    May 4th: 1734 [May th: 1734 (no day shown)] IN the Name of God Amen I being weak of Body but in Perfit sence thought good to make my last Will and Testament I asigne my Soul to God who gave it me and my Body after my Decess to be desently Entered in the Meeting house Yard at the Discration of my Friends and well Beloved Son John Mitchell & my Wife Elloner Mitchell to be my Exetors & Administerators I do bequath and leave to my Wife Elloner Mitchell the Plantation while she is alive and the two working Horses with Plough and all Implements belonging therto and a Mare Caled Beefs [Bess] and three her choice of the Cows and two two year old Hefers and a Black Bullock and the Sheep But Jeam [but Jean's] till [at] her dispossel as [and] also the Houshold goods to her own Discretion amongst her Daughters And to my well Beloved Son my best Wearing Sutte of Apperell with Hatt and one Three Old Hefer and one Year Old Bullock and to my Elldest Daughter Martha the Black Horse and Brown Mare but not the foal She is now with and two two year old Hefers and one year old and to my Second Daughter Mary [McCary] one Cow besids the one called her own and one year old Bullock and the young Sorrel Mear

Day of November 1734 Then Personally appeared William Mitchell and James Cook and on their Oaths Did Declare that the within Will was written in the time of the last Sickness of Thomas Mitchell the Testator and in his Presence and at his Special Request as his Last Will and that at the time of the Pronounceing and writing thereof he was of Sound mind and Understanding according to the best of their Knowledge but that he was Prevented by Death from Saying anymore.


    BE IT REMEMBERED that on the 14 Day of November A D 1734 The Last Will and Testament of Thomas Mitchell Deced was proved in due form of Law and Probate and Letters Testamentary were granted to John Mitchell and Elliner Mitchell Having first Sworn well and truly to Administer the said Deceds Estate and bring an Inventory thereof into the Registers Office in Lancaster Co. at or before the 14th. Day Dec. next And also to Render an Acct. where thereunto Lawfully Required Given under the Seal of the said office.

    Below are the extracts of the argument.

    From the following Augusta Co. VA record, John Tate and Francis Beaty were brothers-in-law.

    10th October, 1769. Francis Beaty, of Mecklenburg County, North Carolina, Gent., to his brother-in-law, John Tate, power of attorney to sell all lands belonging to Francis, including land bought of John Greer, on Flat Spring Branch, joining the other land where I last lived; also 200 acres joining Charles Berry. Teste: Robert Gay, John and James Beaty.

    To be Francis' brother-in-law, John would have married either Francis' sister or Francis would have married John Tate's sister or the two would have had to marry sisters. No documentation has been found to prove the first two options, so it is more likely John and Francis married sisters.

    Thomas Mitchell's will in 1734 mentions his daughter, Mary, along with his wife Elloner, son John, and other daughters Martha (eldest), Jean and Jenat. The will was written 4 May 1734; probated 14 Nov. 1734, (Lancaster Co, PA, Will Book A, vol 1, pg 17)

    Mary Doak is a least likely candidate for two reasons. One, there is no will of Samuel Doak in Augusta County records to indicate that Mary was his daughter. In addition there are no records of any of Samuel's other children listing her as a probable sister.

    Two, the following record is interesting because Samuel Doak would have been the brother of Mary, if she was the daughter of Samuel Doak, Sr. Samuel Doak in his will extract names his "brother-in-law John Finley, husband of Samuel's sister Thankful. However John Tate is not also named as a brother-in-law, which he would have been if Mary, the sister of Samuel Doak was his wife, but he is named as an advisor to the executors. This is another key piece of evidence to possibly support Mary as a Mitchell and not a daughter of Samuel Doak, Sr.

Crawford; daughters, Jane and Elizabeth. Executors, wife Jane, son David, son-in-law Wm. Brown. Brother-in-law John Finley and John Tate to advise executors. Teste: John and James Mitchel, William Tate, John Tate, Jr. Proved, 19th May, 1772. by James Mitchel and the Tates. David Doack qualifies with John Tate. Nathaniel Steel.

    There are many records linking the Tate, Mitchell, Beaty, and Doak Families in the Augusta Co. VA records.

