Information on Giles Whitaker is from John Weldon Whiteaker's book, Whit[eakers of Claiborne County, TN.
Private in the Washington Co., N.C. Milita commanded by Captain James Scott from Aug. 31 to Dec. 1793. [This could also be his nephew Giles Whitaker, son of Richard.
Giles Whitaker evidently went into Claiborne County, TN in the early 1800's. He is found on Thursday, May 16, 1816 serving Jury duty. [Ref: Claiborne Co., TN County Court Clerk's Minute Book, 1815-1817, page 267].
Giles lived and died c 1831 in Claiborne Co. TN. Rice Whitaker was the administrator of the estate of Giles Whitaker.

Richard Whitaker of North Carolina and Washington County, Virginia by Joye Boardman
The significant portion of the information on Richard Whitaker and Rachel Bentley's descendants comes from Joye Boardman's book which is out of print. She kindly provided me her material via email with permission to post on this website.
"For a time it was thought Richard Whitaker, born 1752, was a son of Richard,Sr. and wife, Elizabeth Cary of Halifax Co., NC. After careful and extended research from many different sources,this Richard is not a son of the Halifax County Whitakers. It is possible he is a relative of the large Whitaker family from Virginia and North Carolina but that must be researched further."
David Whitaker, son of Benjamin and grandson of Richard, tells in the History of Oregon, page 886, that "Grandfather Richard Whiteaker emigrated from Wales previous to the Revolution and settled in North Carolina, where he married Rachel Bentley and reared a family of five sons and four daughters. He was a participant in the Revolutionary war and lived to be eighty-two years of age."
Richard may be the son of either Mark Whitaker or James Whitaker whose adjoining plantations lay southeast of the Bentley plantation on Bear Creek.
Cheryl Duke's notes: The evidence is pointing in this direction for several reasons. No immigration record has been located o his coming from Wales, nor is there any record of his being an indentured servant.
Given the patterns of families and neighbors migrating from one location to another,it was unusual for a man without any ties to come into an area and be readily accepted. Especially to marry into an extended family like the Bentley's. Also, a person needed to have farming and survival skills to settle on the frontier. Coming from Wales and settling in the wilderness, a person would need friends or family to help in the process of adjustment. With the Whitaker's and the Bentley's both being from counties in Maryland that were close to each other, there would probably be a comfort and connection that would make it easier to establish communication and being neighborly.
So it is more likely that Richard is the son of James Whitaker, as the name Mark doesn't appear in the names of his son or his descendants. On the other hand, Mark Whitaker Jr.'s offspring do continue its use. Only DNA evidence will ultimately confirm what written records do not.

