LAND RECORDS
In the Wakefield Manor court rolls for 1651 there is a record of a surrender of land in the Nethermoorecroft of the Northfield of Ossett for the use of Mark Whitteakers and his heirs

In the 1672 Hearth tax returns he is paying for 4 hearths.

28 MAR 1682 Of Ossett The will of Mark Whittaker

In the name of God amen I Mark Whittaker of Osset in the County of Yorks Yeoman doo make this my will in forme following.

First I bequeath my soul to God and my body to decent buriall; and as touching my effects my will is that my oldest sonne Thomas shall have the revetion of the house wherein I now dwell & the buildings thereto belonging after my wive's death which I have surrendered accordingly, And also shall have after her death the farm thereto adjoining & all oth lodge farms which I now hold and have under the Right Honorable the Lord Brudnall and his lady; item I give the said Thomas the interest and Tomiant right of the farme wherein he now dwells which I hold under Mr James Oates in Ossett aforesaid, he paying the rent and and performing the covenants for the farme;

I give my second sonne Marke the farme at Hanging Heaton wherein he now dwells and which I hold under the Right Honorable the Earl of Halifax he paying the rents and performing the services for the farme;

And my will is that my wife take care of the further education of my sonne John now at Cambridge as shall be thought most fitt by my brother and other good friends;

Item I give to my sonne Robert three gross pounds [3 gross pounds is £432] for his portion; And to Dorothy wife of George Chaytor fourty pounds having already given her some considerable portion before;

Item I give to my daughter Mary three gross pounds [3 gross pounds is £432] for her portion;

All the rest of my personal effects I give to Mary my loving wife whom I make executrix of this my will and desiring her endeavor towards the education of my grandchildren Willam and George Speight in [hope] she will get some assistance from their grandfather Speight and their mother in [illeg].

In testimony whereof I have hereunto set my hand and seal this eight and twentieth day of March in the year of our Lord 1682 Marke Whittakers sealed and published in the presence of us Tho Stowell & Tho: Whiteakers.

Mark Whitaker's will does not mention her name - just his grandchildren William & George Speight.

Also there is a daughter of Mark Whittakers born the 20th December 1653, who could be her.

He is to have the reversion of the house after his mother's death.... He has the interest in the farm where he now dwells which I hold from James Oates of Ossett.

They (the jury) said that the persons named below refused to pay customary dues payable to the lords of the Manor, and their customary land was forfeit and should be seized?..the heirs of Mark Whiteaker.

2)The Court Baron, Wakefield 6 April 4 James II (1688)
It was attested by William Turner,gen, lords? tenant, that Thomas Whiteakers of Ossett, gen on 17 March 1685 surrendered into the lords hands the reversion, following the death of Mary Whiteakers of Streetside in Ossett, widow, mother of Thomas, of a messuage or residence at Streetside in Ossett and all ?outhouses, barns, structures, stables, folds, orchards, gardens, crofts, yards and easements appurtenant, now occupied by Mary or her assigns at an annual lords? rent of 5d: to the use of Joseph Richardson of Dunsfold, Surrey, clerk, his heirs and assigns for ever, on condition that if Thomas Whiteakers, his executors, administrators or assigns or any of them paid or caused to be paid to the said Joseph Richardson, his heirs, executors or administrator the sum of £26 15s on 29 September following without fraud or delay at the residence of William Turner at Wakefield, the surrender would become void.

What Thomas is apparently doing is giving away the family home and lands unless he can find a large sum of money by 29 September. That land is also going to someone in Surrey! The answer to what this is about may lay in the name of the person taking over the land title ? Joseph RICHARDSON. Thomas? mother was Mary RICHARDSON so the land may have been kept in the family after all.

The farm he inherited was held from the Earl of Halifax

The YAS publication of the 1709 Wakefield Manor Book records that he was a resident of Hanging Heaton and paid 3 shillings. He was a freeholder and copyholder in the graveship of Ossett (page 99).

He also paid (page 103) 5 pence rent for two houses and Lands in Ossett

His marriage is also recorded in the Northowram Register - Mr Mark Whitaker, shopkeeper in Wakefield married Dec 9 1709

In the rent rolls of the Earl of Cardigan for 1724 (Brudenell papers ARS/2 at Northampton RO there is a record of a Mark Whiteaker paying rent of £73/10/0 as a tenant in New Park, Dewsbury. In 1709 (ARS1) he he is listed as Mark Whittakers owing £3/11/3 out of a total rent of £36/15/-

Also in the will of William Ingham of Ossett (d 1723) there is: "I give to my four daughters Susannah, Elizabeth, Rachel, and Hannah, all the housing, malt killn, gardens, backside croft in a street called Westgate in Wakefield, now in the possession of Mark Whiteaker, (and others)..."

Mention is also made of Thomas, my eldest son, Francis, Joshua, daughter Martha and brother in law Joshua Haigh. This one document confirms Martha Haigh as being the person marrying Benjamin and the link to Francis in the next generation."
