on Belcher Ridge, later known as Whitaker Ridge, which straddled Tazewell County VA and McDowell Co. WV. This area was a battleground between Confederate and Union sympathizers, pitting neighbor against neighbor and sometimes splitting families. All of his neighbors supported the Confederacy, but the area wasn't immune from raiding parties of Union soldiers or Union partisans.

One piece of family lore that has been handed down is that he taught singing by notes and using a pitch pipe to get the key.

James married Nancy PETTS 27 Feb 1843, Smyth Co. VA. Nancy (daughter of Adam PETTS and Delilah Fanning) was born Jul 1824, Wythe County, VA; died Bef 1910. [Group Sheet]

I, Jerry WHITEAKER, of Washington County, Virginia, do make this my last will and testament hereby revoking all other? wills formerly made.

1st I desire all my just debts paid.

2nd I give and bequeath to my beloved wife Martha Elizabeth, one? buggy and one half (1/2) of all my house hold goods except as hereinafter bequeathed- I further devise to my wife Martha Elizabeth, during her life, the Mansion house and all its? appurtenances and I hereby charge the lands herein after devised,for the support and Maintenence of my wife as follows: The parts devised to my son Charley and daughter Susie Rush, with one third of the proceeds of said land and they are to take care of and support my wife according to her station in life. The parts devised to J.J. COLLINS, Sallie McDANIEL, Ollie? GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, with Four dollars per year each to be paid in Money. I give to my wife the horse called Charley; the Mare called Daisy I desire to be sold and the proceeds paid to my wife.

3rd Because of the labor performed for me and his kindness and attention to my wife and I, I give to my son Charley all my farming implements. I further give and devise to my son Charley, fifty acres (50) of land, Commencing at Lester and Clyce's corner on the North side, coming with line to mine and Clyce's corner west of the school house; then coming east to corner at junction of creek and lane; then south to Jonesville road; then go east south of the road until he gets fifty acres.

4th I give and bequeath to my daughter Susie RUSH because of her faithful care and attention, one half of my household goods and one buggy. I further give and devise to my daughter Susie, fifty acres of land commencing at mine and Clyce's corner, thence south to the school house corner and mine and Clyce's corner; then with school house lot down the creek to the cross road; then with said road south to Jonesville road, then east until she gets forty five acres of land, then she is to have five acres of the timber land and at the death of my wife I devise to her the mansion house and its appurtenances.

5th I give and bequeath to my daughter Sallie McDANIEL the bureau and wash stand in my bed room.

6th The residue of my land I give and devise equally to my children Jane COLLINS, Sallie McDANIEL, Ollie GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, subject to the charge upon it, contained in the first clause of my will?.

7th I give to Vic Rush my log chain. It is my desire and will that the salt kettle, which now sits at the spring, remain in its present location for all time.

She raised a child of her sister Mary Rachel, Susan Ayres, who was their heir.

She became prominent in Knoxville Tennessee society because her husband was twice mayor, was a wealthy industrialist and bank president.

Sept. 29, 1856.. Washington County, Virginia Deed Book 23, page 346 James Snodgrass bought land for $1.00 from Joseph Worsham and wife, Nancy McNew, for a meeting house for free religious worship at the forks of the creek running from James Meadow's and I. N. Logan. This is present day Blackwell's Chapel.

1858.. Washington County, Virginia.. James and Mary Ann bought a tract of land in Washington County, Virginia on the south side of Little Mountain...bound on east by her brother, Calvin and on the west by Andrew Taylor's place.  Exact number of acres not known. This land is now owned by James & Mary Ann's great-great-great grandson, Tommy Worley.

May 12, 1862, Mary Ann Whitaker Snodgrass held a sale of James' personal property.  The buyers were Oscar Akers, Abby F. Snodgrass, David Worley, Calvin M. Whitaker, John Taylor, Madison Holly, John D. Blackwell, I. N. Logan, Joseph Murdock and Joseph Snodgrass.
 
Feb 22, 1864, Henry Davenport, brother-in-law, was named guardian of her two youngest children, Julino O. and Henry Francis Snodgrass.

