MILITARY RECORDS

On Oct.7, 1777, Henry Co. VA., Moses renounced allegiance to King, swears allegiance to VA. The Library of Virginia in Richmond lists Moses Parsley in the Bedford Co. VA Militia during the Point Pleasant campaign in 1774.

He fought in Lord Dunmore's War under Captain Abraham Penn of Bedford County. Dunmore's War was a conflict between the Colony of Virginia and the Native Americans of the Ohio Valley. Following increased raids and attacks on frontiersmen in this region, the Royal Governor of Virginia, Lord Dunmore, organized a large force of militia and marched to Fort Pitt arriving at the end of August 1774. Dunmore also ordered Colonel Andrew Lewis, commander of the southwestern Virginia militia, to raise an army in the south and meet Dunmore?s force along the Ohio River. Lewis formed militia companies from Augusta, Bedford, Botetourt, Culpeper, Dunmore, Fincastle, and Kentucky counties. After Colonel Lewis' victory at the Battle of Point Pleasant, Dunmore successfully negotiated a peace treaty with the Delaware, Mingo, and Shawnee chiefs that prevented them from settling or hunting south of the Ohio River.

He fought at the Battle of Point Pleasant. This was a conflict between the Native American Confederation under the Shawnee chieftain Keightughqua, or Cornstalk, and the colonial forces under General Andrew Lewis. It was one of the bloodiest, hardest-fought battles ever waged between the early settlers and the Indians.

The Virginians suffered a loss of eighty-one men and one hundred forty were wounded. Chief Cornstalk's fatalities were enormous. He lost two hundred men and had twice as many wounded. The result was a victory for the Virginia colonists and the opening of the area for permanent settlers. This opened the way to rapid western expansion.

Some historians consider the Battle of Point Pleasant the first battle of the American Revolution in spite of the fact that this battle actually took place six months before the documented beginning of the war. However, no one questions the importance of this battle, which thwarted an alliance between Native American forces and British collaborators and established a peace with the Indians for the first three years of the Revolutionary War.

The Shawnee had never given up their claims to western Virginia and interpreted the rapid settlement of whites into the area as acts of aggression. Hostilities reached a climax in 1773 when a group of volunteers from Fort Fincastle raided Shawnee towns. One of the worst atrocities of the conflict was the murder of several family members of Mingo chief Logan. Logan, who had previously lived peacefully with the settlers, killed at least 13 western Virginians that summer in revenge.

The Battle of Point Pleasant, fought between the Long Knives of Virginia and the Shawnee Indians and their allies on October 10, 1774, was the final battle of Governor John Murray, the Earl of Dunmore, and is considered by many to be the first battle of the American Revolution. It is said that when George Washington surveyed the area in the 1740s, he referred to it as the Pleasant Point.

Cornstalk was the principal chief of all the Shawnee sects at this time. He led both the Shawnee warriors and other tribes who joined the Shawnee in this battle. The Shawnee, who had lived in this area for hundreds of years, were hunters and farmers. They burned parts of the forests to make fields, and then they grew maize, beans, and pumpkins. They lived in wigwams, which they made by bending small trees and tying them together, then draping animal skins over them.

Virginia Governor John Murray, Earl of Dunmore, plotted to crush the Shawnee and end hostilities. Dunmore drew up a plan to trap the Shawnee between two armies. The governor personally led the northern army while land speculator Andrew Lewis led a smaller force from the south. But Shawnee leader Cornstalk struck the southern regiment before it united with Dunmore's troops.

On October 10, 1774, Cornstalk's force of approximately 1,200 men attacked Lewis at the confluence of the Kanawha and Ohio rivers at present-day Point Pleasant. After the battle, which resulted in significant losses on both sides, the Shawnee retreated to protect their settlements in the Scioto Valley in present-day Ohio. As a condition of the subsequent Treaty of Camp Charlotte, the Delaware, Shawnee, and Mingo relinquished all claims to land south of the Ohio River. The Battle of Point Pleasant eliminated Native Americans as a force on the frontier for the first three years of the American Revolutionary War, which began in April 1775, clearing the way for peaceful settlement of the region.