NORTH CAROLINA COURT AND LAND RECORDS
The Rowan County North Carolina Court Minutes dated 8 Aug 1778 list those persons who "refused of neglected" to take the Oath of Allegiance to the state. Included in the list for Capt. Lyon's District is the name Daniel Bentley, and the names of Bentleys neighbors: Mesheck Davis, John Willcockson, Snr., Mark Whitacre, Adam Hall Snr., Samuel Willcoxson and Israel Willcoxson being also on the list.
From Civil Action Papers, Lincoln Co., NC Richard Whitaker vs Michael Buff. In same papers, Whitakers on a 1782 List of Rowan County property owners, summoned with regard to confiscation of their property: Alexander, Henry, James, Jiles, Richard. See Rowan County Register August 1988 by Jo White Linn.
A list dated 3 November 1782 details the names of men living in Capt. Pearson's Company who were summoned by William Butler, constable, to show why their property should not be confiscated. Included in the 1782 list are the names of Anthony Pealor [Peeler], John Wilcockson, Danul [Daniel] Lewis, and "Richard Whitaker Runaway." "Runaway" simply meant the individual was no longer in the area. This was Richard Whitaker's case as he moved with Thomas Bentley's family in 1782 to Lincoln County, North Carolina, having married Thomas Bentley's daughter, Rachel Bentley.
Note from Cheryl Duke: It appears the families were victims of claim jumping, In 1777, a confiscation act was passed during during the Revolutionary War, seizing the lands of Lord Granville for the state of North Carolina. Settlers on Granville lands had to reapply for a new state land grant to their farms, and many lost everything to claim jumpers. Also on this list were John, Henry, Alexander and James Whitaker, along with Jiles Whitaker listed as a runaway (meaning he was no longer in the area).
Rowan County, North Carolina Tax Lists 1757-1800 Annotated Transcriptions, by Jo White Linn, 1995, Preface pp. xi - xv. "Because Rowan County lay within the Granville Proprietary and because the Granville Land Office snapped shut in 1763 and never reopened, there was no way for a person to gain title to vacant land for the fifteen year period until the State Land Office opened in 1778. Because many of the settlers who flooded into the area during the period could not gain title to land, their names do not appear in the deed records and cannot readily be confirmed by other records."
"Conscientious objectors, such as Quakers, Moravians, Menonists, and Dunkers, and those who refused to swear allegiance to the State were charged a three fold tax." Mark Whitaker was listed on the list of those not taking the oath of allegiance, so if the family was percieved as being Loyalists or Tories, then they paid in money and enmity from Patriot neighbors.
In 1782 Thomas, his wife Hannah, and some of the children moved to the Indian Creek area of eastern Lincoln County, North Carolina. Accompanying Thomas and Hannah were Daniel and Nancy (Lewis) Bentley; Meshack Davis, who had married Thomas and Hannah's daughter Lydia about 1774 in Rowan County; Richard Whiteaker, and his wife Rachel Bentley; and Thomas and Hannah's daughter, Margaret, who would later marry William Yonts in Lincoln Co. NC.
Rachel's sister Mary married Aaron Freeman according to the Rowan County records. "Freeman, Aaron to Mary Bently, 17 dec 1769, Bentamin Bently, bondsman, Thomas Frohock, wit consent from Thos. Bently for his daugher Mary, 17 dec 1769, Benjamin Bently, James Freeman, wit."
Richard Whitaker was a very good friend of Aaron Freeman, and they named their sons Aaron, Benjamin & Thomas.
On 1 September 1795 the widow Hannah Bentley and her son, Daniel, sold to George Savage and Catherine Bollinger the plantation on which Hannah lived.
1 September 1795. Hannah Bentley & Daniel Bentley of Lincoln County to George Savage & Catherine Bollinger, both of Lincoln County, for 20 pounds, a tract of land that Thomas Bentley bought of Thomas Welch in Lincoln County on the waters of Indian Creek on the south side of the creek, it being the plantation she [Hannah Bentley] now lives on. It being the land [25 acres] that was accepted [excepted] in the deed that Daniel Bentley made to Jacob Bollinger [doesn't give boundaries] Signed: Hannah Bentley (her mark), Daniel Bentley. Witnesses: Benj. Moore, Richard Whiteakker, William Yonts. Lincoln Co., NC, Deed Book 18, page 146.
Richard and wife, Rachel, moved to Washington County, Virginia, from the Lincoln County area of North Carolina. This is where Richard resided until his death on 18 October 1838.
WASHINGTON COUNTY VIRGINIA RECORDS
Richard Whitaker came into Washington County, Virginia from North Carolina sometime around 1796. [Ref: Washington County, VA Personal Property Tax Lists 1782-1840]. Listed are Giles Whiteacre and Richard Whiteacre. Richard Whitiker is listed with various spelling of the name from 1796 until his death. The 1810 Index to the Census of Virginia lists Richard Whitaker living next door to James Whitaker. Isaac Whitaker is listed under a different household.
It can only be conjectured as to why Richard and his sons came into Washington County, Virginia; perhaps they were attracted to the salt deposits on the North Fork of the Holston River. They evidently had means as they purchased land shortly after coming in the County. Dr. Joseph E. Williams, Professor at Emory & Henry College suggested they perhaps came for the salt at Saltville, VA.
Benjamin Whitaker stated he had 5 brothers and 4 sisters. Absalom Rufus Whitaker, grandson of Richard named seven brothers and three sisters in his Bible. Why the others were not named remains a mystery. They could have been older or died as youngsters.

Nov 25, 1814 Washington Co VA [Deed Bk 6, page 21; page 319 in DB index] Richard Whitechor [Whitaker] and his son, Moses purchased two [2] tracts of land belonging to Charles Thurman and his wife, Barbara, all of Washington Co VA for $600. containing 113 acres, patent bearing date of 10 Sept 1787 and 50 acres, patent bearing date of 5 Nov 1798, lying on both sides of the North Fork of the Holston River. The 113 acres begins at a beech tree in an island corner to John Lee and crossing the river and a corner to John Lee on the south side of Little Mountain. p.6

1822 Washington County VA:Â Richard and John Whitaker witnessed the will of Rev. Isaac Chapman in 1822, the year Chapman died. Richard went bond to settle his estate which was settled in 1825.

James processed and sold salt from his property on the Elk Horn Branch of the North Fork of the Holston River, three miles east of Saltville. Apparently Alexander inherited the farm. James, Sr.'s land extended toward other Whitaker property which included Broadford to Big Tumbling, a stream cascading down from Laurel Bed Lake to end up in the town of Saltville. Professor J. Williams of Emory and Henry College, said the Whitakers operated a barge from Smyth Co. VA to Kingsport, TN carrying salt.

His will is dated Aug 4, 1854, with Codicil #1, dated Dec 7, 1854 and Codicil #2, dated Jan 18, 1856.
Children named in his will probated 19 Feb. 1856, recorded in Will Book 2, pp. 9-12, Smyth Co., VA, were Alexander, John, James, Jeremiah, Joseph, Thomas C., Polly, Jane, Elizabeth, and Susannah. Feb 19, 1856. In his will another child is listed: Rachie D. Johnston, who is probably a daughter of third wife, Elizabeth from a previous marriage.