Oct 28, 1864, Washington County, Virginia Deed Book 26, page 211.....Mary Ann sold to Julina O. Snodgrass , her daughter and Henry Francis Snodgrass, her son all the real estate her late husband, James M. Snodgrass had left.  Mary Ann retains her life interest in the real estate and one half increase of the personal property (meaning livestock).
 
November 3, 1864, Mary Ann Whitaker Snodgrass married John R. Jackson, widower, age 53, born Russell County, VA., son of William Jackson and Mary Hunt.  Mary Ann was 47 years old at this time.  The minister who performed the marriage was J. T. Davenport.

May 29, 1869, Washington Co. VA Deed Book 27, page 676...A. G. Thompson, Attorney-in-fact of John Gordon Ogden and Jane C. Ogden, and heirs and legal representatives of James M. Snodgrass, deceased..a sale and conveyance made about 1858 by said Thompson, attorney...sold by him to said James M. Snodgrass lying on south side of Little River, bounded on the east by Calvin Whitaker and on the west by Andrew Taylor, formerly Mitchell Talbert.

1870 (Ref: She was not listed in the 1870 Census) Buried Blackwell Cemetery. The date of her death is gone from the stone and no exact date has been found.

March 6, 1845..Washington Co.VA Deed Book 17, Film #0034371...This indenture between Aaron Bowman and Mary Bowman, his wife of the County of Washington and State of Virginia of the one part and Calvin M. Whitaker of the same county and state the other part. Witnesseth that the said Aaron Bowman and Mary his wife, for and in consideration of the sum of $18.50 current money of the United States to them in hand paid the receipt whereof is hereby acknowledged do grant bargain and sell unto the said Calvin M. Whitaker all the right title interest and claim whatsoever which they the said Aaron Bowman and Mary, his wife, have or are in otherwise entitled to in the land lying and being in the County of Washington of which James Dolan died seized and possessed.  One tract of said land lies on the north fork of Holston River about seven miles west of the Saltworks and contains as is supposed about 296 acres being the same land upon which Josiah Poston, the father, of said Mary Bowman now lives. Another tract lies upon the little mountain about one mile from the said 296 acres and contains about 60 acres. and the third tract lies in the Poor Valley, and the parties to this deed do not know what is it's exact condition, but whatever interest the said Aaron & wife may have in it is hereby intended to b conveyed. The interest in the land of said James Dolan, dec. hereby intended to be conveyed by the said Aaron Bowman & Mary, his wife is the one sixty part of the interest, which Anna Poston, dec., the mother of the said Mary Bowman would be entitled to if living as one of the children and heirs of the said James Dolan, dec. the said Anna Poston having died leaving six children, her heirs at law, of whom the said Mary Bowman, wife of said Aaron is one with all the appurtenances to have and to hold the said interest in said lands with all their appurtenances unto the said Calvin M. Whitaker and his heirs to the sole use and behoove of him the said Calvin M. Whitaker with his heirs forever.  And the said Aaron Bowman and Mary, his wife and their heirs the said right and interest in said lad unto the said Calvin M. Whitaker and his heirs. Moses Whitaker left in his will land to Lydia with the notation "The land was not to be in the hands of John Litton - if he was alive" -. He wasn't.  From family stories handed down, John Whitley Litton III was a gambler and kept race horses. It is told the Litton Plantation was a good place to raise hell on weekends.

Family stories having John joining the US Army after the war ended and supposedly dying in the Mountain Meadow Indian Massacre in 1867 Utah. This was the story told by his son, Lilburn to cover the fact that he may have deserted his family. This story is documented in "Russell County, Virginia: History Revealed Through Biographical and Genealogical Sketches of Its Ancestors" M. Secrist, Lulu Press, Inc, Feb 18, 2013.

However, the massacre took place in 1857. The Mountain Meadows Association has the following information showing he was not a victim of the is massacre.

The MMA investigates every person who is believed to have died in the Mountain Meadows Massacre. According to a family tradition, John Whitely Litton died in a "Mormon Indian Massacre in Utah", in 1867. Although the Mountain Meadows Massacre took place in 1857, stories usually get some facts wrong, and he was investigated as a possible victim.