    After her husband died, her four children were placed under guardianship, a usual situation since women had few legal rights. The guardians were two of her brothers-in-law.

    Vol. 2 - Tate's heirs vs. Tate's executors--O. S. 144; N. S. 50--Bill, 28th July, 1803. Complainants are, viz: Thomas, John, Isaac, Mary Tate, Andrew Steel and Elizabeth, his wife, and Sarah Tate. In 17__ a contract was made between John Tate, father of Thomas, of one part and Thomas and his brother, James Tate (deceased), of other part, by which Thomas and James were to assist in building a mill. John, Isaac, Mary, Elizabeth and Sarah are children and legal representatives of James (or John?). John died testate, devising part of mill to his son John, part to orator Thomas, and remainder to orators John and Isaac. James Tate died 178_ testate. John Tate, Jr., lately died testate. Suit against executor of John Tate, Sr., and of John Tate, Jr., for accounting. Thomas Tate removed to Holston. Answer 1804 by Jane Tate, widow and executrix of John Tate, Jr., and by Samuel Finley, who married Polly Tate, daughter of said John. Jane married John about 1774. Samuel married Polly about 1796-1797. John Tate, Sr., died March, 1801. Deposition 23d July, 1804, of Hugh Fulton in Flemingsburg, Ky. Hugh did not marry the widow of James Tate. Charles Tate deposes in Washington County, 9th March, 1805: Is son of Thomas Tate and grandson of John. Nancy Tate deposes ditto, is daughter-in-law of John Tate. James Tate was killed at Battle of Guilford, 1781. Hugh Fulton, Sr., deposes in Augusta, aged 77 years. The contract about mill was made prior to 1774. Alexander Hall deposes ditto, was brother of James Tate's wife. William Tate deposes 27th June, 1804, in Washington County, brother of Thomas and James. William moved from Augusta in 1782-83. Alexander Stuart deposes 28th January, 1804, in Augusta, aged 70. James Tate died 1780. His wife, Sarah, married Hugh Fulton in 1785, and they moved to Kentucky about 1781. Peter Alexander deposes 25th October, 1805, in Woodford County, Kentucky.

    William Tate settled in Washington County about the time, John and Robert did and is thought to be a brother. He was on the tax rolls for 1784. On February 20, 1793, Joel Hobbs and wife Margaret sold 145 acres on both sides of Big Moccasin Creek, a spur of Clinch Mountain on the Holston River to William Tate. It would seem that he was not a public spirited man, however, there are so many acts attributed to the other William Tate over this period that I wonder if this William Tate was active, but the other William has received all of the credit, living in the same county as they did. He lived within five miles of Col. John and Robert Tate. He executed his will, September 15, 1803 in Russell County, VA, probated October 25, 1803 by wife Elizabeth.

    On May 1, 1782 Washington County Virginia issued land grants of 250 acres to Robert Tate and 100 acres to John Tate, both on Moccasin Creek. On February 20, 1793 William Tate bought 145 acres on Moccasin Creek adjoining the 424 acres granted to Robert Tate.

    Robert and John were active in County militia and government affairs from 1781 to their deaths. William can find himself to farming. William died testate on Sept. 15, 1803. The two of Roberts and one of John sons were witnesses to his will. He named the widow, four sons and a daughter. Robert junior. It was named executor.

    Moccasin Creek was located in Botetourt County prior to 1773; in Fincastle County from January 1773 to January 1777; in Washington County from 1777 to May 1786; in Russell County May from 1786 to present

    I William Tate of the county of Russell in the state of Virginia, being in a weak and infirm state of body but of sound mind and desirous of settling my worldly affairs do make this my last will and testament giving and bequeathing as follows:

    After my lawful debts and funeral charges being paid Item, To my wife Elizabeth Tate the land that I now live on during her natural life; After the decease of my wife Elizabeth I give and bequeath to my son William Tate that part of the tract of land aforesaid including the house thats now live in and with an with a direct course from the west side of the house to the sugar camp and a direct course with the west side of said house crossing the creek to the line of said land including the upper end of said tract.

    Item, To my son Joseph Tate and my son Robert Tate all that part or tract of land from the house aforesaid with the aforesaid conditional lines including the lower end of the above tract of land.