The 113 acres begins at a beech tree in an island corner to John Lee and crossing the river and a corner to John Lee on the south side of Little Mountain. p.6
Moses and his father bought the first 113 acres which lay on both sides of the North Fork of the Holston River a few miles from Hayters Gap near present-day Tumbling Creek.

This cause came on the 15th day of May 1839 to be heard upon the bill, the answer of Uriah Bowman and the verdict of the jury rendered upon the issues to ascertain whether the paper in the bill mentioned is the last will and testament of Esaias Bowman, deceased, and was argued by counsel, and it appearing to the satisfaction of the court that the specifications and conditional order has been returned executed on Samuel Bowman, Benjamin Bowman, Esaias Bowman and Aaron Bowman more than four months before the commencement of this term, and they still failing to appear and answer, the bill as to them is taken as confessed..and it also appearing to the satisfaction of the court, that the order of publication, awarded at the rules in the Clerk's office against the defendants, Absalom Bowman and George Washington Bowman, has been duly posted and published, and they still failing to appear and answer, the bill as to the, is taken for confessed..and Wm. S. Logan, Sheriff of Washington County, to whom the estate of Esaias Bowman, deceased, with the bill annexed, was committed to be administered having consented that this cause might be heard and determined at this term..it is therefore adjudged, ordered and decreed, that the paper in the bill mentioned purporting to be the last will and testament of Esaias Bowman, deceased, and which bears date on 24 Aug of 1837, and which was admitted to record in the county court of Washington County on 23 day of Oct 1837, is the true last will and testament of Esaias Bowman, deceased, and therefore, it is further ordered and decreed the plaintiffs ill be dismissed and that the defendants recover their costs by them about their defense in this behalf expended.

The Whitakers lived on his property and farmed until his death on September 14, 1875. He is buried in a cemetery on his property, now called the Hayter-Litton Cemetery near Hayters Gap, Virginia. His stone is marked Moses Whitaker, "Father." Next to Moses is buried his daughter, Lydia E. Whitaker Litton. Her stone reads Lydia E. Litton, daughter.

Joye Boardman notes she knows nothing of Thomas Whitaker except he was named as a son of Richard Whitaker in the bible of Absolom Rufus Whitaker. She does not find him in the Personal Property Tax Lists of WASHINGTON CO.VA 1782-1840.
[Note: I don't believe this Thomas is Thomas Hargis Whittaker born Jan. 16, 1788 in Virginia and died Jan. 16, 1869 in Greene Co. TN who married Jemima Edgemon. Joseph Whitaker and Obedience (Biddie) Perdue of Wythe Co. VA are the likely parents of Thomas Hargis. Here is the best source for this line:

Washington County, Virginia Deed Book 20, page 26 In 1827 Polly Hayter, Richard Whiteaker and Adam Fudge, Jr. went bond for the estate of William Hayter, deceased, with Polly Hayter as the administrator. We know Richard Whitaker was the father-in-law of Adam Fudge, Jr. More than likely this Polly Hayter was the daughter of Richard and widow of William Hayter.

MIGRATION
1836...Benjamin and his family left Virginia and moved to Lee County, Illinois, staying in this country for eleven years where three more children were born.
1848...The family left Lee County, Illinois, and crossed the plains in a covered wagon to Oregon, taking with them eight yoke of oxen, three wagons and his carpenter tools, two plows and harrow teeth that were made of inch square iron. They also took with them the family bible and a few books and some of the family relics, which they prized. The family also brought with them the staples for some months provisions, and thus equipped the pioneer, Benjamin Whitaker, and all he held dear on earth cut loose from civilization to cross the plains, which were infested with savage beasts and little less savage Indians (Ref: History of Oregon, Page 886). They found a home for themselves in the mild climate of the beautiful and rich Willamette Valley in Oregon. They arrived at Foster's Farm on October 5th and on the 11th reached Polk County and the following spring purchased the Dr. Boyle donation claim of 640 acres of choice land. The price paid was $250.00 which was less that forth cents an acre. On the property Benjamin raised his family and resided until his death in his seventy-sixth year.