John Whitely Litton was the son of John S. Litton and Catherine Younce, born 5 March 1830 in Elk Grove, Russell County, Virginia. He married Lydia Eva Whitaker on 14 May 1845 in Russell County, Virginia. She was the daughter of Moses Whitaker and Polly Bowman. In the 1850 census, they are enumerated in Russell County, Virginia, and in the 1860 census they are enumerated in the Western District of Washington County, Virginia. Lydia (Whitaker) Litton is enumerated as a widow in both the 1870 and 1880 census for Washington County, Virginia. These census records indicate that Litton probably died sometime between 1860 and 1870, and not before 1860, which would have been the case if he was a victim of the Mountain Meadows Massacre in September 1857.

John W. Litton was in Wade's Regiment, Local Defense (Washington County VA Militia), in April 1862, before he enlisted in the Confederate Army. Litton served the Confederacy during the Civil War, in Company A (originally Stevenson's Company, Ferguson's Battalion) of the 16th Virginia Calvary. This Company was primarily made up of men from Russell County, Virginia. John W. Litton was a wagon master in the Civil War. Most Confederate records from Virginia were burned in Richmond, however a copy of a Company Muster roll for 31 October 1863 to 1 April 1864 shows he enlisted 5 August 1862 at Lebanon, VA. for a period of 3 years. He was signed in by Capt. Stevenson. He appears on a Receipt Roll for pay on 31 December 1863. He was paid $.25 for service from 1 August 1863 to 31 December 1863. These records indicate that Litton was still alive in at the end of December in 1863. There is no record of Litton's wife filing for a widow's pension.

Lydia (Whitaker) and John W. Litton had seven children. The two youngest children were Clementine Catherine Litton, born in September 1861, and Mary Cordelia Litton, born 31 March 1865. The birth of Litton's youngest daughter indicates that he was living in 1864. The census records, military records, and birth date of his youngest daughter, prove that he was not a victim of the 1857 Mountain Meadows Massacre.

Another family story states that when he returned from the Civil War, he didn't like the reconstruction, so he enlisted in U.S. Army and was sent to Utah, where he died as an Indian fighter. A different story said that he settled in Texas and married again. He was rumored to have several children and was living in Campbell County, Texas. [Note: There is no Campbell Co. TX. There is the town of Campbell in Hunt Co. TX] No evidence, that would support either story, has been found.

In Lydia (Whitaker) Litton's father's will of 31 March 1874, proved 22 November 1875, Moses Whitaker left her land, and other property, and further stated that the "devise to Lydia E. Litton, dau., are not to be liable for any debts due for any one from her husband, John Litton, if he is now alive." When and where John Whitely Litton died remains a mystery. It is evident, from her father's Will, that as late as 1874, Litton's wife did not know what happened to her husband. She never remarried, and Lydia Eva (Whitaker) Litton died 14 May 1901 and is buried in the Hayter Cemetery in Abingdon, Washington County, Virginia.

Moved to Washington County, Arkansas before 1860 There were children in this family, however unknown at this time. The children  were mentioned in the will of Moses Whitaker, Sr. but not by name.  [Note:  There was another Moses Whitaker born in 1819, VA listed in Putnam County, Ill in the 1850 Putnam Co. Census.  This was not Moses Whitaker, Jr. son of Moses Whitaker of Washington Co., VA.] This Moses Whitaker had a wife, Eliza, and son Aaron, age 1. Also living with this Moses was Joseph Whitaker, born VA, age 25.

Absalom was a carpenter living with his father, Moses in 1860 in Washington Co.VA.  By 1870 he had taken his family and moved to Greene County, Illinois. "In 1879 David and Lucy retired to Polk County, Oregon and resided in Independence for five years, and then came to the donation claim on which they have since resided and they are living in the home he built forty years ago.  They are members of the Methodist Church.  Mr. Whitaker does not pay much attention to politics, but he always voted with the Democrats.  Mr. Whitaker has almost reached three score and ten mark; but he still retains his faculties, and has yet much strength and endurance.  While he does not need to work he keeps up his habits of industry, and still retains the 320 acres he took up as his donation claim.  In addition, he has stores and other property in Independence."