I Moses Parsley of the County of Russell and common wealth of Virginia being weak in body, but of perfect sound mind and memory, do this thirtieth day of August in the year of our Lord one thousand eight hundred and thirty one, make this my last will and testament in manner and form following.

I will and bequeath to my loving wife Obedience all my estate real and personal during her natural life to make use of at her discretion for the support of her to have and to hold it without any appraisement or sale.

James enlisted, along with his sons William James and John to fight for the Confederacy. in Co. C of the 34th Virginia Cavalry under Col. W. A. Witcher. He is listed as Whitaker, Sr. J. with the rank of private.

James was killed by Union marauders or bushwackers at his gate. He lived on Belcher Ridge, later known as Whitaker Ridge, which straddled Tazewell County VA and McDowell Co. WV. This area was a battleground between Confederate and Union sympathizers, pitting neighbor against neighbor and sometimes splitting families. All of his neighbors supported the Confederacy, but the area wasn't immune from raiding parties of Union soldiers or Union partisans.

One piece of family lore that has been handed down is that he taught singing by notes and using a pitch pipe to get the key.

I, Jerry WHITEAKER, of Washington County, Virginia, do make this my last will and testament hereby revoking all other? wills formerly made.

1st I desire all my just debts paid.

2nd I give and bequeath to my beloved wife Martha Elizabeth, one? buggy and one half (1/2) of all my house hold goods except as hereinafter bequeathed- I further devise to my wife Martha Elizabeth, during her life, the Mansion house and all its? appurtenances and I hereby charge the lands herein after devised,for the support and Maintenence of my wife as follows: The parts devised to my son Charley and daughter Susie Rush, with one third of the proceeds of said land and they are to take care of and support my wife according to her station in life. The parts devised to J.J. COLLINS, Sallie McDANIEL, Ollie? GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, with Four dollars per year each to be paid in Money. I give to my wife the horse called Charley; the Mare called Daisy I desire to be sold and the proceeds paid to my wife.

3rd Because of the labor performed for me and his kindness and attention to my wife and I, I give to my son Charley all my farming implements. I further give and devise to my son Charley, fifty acres (50) of land, Commencing at Lester and Clyce's corner on the North side, coming with line to mine and Clyce's corner west of the school house; then coming east to corner at junction of creek and lane; then south to Jonesville road; then go east south of the road until he gets fifty acres.

4th I give and bequeath to my daughter Susie RUSH because of her faithful care and attention, one half of my household goods and one buggy. I further give and devise to my daughter Susie, fifty acres of land commencing at mine and Clyce's corner, thence south to the school house corner and mine and Clyce's corner; then with school house lot down the creek to the cross road; then with said road south to Jonesville road, then east until she gets forty five acres of land, then she is to have five acres of the timber land and at the death of my wife I devise to her the mansion house and its appurtenances.

5th I give and bequeath to my daughter Sallie McDANIEL the bureau and wash stand in my bed room.

6th The residue of my land I give and devise equally to my children Jane COLLINS, Sallie McDANIEL, Ollie GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, subject to the charge upon it, contained in the first clause of my will?.

7th I give to Vic Rush my log chain. It is my desire and will that the salt kettle, which now sits at the spring, remain in its present location for all time.

Notes:

Jane was 4 years old when Mother died.
She raised a child of her sister Mary Rachel, Susan Ayres, who was their heir.

She became prominent in Knoxville Tennessee society because her husband was twice mayor, was a wealthy industrialist and bank president.

CIVIL WAR SERVICE

In the Fall of 1862 at Dry Fork, John enlisted, along with his father James and his older brother William James to fight for the Confederacy. John served in Co. E of the 34th Virginia Cavalry under Col. W. A. Witcher until the war ended at Appomattox in April, 1864. He was about 16 years old when he became a soldier.

34th Virginia Cavalry (CSA)was probably the most distinguished confederate unit in West Virginia history. The 34th Virginia Cavalry's core company, Company A, was formed in Wayne County.