Will of Benjamin Whitaker and Probate
July 16, 1872...Polk County, Oregon...In the name of God amen, I Benjamin Whitaker of the County of Polk and the state of Oregon and of the age of seventy five years and being of sound mind and memory do make, publish and declare this my last will and testament in names as falls to wit.
First, I give and bequest to my wife, Polly Whitaker the sum of $100. Second, It is my will that the farm that I now own in Walla Walla County, Washington Territory inherited by me from my son William and the south half of my half of my donation land claim in Eight South Rouge in the County of Polk, and state of Oregon shall be sold and the proceeds equally divided among all of my heirs to wit. David, Whitaker, Rachel McGee, Benjamin Whitaker, Joseph R. Whitaker, Elen Levens, Mariah Ogden, George Whiter and Ellen Collins. Third, it is also my will if there should be any other property at my death it be divided among my heirs. Fourth, it is my will that if Elen Collins is not of age at my death, that my executors shall hold in trust for said Ellen Collins, all that she may inherit from my estate until she is of lawful age and then pay it over to her taking her receipt and if she should die before she is of age her share shall be equally divided between my lawful heirs. July 2, 1873..County Court of Polk County, State of Oregon..In the matters of the last will and testament of Benjamin Whitaker, deceased... To the Hon. Court of said County, Isaac Levens respectfully show unto the court that Benjamin Whitaker, a resident of said Polk Co., Oregon, died in said county and state on the second day of July AD 1873., that said deceased left a last will and testament; and that he therein appointed and designated Levens and George Whitaker his exec. The estate consists of real estate and personal property of about $3180.00 dollars and the legal heirs are David J. Whitaker, aged 48, Rachel McGee, age 41, Ellen Levens, age 40, Joseph R. OBITUARY
Obituary (published in a paper in about 1882)
"Never having noticed anything relative to the death of "Old Mrs. Whiteaker" in the papers, I thought it due to herself and her friends that something of her domestic history should be given publicity, while yet some of her old pioneer associates still survive her, and some of whom regarded her with that high esteem which respected worth always merits. This thought was suggested by my wife, who in years past has been the recipient of Mrs. Whiteaker's unbounded hospitality, and who frequently recalls to mind one incident in early life, when that hospitality was most generously extended, and most thankfully accepted. The remembrance of those pioneer days can never be obliterated from the memory, either by time or circumstances. Let the pioneer retrospect the past; call to mind his early associates, and attempt to number his survivors. He will find but few living of the many with whom he was familiar in those early days, and with whom he felt a degree of intimacy amounting almost to that of consanguinity.
In 1852, now about thirty years ago, my wife and self, with our two little ones, were coming from Yamhill, when we were caught in a very heavy rain storm. We were in an open wagon and pretty well drenched when we stopped at Mr. Whiteaker's house. Driving up to the fence, we were met by Mr. Whiteaker, who in loud tones exclaimed: "Hello! What the devil are you doing here? Get out of the wagon and come in the house; you are as wet as the devil." Well, we did as requested, and soon a blazing fire restored warmth to our chilled frames. Mrs. Whiteaker took my wife in charge, and she was quickly clothed in habiliments more congenial to the female sex than a water-saturated piece of calico. And now, after the lapse of thirty years, the kindly feelings manifested upon that occasion by Mr. and Mrs. Whiteaker are remembered by us with the most lively emotions of respect and regard; and more, not only the kindness and hospitality manifested upon that occasion entitled them to our highest regard, but during many years thereafter we received many manifestations of their kindly disposition towards us, that makes the remembrance thereof pleasing reminiscences of the past. But today where are they? Gone to that mysterious realm from which there is not return, and to which we are all hastening.
Mr. Whiteaker was a man of very jovial and merry disposition. Upon one occasion ex-Gov. Whiteaker called upon him and made inquires to ...whether or not there was any relationship between them. Mr. Whiteaker remarked: "I do not claim kin with every scalawag that comes along, but as you are a pretty good looking man, and appear to have some sense, if you can show that we are kin, I'll acknowledge the corn." This was many years ago, and it occurs to my mind as one of the many incidents that go to show the natural tendencies of his disposition, for upon many occasions have his sallies of wit caused much merriment. For his associates: yet, withal, he was a man of strict integrity, of unbounded hospitality, and his rule was to do as he would be done by. How often do the hearts of the old settlers, when calling to mind the struggles and toils incident to pioneer life, bound with a fresh impulse at the remembrances of the social equality, the generous dispositions and disinterested sympathy which characterized them in the intercourse with each other. Almost isolated from civilized life, bound together in a common destiny, each felt the other a warmer friendship that is much of the characteristic of society of the present day. The onward march of time is fast removing from the scenes of active life the "Old Pioneers." Soon the last one will have obeyed the dreaded summons, and the recollection of their hardy toil and struggles in the advancement of civilization will be but a matter of history.
In the death of Mrs. Whiteaker the ranks of the pioneers number one less of that noble band of women who braved the dangers of the wilderness with a heroic devotion to life's duties, worthy a remembrance in the hearts of all who survive her. There is naught in the remembrance of her domestic life but what should bring consolation to all her surviving friends and relatives.
Mrs. Whiteaker was born in Washington County, Virginia, in 1808. Her maiden name was Mary B. Hayter, she married to Benjamin Whiteaker in 1823. They went to Illinois in 1836, where they resided about eleven years. They then came to the conclusion that they would cross the plains to Oregon. In 1848 they bade adieu to friends and started on the perilous trip with sanguine hopes, that with patience and perseverance they would reach the goal of their desires and build upon them up a happy home, where peace, plenty and contentment might bless them through life's pilgrimage. In October,1848, they settled in Polk County where they made a continued residence up to the time of their death, known and respected by all their neighbors as kind , genial, and hospitable in all life's associations.
On the 1st day of December, 1882, Mrs. Whiteaker yielded up her spirit, to God who gave it, serenely and calmly, with the precious hope of ascending. ... She leaves seven children, to whom she leaves the priceless legacy of an honored name, and whose memory will be long cherished by all who knew her, for to have known her was to have formed a deep-seated friendship, and her friendship was indeed a boon, as was indicated by the warmth of her heart and a generosity that was without limit. She is gone and we are left to linger for yet a brief hour before we join the vanished numbers of the pioneers that were."