INDEPENDENCE, Oct. 14. (Special.) David Whiteaker, who. was Injured in a runaway accident here, yesterday, has not regained consciousness, and his death Is momentarily expected. Mrs. Whiteaker is much worse injured than at first expected, and she Is now unable to leave her bed.

Mr. and Mrs. David Whiteaker, aged residents of Independence, were badly injured in a runaway Monday. Mr. Whiteaker, who is in feeble health, received a deep gash in the back of his head and a bad wound on the forehead.

OBITUARY

Independence Enterprise & West Side; 23 October 1902

Died at his residence in this city, on Wednesday, Oct. 22, 1902, David Jesse Whiteaker, aged 77 years, 11 months and 26 days. The circumstances leading to the death of "Uncle Davey" are too fresh in memory to be rehearsed at this time. Suffice it to say that he scarcely regained consciousness from the runaway accident of last week.

Mr Whiteaker was an honored pioneer of '48 and a veteran of the Oregon Indian wars. He was a native of Virginia. In '36 he, with his parents, removed to Illinois, they being pioneers to that state. His trip across the plains to Oregon is similar to those of all that heroic band, which braved the hardships and reclaimed Oregon to the Union.

Funeral services were held today at 11 a.m. at the M.E. church, Rev G.H. Osborne officiating. Interment took place at the family burying ground on the B.F. Whiteaker farm, north of Monmouth.

The Whiteaker Cemetery is located on the Bengamin Whiteaker D.L.C.in Township 8S, Range 5W, Section 11. It is a private family cemetery about .01 of an acre in size. All known burials are related to the Whiteaker family. It is about three miles northwest of Monmouth, Polk,County, Oregon. The cemetery has been abandoned to nature. It was last read by Addie Dyal Rickey in 1973.

HISTORICAL RESOURCES

From the History of Oregon: Benjamin was sixth of his father's eight children and was ten years old when they crossed the plains to Oregon.  His duty on the journey was to drive the milch cows on horseback, and he performed his task to the satisfaction of all parties.  After the arrival and settlement on the donation claim he remained at home until he was twenty-one and then went with his brothers to eastern Washington to engage in the stock business, and they took with them 225 head of cattle; because of the severity of the winter they lost nearly all of their stock.  About this time the war broke out, mining began in Idaho, and prices advanced. This naturally benefited them and in time they became wealthy.  Benjamin then went to Polk County and purchased a half section of land off the John Fudge donation claim.  After his marriage the couple resided in Washington for a year and then returned to Oregon and lived on land left him by his mother. He purchased more land by his mothers to total 800 acres.

DISCREPANCY - Monmouth Herald obituary gives birth year of 1835, while death certificate and marker give 1838.

NOTE - His second wife, Adelaide, and two of his children, Glendon Whiteaker and Nellie (Whiteaker) Kantner, are buried at Salem Pioneer Cemetery in Salem, Oregon.

OBITUARY:
The Herald made mention, last week, of the serious illness of B.F. Whiteaker, who was stricken with paralysis while transacting business at Independence. Mr. Whiteaker was taken home and under the care of a physician seemed to rally, but taking a relapse died on Saturday morning, August 24, 1912, and was buried on Monday.

He was born in Illinois, May 25, 1835, and came with his parents to Oregon in 1848. They located in Polk county and the Whiteaker homestead marks their enterprise. He was twice married, his first wife being Narcissa Hamar, and to this union were born W.H. Whiteaker, of Portland; A.J. Whiteaker, of Raymond, Wash.; Mrs. W.O. Cook of Eugene, and Mrs. E. Roe of Enterprise.

After the death of his first wife he married Miss Adelaide Fetzer, to whom were born Mrs. Etta [Nettie] Kantner of Seattle and Frank and Glenn Whiteaker of Cochrane, Ore. Deceased was a man of warm and generous impulses. His friends were numbered by his acquaintance, and he was a fine type of the pioneer. His home was always open and his hand ready to help the suffering and needy. He gave liberally to worthy public enterprises and at the time of his death was engaged with others in drilling an oil well on his extensive farm.