Buchanan County Men in the Civil War: "The 34th Virginia Cavalry came into being in September, 1861. Early in the war, the 34th operated mostly in the region between Grundy and Piketon (Pikeville). Many times,the 34th won the distinction of being the advance guard on operations involving numerous units, including the Confederate armies advance into Pennsylvania.

The 34th fought an engagement within 2 miles of Harrisburg, Pennsylvania in late June, 1863. The 34th then fell back and occupied the city of Carlisle, Pennsylvania, before being called to Gettysburg. The East Cavalry Battlefield is generally credited as a Union victory because the goal of the Union Cavalry to delay Gen. J.E.B. Stuart's Cavalry on July 3rd was accomplished. On the morning of the 4th of July, 1863, it was Lt. Col. Vincent Addison Witcher of the 34th VA and General Stuart who walked the battlefield. The Western Virginia men of the 34th, along with only a portion of the rest of the Brigade, had fought the 1st New Jersey, 3rd Pennsylvania, 5th Michigan, and the 7th Michigan led by newly promoted Gen. George Armstrong Custer. The 5th Michigan was armed with the 7 shot Spencer repeating rifles.

Witcher later wrote: "the 34th Battalion, which had alone rallied with me, opened upon the 5th Michigan, sweeping down its ranks with a most deadly fire, killing its Major, capturing its colors, and covering the ground with the killed and wounded men and horses of the 5th Michigan. I was within 30 yards and saw the Major fall, a gallant and heroic man he was."

General Stuart said "the34th had made the worse massacre of Alger's command and had piled more dead and wounded men and horses on as little space as he had ever seen on any field." The 34th had dismounted that morning with 332 men. After the war, Witcher wrote: "I shall never, no never, forget that eventful night when accompanied by one courier, my Adjutant Edwards and Sergeant Major, both being wounded, I full of grief and bitterness, rode to the barns in our rear and saw with tears in my eyes, my brave fellows from away over the mountains in West Virginia, laid out in windrows, torn and bleeding. I shall never forget that night or the next mornings parade when I could muster but 96 enlisted men. Brave fellows, not a slave holder among them."

[John Whitaker in his 1923 Civil War pension application he said, "I was in the battle of Gettysburg three days and nights, and if I never performed any other military service for the state of Virginia, this baptism of fire and shell should certainly be sufficient credit for my eligibility rolls, at least it seems so to me after 57 years have passed by. I am old and worn out and tired. Have perhaps lived beyond the allotted time already, and if the pension does not come pretty soon. I will not need it."]

The 34th was also given the honor of leading Lee's Army back into Virginia. "The Virginians, and they were almost all that, whether from the counties of Southwest Virginia or the mountain counties of the new state of West Virginia, left knowing they had fought with honor."

He kept bees. Sold honey. Buried his money in jars around the yard. Nancy Whitaker Tate would go with him when he would go get his jar of money.

He would sit on front porch with a fan and visit with folks that came up the road. He kept a gallon jar of his "medicine" of rock candy and whiskey. He would take a sip when for medicinal purposes.

He would bake potatoes in the fireplace ashes and pop popcorn in the fireplace. This was a real treat for the grandchildren.

At Christmas, Nancy Whitaker Tate, his granddaughter, would wake up around 4 AM and go up to house. It was a game to see who was going to wake up first. He was always up when NWT got there. His nickname for her was "Shikepoke."

She spent most of her time with them as a child that she had her own bedroom with a feather mattress.

He would ride his horse and Nancy Whitaker Tate would ride double with him, hanging on the back. She was sent to get the horse, because it would run away if someone else rather than NWT came to get him. He was a brown sorrel horse named Doc. Scared of cars, and he would run away. Nancy Whitaker Tate would ride with no saddle or bridle. If a car came, he would stop and not run if she was on him. Nancy Whitaker Tate was a not yet in school. She would take him to a fence, and he would stand still until she would climb the fence and get on him, Then off the would go. He was used for riding to the mill and the store.

He met his first wife on Whitaker Ridge