The Whiteaker Cemetery is located on the Bengamin Whiteaker D.L.C.in Township 8S, Range 5W, Section 11. It is a private family cemetery about .01 of an acre in size. All known burials are related to the Whiteaker family. It is about three miles northwest of Monmouth, Polk,County, Oregon. The cemetery has been abandoned to nature. It was last read by Addie Dyal Rickey in 1973.

Benjamin Whitaker reported in the above report that he was from a family of nine [9] children. Five sons and four daughters. Adam, Catherine and their children followed her brother, Benjamin Whitaker to Illinois. In the Fall of 1835 they emigrated to Putnam County, Illinois where they
remained until the fall of 1836. They stayed in this area until March 7, 1847, when they joined Benjamin and family and headed west on the Oregon Trail crossing the continent to Polk County, Oregon where Adam secured a farm and engaged in its operation. Mr. Fudge took a donation claim on the Territorial road between Salem and Corvallis consisting of 640 acres. Their trip west began by crossing the Missouri River at St. Joseph and then proceeded by way of Platte River, Soda Springs, Green River, Snake River, the Barlow Toll Road through the Cascade Mountains, Grande Ronde Valley, across the Blue Mountains at the present site of Pendleton, and finally arrived in Polk County, Oregon.
Adam died in an accident in 1848. Catherine is 45 years old and left with 10 children, ages from 20 thru 5 years.

James enlisted, along with his sons William James and John to fight for the Confederacy. in Co. C of the 34th Virginia Cavalry under Col. W. A. Witcher. He is listed as Whitaker, Sr. J. with the rank of private.
James was killed by Union marauders or bushwackers at his gate. He lived on Belcher Ridge, later known as Whitaker Ridge, which straddled Tazewell County VA and McDowell Co. WV. This area was a battleground between Confederate and Union sympathizers, pitting neighbor against neighbor and sometimes splitting families. All of his neighbors supported the Confederacy, but the area wasn't immune from raiding parties of Union soldiers or Union partisans.
One piece of family lore that has been handed down is that he taught singing by notes and using a pitch pipe to get the key.

Laura Gaynell Whitaker Pannell said that during the early part of the 1800's, the three brothers came to Southwestern VA. Alexander settled in Saltville. She was one generation off on this information.

I, Jerry WHITEAKER, of Washington County, Virginia, do make this my last will and testament hereby revoking all other? wills formerly made.
1st I desire all my just debts paid.
2nd I give and bequeath to my beloved wife Martha Elizabeth, one? buggy and one half (1/2) of all my house hold goods except as hereinafter bequeathed- I further devise to my wife Martha Elizabeth, during her life, the Mansion house and all its? appurtenances and I hereby charge the lands herein after devised,for the support and Maintenence of my wife as follows: The parts devised to my son Charley and daughter Susie Rush, with one third of the proceeds of said land and they are to take care of and support my wife according to her station in life. The parts devised to J.J. COLLINS, Sallie McDANIEL, Ollie? GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, with Four dollars per year each to be paid in Money. I give to my wife the horse called Charley; the Mare called Daisy I desire to be sold and the proceeds paid to my wife.
3rd Because of the labor performed for me and his kindness and attention to my wife and I, I give to my son Charley all my farming implements. I further give and devise to my son Charley, fifty acres (50) of land, Commencing at Lester and Clyce's corner on the North side, coming with line to mine and Clyce's corner west of the school house; then coming east to corner at junction of creek and lane; then south to Jonesville road; then go east south of the road until he gets fifty acres.
4th I give and bequeath to my daughter Susie RUSH because of her faithful care and attention, one half of my household goods and one buggy. I further give and devise to my daughter Susie, fifty acres of land commencing at mine and Clyce's corner, thence south to the school house corner and mine and Clyce's corner; then with school house lot down the creek to the cross road; then with said road south to Jonesville road, then east until she gets forty five acres of land, then she is to have five acres of the timber land and at the death of my wife I devise to her the mansion house and its appurtenances.
5th I give and bequeath to my daughter Sallie McDANIEL the bureau and wash stand in my bed room.
6th The residue of my land I give and devise equally to my children Jane COLLINS, Sallie McDANIEL, Ollie GILMER, Joe WHITEAKER, Newton WHITEAKER and Thomas WHITEAKER, subject to the charge upon it, contained in the first clause of my will?.
7th I give to Vic Rush my log chain. It is my desire and will that the salt kettle, which now sits at the spring, remain in its present location for all time.