The History of Oregon:
George was six years old when they crossed the plains to Oregon.  After his arrival he had a severe attack of mountain fever and it affected his memory of the journey. He attended public schools and remained with his father until he was twenty-seven years of age, when he married.

After his marriage he settled on the donation claim of his brother William Whitaker which contained 320 acres.  This farm he purchased and farmed for twelve years.  He is a stockholder in both the banks of Independence and has been a director of the First National Bank since its organization.

HON. JAMES L. COLLINS

The marriage of Judge Collins occurred in Polk county in 1861, Miss Mary Whiteaker becoming his wife. She was born in De Kalb county, Ill., in 1846, the daughter of Benjamin Whiteaker, who was one of the pioneers of Polk county in 1847, and a relative of John Whiteaker, the first governor of Oregon. Mrs. Collins died in 1864, leaving one daughter, Nellie, who is a graduate of La Creole Academy, the state normal school at Monmouth, and the New York state normal college at Oswego, N. Y. She is now critic in the state normal school at Madison, S. D., which position she has occupied for the past ten years.

In 1862, the brothers packed to the Florence Mines; in 1863 they moved their mother and their respective families from Oregon; in the following year engaged in freighting from Umatilla Landing and Walla Walla to Boise; in 1865 made two trips to Kostenia, British Columbia and one to Helena, Montana and then sold their pack outfits and in the following summer freighted with teams to Colveille and to the old Hudson's Bay Company's fort.

went to Illinois with his parents and ten years later crossing the plains with his parents to Oregon.  In 1862 he came to Walla Walla and for two years was engaged in packing between the point and the Idaho mines.

They were married at the home of James Smith of Polk County, by J. W.Stahl, Minister of the Gospel. Witnesses Benjamin F. Smith and William Jones. 

In 1865 they bought the farm on which they now live, lying on both sides of the Touchet, near the mouth of Whiskey Creek.  He owns 560 acres of land.  John raised cattle and later sheep and sold this business to his brother Adam and his son James H. Fudge.

James is a member of Latah Lodge, No 76, of Spokane Co.  He is identified with the Republican party, has served as a member of the County Central Committee, was a delegate to the State Convention at Ellensburg in 1881, was a member of the Board of Directors of school district No 20, and served an equal length of time as Road Supervisor.

Crossed the plains at age nine with his parents Adam and Catherine to reach Oregon. 

After his father's death, William remained with his mother on a farm and assisted on the farm.  In 1859 he moved to Walla Walla to start in the business world where he was successfully engaged in farming and in the raising of livestock. 

In 1884 he moved to Whitman County and his success as a cattle man and a farmer continued and he acquired fifteen hundred acres of valuable land.  He lived his retirement years in Waitsburg.

1870 Washington Territory Census, Waitsburg Township lists William, age 33, farmer, Elizabeth, age 22. Living on their farm is Francis Dice, farmhand.

Found in a scrapbook, with the date of Jan 31, 1917...WILLIAM FUDGE IS DEAD. Oregon Pioneer of Early Forties dies at Walla Walla..Walla Walla, Wash., Jan 30 - (Special) - William Fudge, prominent valley pioneer of 1859 and an Oregon pioneer of the early '40's died here today in his 80th year. His father and the family started across the plains by ox team with an immigrant train of 300 teams.  The trip proved a horrible one, as some of the party became separated from the main train and were set upon by Indians and massacred.  The family settled near Dallas, in Polk County. During the gold excitement in California, his father went there and died.  Adam Fudge had brought his family from Illinois with the Whitikers and McGhees, pioneers, and settled near the Tucannon River.  He is survived by his wife.  There are no children. In 1872 he came to Walla Walla, WA where he lived the remainder of his life. 

For five years Adam engaged in the butcher business in Waitsburg and then purchased a ranch in Whitman County.  At his death he left his widow a valuable tract of eight hundred acres of land in Whitman County.  Adam took a very active part in the ODD Fellows lodge and was a staunch supporter of the Republican Party.  He was a man of good business and executive ability. Scrapbook - dated about 1901, located at the Oregon State Historical Society Library, Portland, Oregon. Walla Walla, WA. May 20, - Adam Fudge, aged 55 years, a pioneer of the Pacific Coast, and for many years a resident of Endicott, Washington, died in this city late last evening.  The funeral will take place at Waitsburg under the auspices of the 100F Lodge.  The exact date has not been set.