    The Tates are a tangle to unravel. Robert's grandparetns are most likely John Tate and Sarah Beaty. His parents, John Tate II or Jr. and Mary Mitchell's descendants tended to stay in Augusta and Rockbridge Counties, VA and marry into other Scot-Irish families of the Shenandoah Valley i.e. the Campbells, McClungs, Stuarts, Finley, and Alexanders.

    Robert, who married Margaret McClung, has been confused by researchers with his uncle, Robert Tate, who settled in Washington Co. VA and had three sons, Col. John Tate, Robert Tate, and William Tate all played prominent roles in the history of Southwestern Virginia. Robert and Margaret McClung had about 11 children who had deep ties to Augusta and Rockbridge Counties, but some researchers have combined the uncle and nephew Robert's families. See what I mean about a tangle of Tates?

    Uncle Robert's descendants were the Traveling Tates. His offspring founded Tatesville in Pulaski Co. KY or settled in Warren and Grundy Co. TN and DeKalb Co. AL. Robert's grandchildren ended up in Missouri, Texas, and Oklahoma.

I David Doak of Augusta County and State of Virginia being weak in body by reason of sickness but sound of mind memory and Judgment Blessed be God and calling to mind the mortality of the body that it is for all men to die do this 26th day of June in the year of out Lord one thousand seven hundred and ninety nine make ordain and publish this my last will and testament in manner following to wit I resign up my soul to God who gave it and my body to be buried at the discretion of my Executors nothing doubting but at the last day both shall be united in Glory and respecting that part of the good things of this world which it hath pleased God to bless me with after my just debts is paid I dispose of and Bequeath as follows Viz: Imprimis I Bequeath to my Beloved wife Jennet Doak her living off this plantation that I now live on during her natural life & while she remains my widow and I allow my two sons Samuel and David Doak who gets the land to support her and the rest of my children that is to get their living off this plantation and each of my sons to be at equal Expense in supporting s.d. family. But if my wife thinks proper to live by herself without depending on her two sons I allow her a certain part of my plantation (during her natural life or while she remains my widow) for her support that is to say I allow her to have the management of and the Benefits arising from all my lands that lies on the South side of the great -?- including the dwelling house and to --?-- from line to line and after her decease s.d. land is to go to my two sons agreeable to the division that is to be made to them. I also bequeath to her my negro named Abraham (during her natural life or widdowhood) for the support of her and my children and at her Decease he is to be sold & divided between my two sons to enable them to make up the Legacies that is left to the rest of my Children. I also bequeath to my wife one third of all my stock and farming tools after just debt and specific Legacies is made up an the disposal and management of all the household furniture which stock farming tools and household is to be given to her agreeable to the appraisement of such things as she thinks proper to take. Item I Bequeath to my daughter to my daughter Jenny Berry five shillings for her Birth right Item I Bequeath to my daughter Rosanah Doak my negro girl named Hannah to her during her natural life and to desc.ds to her issue but is she dies without issue then s.d negro girl is to come back and her Value to be divided between my sons Saml & David Doak. I also bequeath to Rosannah a young mare Equal to Samls mare N--?-- --?-- her saddle bridle bed and bedding or furniture fitting for the Sorrel and such a quantity of Stock and household furniture as her mother thinks fit to give her living and maintainance for herself and negro and cratures of that part of the land alloted to my wife during her unmarried State. Item I Bequeath to my daughter Betsy five shillings for her Birth right as I intend o give her her divide immedietly. Item I Bequeath to my two sons Samuel and David Doak to each of them one half of this land that I now live on part to ther theirs after my Decease and the other part after their mother's decease which said Land is to be Equally divided considering quantity quality and improvement to be theirs and their heirs and assigns forever. I also Bequeath to Each of them a negro boy that is to Saml his negro boy Andw. and to David Dinnise I allow bequeath to then an Equal Share in my Grist Mill and saw mill and still with the appartainance thereto belonging reserving to my wife if she thinks proper to live by herself one fourth of the profits arising from the Grist Mill I also Bequeath to Each of my sons a young mare that is to say to Saml N-?- and to David a young filly named his with the remainder of all personal Estate not Bequeathed I also allow my negro woman June to be sold and her price to be appropriated for to enable my two sons to make up the following Legacys and to pay and to pay my just debts and my waggon I allow to be continued on the plantation for the use of my widow and all my children that lives thereon. Item I Bequeath to my five daughters (Viz) Paggy, Fanny, Dorces, Polly and Elly Doak to Each of them a l ittle negro girl to be given to Each of them by my two sons Saml & David out of the Land to them and their issue but is no issue to return --?-- back to my two sons. I Bequeath to each of my above named daughers a tolerable good horse creature saddle and ridle and such Stock and household furniture as their mother thinks proper to give them but if their mother should be Called off before the[y] get married I allow my Executors to Give them nearly as much as Rosannah gets. I also allow all of my children to be Schooled what is common out of the profits of my Mills and Still or to be Learned as fare as is necessary for children. I also my five daughters and son Hugh to get their living with their mother or to be supported off this plantation until the[y] change their way of living.     DOAK, Samuel, founder and first president of Washington College, Tennessee (1795-1818), was born in Augusta County, Va., Aug. 1, 1749, son of Samuel and Jane (Mitchel) Doak. His parents, natives of Ireland, and of Scotch extraction, emigrated to America early in the last century, settling in Chester county, Pa., and later removing to Augusta county, Va. His father was a farmer, and the son's early life was hampered by poverty, although with an unquenchable thirst for knowledge he struggled manfully for an education.