Washington County, Virginia Deed Book 23, page 346 James Snodgrass bought land for $1.00 from Joseph Worsham and wife, Nancy McNew, for a meeting house for free religious worship at the forks of the creek running from James Meadow's and I. N. Logan. This is present day Blackwell's Chapel.

Exact number of acres not known. This land is now owned by James & Mary Ann's great-great-great grandson, Tommy Worley.

May 12, 1862, Mary Ann Whitaker Snodgrass held a sale of James' personal property. The buyers were Oscar Akers, Abby F. Snodgrass, David Worley, Calvin M. Whitaker, John Taylor, Madison Holly, John D. Blackwell, I. N. Logan, Joseph Murdock and Joseph Snodgrass.
Feb 22, 1864, Henry Davenport, brother-in-law, was named guardian of her two youngest children, Julino O. and Henry Francis Snodgrass.
Oct 28, 1864, Washington County, Virginia Deed Book 26, page 211.....Mary Ann sold to Julina O. Snodgrass , her daughter and Henry Francis Snodgrass, her son all the real estate her late husband, James M. Snodgrass had left. Mary Ann retains her life interest in the real estate and one half increase of the personal property (meaning livestock).
November 3, 1864, Mary Ann Whitaker Snodgrass married John R. Jackson, widower, age 53, born Russell County, VA., son of William Jackson and Mary Hunt. Mary Ann was 47 years old at this time. The minister who performed the marriage was J. T. Davenport.
May 29, 1869, Washington Co. VA Deed Book 27, page 676...A. G. Thompson, Attorney-in-fact of John Gordon Ogden and Jane C. Ogden, and heirs and legal representatives of James M. Snodgrass, deceased..a sale and conveyance made about 1858 by said Thompson, attorney...sold by him to said James M. Moses Whitaker left in his will land to Lydia with the notation "The land was not to be in the hands of John Litton - if he was alive" -. He wasn't. From family stories handed down, John Whitley Litton III was a gambler and kept race horses. It is told the Litton Plantation was a good place to raise hell on weekends.
Family stories having John joining the US Army after the war ended and supposedly dying in the Mountain Meadow Indian Massacre in 1867 Utah. This was the story told by his son, Lilburn to cover the fact that he may have deserted his family. This story is documented in "Russell County, Virginia: History Revealed Through Biographical and Genealogical Sketches of Its Ancestors" M. Secrist, Lulu Press, Inc, Feb 18, 2013.
However, the massacre took place in 1857. The Mountain Meadows Association has the following information showing he was not a victim of the is massacre.

The MMA investigates every person who is believed to have died in the Mountain Meadows Massacre. According to a family tradition, John Whitely Litton died in a "Mormon Indian Massacre in Utah", in 1867. Although the Mountain Meadows Massacre took place in 1857, stories usually get some facts wrong, and he was investigated as a possible victim.
John Whitely Litton was the son of John S. Litton and Catherine Younce, born 5 March 1830 in Elk Grove, Russell County, Virginia. He married Lydia Eva Whitaker on 14 May 1845 in Russell County, Virginia. She was the daughter of Moses Whitaker and Polly Bowman. In the 1850 census, they are enumerated in Russell County, Virginia, and in the 1860 census they are enumerated in the Western District of Washington County, Virginia. Lydia (Whitaker) Litton is enumerated as a widow in both the 1870 and 1880 census for Washington County, Virginia. These census records indicate that Litton probably died sometime between 1860 and 1870, and not before 1860, which would have been the case if he was a victim of the Mountain Meadows Massacre in September 1857.
John W. Litton was in Wade's Regiment, Local Defense (Washington County VA Militia), in April 1862, before he enlisted in the Confederate Army. Litton served the Confederacy during the Civil War, in Company A (originally Stevenson's Company, Ferguson's Battalion) of the 16th Virginia Calvary. This Company was primarily made up of men from Russell County, Virginia. John W. Litton was a wagon master in the Civil War. Most Confederate records from Virginia were burned in Richmond, however a copy of a Company Muster roll for 31 October 1863 to 1 April 1864 shows he enlisted 5 August 1862 at Lebanon, VA. for a period of 3 years. He was signed in by Capt. Stevenson. He appears on a Receipt Roll for pay on 31 December 1863. He was paid $.25 for service from 1 August 1863 to 31 December 1863. These records indicate that Litton was still alive in at the end of December in 1863. There is no record of Litton's wife filing for a widow's pension.
Lydia (Whitaker) and John W. Litton had seven children. The two youngest children were Clementine Catherine Litton, born in September 1861, and Mary Cordelia Litton, born 31 March 1865. The birth of Litton's youngest daughter indicates that he was living in 1864. The census records, military records, and birth date of his youngest daughter, prove that he was not a victim of the 1857 Mountain Meadows Massacre.
Another family story states that when he returned from the Civil War, he didn't like the reconstruction, so he enlisted in U.S. Army and was sent to Utah, where he died as an Indian fighter. A different story said that he settled in Texas and married again. He was rumored to have several children and was living in Campbell County, Texas. [Note: There is no Campbell Co. TX. There is the town of Campbell in Hunt Co. TX] No evidence, that would support either story, has been found.
In Lydia (Whitaker) Litton's father's will of 31 March 1874, proved 22 November 1875, Moses Whitaker left her land, and other property, and further stated that the "devise to Lydia E. Litton, dau., are not to be liable for any debts due for any one from her husband, John Litton, if he is now alive." When and where John Whitely Litton died remains a mystery. It is evident, from her father's Will, that as late as 1874, Litton's wife did not know what happened to her husband. She never remarried, and Lydia Eva (Whitaker) Litton died 14 May 1901 and is buried in the Hayter Cemetery in Abingdon, Washington County, Virginia.