From family stories handed down, John was a gambler and kept race horses. It is told the Litton Plantation was a good place to raise hell on weekends.

Family stories having him joining the US Army after the war ended and supposedly dying in the Mountain Meadow Indian Massacre in 1867 Utah. This was the story told by his son, Lilburn to cover the fact that he may have deserted his family. This story is documented in "Russell County, Virginia: History Revealed Through Biographical and Genealogical Sketches of Its Ancestors" M. Secrist, Lulu Press, Inc, Feb 18, 2013.

However, the massacre took place in 1857. The Mountain Meadows Association has the following information showing he was not a victim of the is massacre.

The MMA investigates every person who is believed to have died in the Mountain Meadows Massacre. According to a family tradition, John Whitely Litton died in a "Mormon Indian Massacre in Utah", in 1867. Although the Mountain Meadows Massacre took place in 1857, stories usually get some facts wrong, and he was investigated as a possible victim.

John Whitely Litton was the son of John S. Litton and Catherine Younce, born 5 March 1830 in Elk Grove, Russell County, Virginia. He married Lydia Eva Whitaker on 14 May 1845 in Russell County, Virginia. She was the daughter of Moses Whitaker and Polly Bowman. In the 1850 census, they are enumerated in Russell County, Virginia, and in the 1860 census they are enumerated in the Western District of Washington County, Virginia. Lydia (Whitaker) Litton is enumerated as a widow in both the 1870 and 1880 census for Washington County, Virginia. These census records indicate that Litton probably died sometime between 1860 and 1870, and not before 1860, which would have been the case if he was a victim of the Mountain Meadows Massacre in September 1857.

John W. Litton was in Wade's Regiment, Local Defense (Washington County VA Militia), in April 1862, before he enlisted in the Confederate Army. Litton served the Confederacy during the Civil War, in Company A (originally Stevenson's Company, Ferguson's Battalion) of the 16th Virginia Calvary. This Company was primarily made up of men from Russell County, Virginia. John W. Litton was a wagon master in the Civil War. Most Confederate records from Virginia were burned in Richmond, however a copy of a Company Muster roll for 31 October 1863 to 1 April 1864 shows he enlisted 5 August 1862 at Lebanon, VA. for a period of 3 years. He was signed in by Capt. Stevenson. He appears on a Receipt Roll for pay on 31 December 1863. He was paid $.25 for service from 1 August 1863 to 31 December 1863. These records indicate that Litton was still alive in at the end of December in 1863. There is no record of Litton's wife filing for a widow's pension.

Lydia (Whitaker) and John W. Litton had seven children. The two youngest children were Clementine Catherine Litton, born in September 1861, and Mary Cordelia Litton, born 31 March 1865. The birth of Litton's youngest daughter indicates that he was living in 1864. The census records, military records, and birth date of his youngest daughter, prove that he was not a victim of the 1857 Mountain Meadows Massacre.

Another family story states that when he returned from the Civil War, he didn't like the reconstruction, so he enlisted in U.S. Army and was sent to Utah, where he died as an Indian fighter. A different story said that he settled in Texas and married again. He was rumored to have several children and was living in Campbell County, Texas. [Note: There is no Campbell Co. TX. There is the town of Campbell in Hunt Co. TX] No evidence, that would support either story, has been found.

In Lydia (Whitaker) Litton's father's will of 31 March 1874, proved 22 November 1875, Moses Whitaker left her land, and other property, and further stated that the "devise to Lydia E. Litton, dau., are not to be liable for any debts due for any one from her husband, John Litton, if he is now alive." When and where John Whitely Litton died remains a mystery. It is evident, from her father's Will, that as late as 1874, Litton's wife did not know what happened to her husband. She never remarried, and Lydia Eva (Whitaker) Litton died 14 May 1901 and is buried in the Hayter Cemetery in Abingdon, Washington County, Virginia.