"In 1879 David and Lucy retired to Polk County, Oregon and resided in Independence for five years, and then came to the donation claim on which they have since resided and they are living in the home he built forty years ago. They are members of the Methodist Church. Mr. Whitaker does not pay much attention to politics, but he always voted with the Democrats. Mr. Whitaker has almost reached three score and ten mark; but he still retains his faculties, and has yet much strength and endurance. While he does not need to work he keeps up his habits of industry, and still retains the 320 acres he took up as his donation claim. In addition, he has stores and other property in Independence."

Serious Runaway Accident
INDEPENDENCE, Oct. 14. (Special.) David Whiteaker, who. was Injured in a runaway accident here, yesterday, has not regained consciousness, and his death Is momentarily expected. Mrs. Whiteaker is much worse injured than at first expected, and she Is now unable to leave her bed.

Mr. and Mrs. David Whiteaker, aged residents of Independence, were badly injured in a runaway Monday. Mr. Whiteaker, who is in feeble health, received a deep gash in the back of his head and a bad wound on the forehead.

Died at his residence in this city, on Wednesday, Oct. 22, 1902, David Jesse Whiteaker, aged 77 years, 11 months and 26 days. The circumstances leading to the death of "Uncle Davey" are too fresh in memory to be rehearsed at this time. Suffice it to say that he scarcely regained consciousness from the runaway accident of last week.
Mr Whiteaker was an honored pioneer of '48 and a veteran of the Oregon Indian wars. He was a native of Virginia. In '36 he, with his parents, removed to Illinois, they being pioneers to that state. His trip across the plains to Oregon is similar to those of all that heroic band, which braved the hardships and reclaimed Oregon to the Union.
Funeral services were held today at 11 a.m. at the M.E. church, Rev G.H. Osborne officiating. Interment took place at the family burying ground on the B.F. Whiteaker farm, north of Monmouth.

The Whiteaker Cemetery is located on the Bengamin Whiteaker D.L.C.in Township 8S, Range 5W, Section 11. It is a private family cemetery about .01 of an acre in size. All known burials are related to the Whiteaker family. It is about three miles northwest of Monmouth, Polk,County, Oregon. The cemetery has been abandoned to nature. It was last read by Addie Dyal Rickey in 1973.

HISTORICAL RESOURCES
From the History of Oregon: Benjamin was sixth of his father's eight children and was ten years old when they crossed the plains to Oregon. His duty on the journey was to drive the milch cows on horseback, and he performed his task to the satisfaction of all parties. After the arrival and settlement on the donation claim he remained at home until he was twenty-one and then went with his brothers to eastern Washington to engage in the stock business, and they took with them 225 head of cattle; because of the severity of the winter they lost nearly all of their stock. About this time the war broke out, mining began in Idaho, and prices advanced. This naturally benefited them and in time they became wealthy. Benjamin then went to Polk County and purchased a half section of land off the John Fudge donation claim. After his marriage the couple resided in Washington for a year and then returned to Oregon and lived on land left him by his mother. He purchased more land by his mothers to total 800 acres.
DISCREPANCY - Monmouth Herald obituary gives birth year of 1835, while death certificate and marker give 1838.
NOTE - His second wife, Adelaide, and two of his children, Glendon Whiteaker and Nellie (Whiteaker) Kantner, are buried at Salem Pioneer Cemetery in Salem, Oregon.

OBITUARY:
The Herald made mention, last week, of the serious illness of B.F. Whiteaker, who was stricken with paralysis while transacting business at Independence. Mr. Whiteaker was taken home and under the care of a physician seemed to rally, but taking a relapse died on Saturday morning, August 24, 1912, and was buried on Monday.
He was born in Illinois, May 25, 1835, and came with his parents to Oregon in 1848. They located in Polk county and the Whiteaker homestead marks their enterprise. He was twice married, his first wife being Narcissa Hamar, and to this union were born W.H. Whiteaker, of Portland; A.J. Whiteaker, of Raymond, Wash.; Mrs. W.O. Cook of Eugene, and Mrs. E. Roe of Enterprise.
After the death of his first wife he married Miss Adelaide Fetzer, to whom were born Mrs. Etta [Nettie] Kantner of Seattle and Frank and Glenn Whiteaker of Cochrane, Ore. Deceased was a man of warm and generous impulses. His friends were numbered by his acquaintance, and he was a fine type of the pioneer. His home was always open and his hand ready to help the suffering and needy. He gave liberally to worthy public enterprises and at the time of his death was engaged with others in drilling an oil well on his extensive farm.

The History of Oregon:
George was six years old when they crossed the plains to Oregon. After his arrival he had a severe attack of mountain fever and it affected his memory of the journey. He attended public schools and remained with his father until he was twenty-seven years of age, when he married.
After his marriage he settled on the donation claim of his brother William Whitaker which contained 320 acres. This farm he purchased and farmed for twelve years. He is a stockholder in both the banks of Independence and has been a director of the First National Bank since its organization.

HON. JAMES L. COLLINS
The marriage of Judge Collins occurred in Polk county in 1861, Miss Mary Whiteaker becoming his wife. She was born in De Kalb county, Ill., in 1846, the daughter of Benjamin Whiteaker, who was one of the pioneers of Polk county in 1847, and a relative of John Whiteaker, the first governor of Oregon. Mrs. Collins died in 1864, leaving one daughter, Nellie, who is a graduate of La Creole Academy, the state normal school at Monmouth, and the New York state normal college at Oswego, N. Y. She is now critic in the state normal school at Madison, S. D., which position she has occupied for the past ten years.

In 1862, the brothers packed to the Florence Mines; in 1863 they moved their mother and their respective families from Oregon; in the following year engaged in freighting from Umatilla Landing and Walla Walla to Boise; in 1865 made two trips to Kostenia, British Columbia and one to Helena, Montana and then sold their pack outfits and in the following summer freighted with teams to Colveille and to the old Hudson's Bay Company's fort.

went to Illinois with his parents and ten years later crossing the plains with his parents to Oregon. In 1862 he came to Walla Walla and for two years was engaged in packing between the point and the Idaho mines.
They were married at the home of James Smith of Polk County, by J. W.Stahl, Minister of the Gospel. Witnesses Benjamin F. Smith and William Jones.
In 1865 they bought the farm on which they now live, lying on both sides of the Touchet, near the mouth of Whiskey Creek. He owns 560 acres of land. John raised cattle and later sheep and sold this business to his brother Adam and his son James H. Fudge.

James then went into the stock business and has since followed that occupation and farming. He still owns the ranch he purchased in 1860, and lived there until 1881 at which time he moved to Huntsville. He owns a beautiful residence and two acres of ground in this city. James is a member of Latah Lodge, No 76, of Spokane Co. He is identified with the Republican party, has served as a member of the County Central Committee, was a delegate to the State Convention at Ellensburg in 1881, was a member of the Board of Directors of school district No 20, and served an equal length of time as Road Supervisor.

Crossed the plains at age nine with his parents Adam and Catherine to reach Oregon.
After his father's death, William remained with his mother on a farm and assisted on the farm. In 1859 he moved to Walla Walla to start in the business world where he was successfully engaged in farming and in the raising of livestock.
In 1884 he moved to Whitman County and his success as a cattle man and a farmer continued and he acquired fifteen hundred acres of valuable land. He lived his retirement years in Waitsburg.
1870 Washington Territory Census, Waitsburg Township lists William, age 33, farmer, Elizabeth, age 22. Living on their farm is Francis Dice, farmhand.
Found in a scrapbook, with the date of Jan 31, 1917...WILLIAM FUDGE IS DEAD. Oregon Pioneer of Early Forties dies at Walla Walla..Walla Walla, Wash., Jan 30 - (Special) - William Fudge, prominent valley pioneer of 1859 and an Oregon pioneer of the early '40's died here today in his 80th year. His father and the family started across the plains by ox team with an immigrant train of 300 teams. The trip proved a horrible one, as some of the party became separated from the main train and were set upon by Indians and massacred. The family settled near Dallas, in Polk County. During the gold excitement in California, his father went there and died. Adam Fudge had brought his family from Illinois with the Whitikers and McGhees, pioneers, and settled near the Tucannon River. He is survived by his wife. There are no children. In 1872 he came to Walla Walla, WA where he lived the remainder of his life.
For five years Adam engaged in the butcher business in Waitsburg and then purchased a ranch in Whitman County. At his death he left his widow a valuable tract of eight hundred acres of land in Whitman County. Adam took a very active part in the ODD Fellows lodge and was a staunch supporter of the Republican Party. He was a man of good business and executive ability. Scrapbook - dated about 1901, located at the Oregon State Historical Society Library, Portland, Oregon. Walla Walla, WA. May 20, - Adam Fudge, aged 55 years, a pioneer of the Pacific Coast, and for many years a resident of Endicott, Washington, died in this city late last evening. The funeral will take place at Waitsburg under the auspices of the 100F Lodge. The exact date has not been set.
Buried in the Odd Fellows Cemetery in Waitsburg.