    At the age of sixteen he began the study of Latin under a Mr. Alexander, probably, Archibald, grandfather of the famous Rev. Dr. Archibald Alexander, who was at that time teaching school in this neighborhood, and in 1773 he entered Princeton College, where he was graduated in 1775. He at once began the study of theology, and was licensed to preach by the Hanover (Va.) presbytery, Oct. 31, 1777. He began his work among the frontier settlements of southwestern Virginia, in Washington county, and later at the Holston settlement, now part of Sullivan county, Tenn., where he remained two years.

    While in search of a more promising field of usefulness, early in 1780, he met some settlers in the neighborhood of Salem, Tenn., who crowded about him and requested a sermon. Using his horse as a pulpit, he delivered so pleasing and helpful a discourse that they forthwith importuned him to remain among them. Here he remained and purchased a farm, lie immediately gathered the pioneer families under his ministry and their children under his tuition, forming the Salem Congregation. He built a log schoolhouse, and in 1783 obtained a charter from the legislature of North Carolina, which then embraced that portion of Tennessee; and again in 1785 he obtained another charter from the legislature of the stale of Franklin, in session at Jonesborough (now in Washington countv, Tenn.), on both occasions giving it the name "Martin Academy" in honor of Gov. Alexander Martin of North Carolina. Although there remains no record of his work in the school during the first twelve years of its existence, many young men educated by him subsequently became useful and eminent. One of them. Dr. J. G. M. Ramsey, in his "Annals of Tennessee" says that it was not only it the " first literary institution ever established in the Mississippi valley west of the Alleghanies," but also "for many years the only, and for still more the principal seat of learning in the western country."

    During this period, however, Dr. Doak had continued as pastor of the Salem Church, which was one of the first in this region, and had also organized a number of other churches among the settlers. By an act of the legislature of the "Territory of the United Slates of America, South of the River Ohio," dated July 8, 1795, the school was chartered as a college, empowered to grant academic degrees; and in honor of George Washington, then for the second time president of the United States, it was called Washington College. From the minutes of the first meeting of the board of trustees, held July 23, 1795, it appears that the academy had received 420 acres of land on the Doe river from Col. Waightstill Avery, besides numerous contributions of money, and later Alexander Mathes donated a valuable tract of fifty acres ad joining the property of Dr. Doak, where the college building then stood, which is the site of the modern institution. In 1798 while in the East as commissioner of the general assembly, Dr. Doak collected the nucleus of a library, which he transported 500 miles across the mountains on pack horses; and in the same year the Avery lands were sold and the proceeds expended in globes, maps and other equipments. Dr. Doak resigned in 1818 after presiding over the institution for thirty five years, and soon after removed to Green county, Tenn., within the bounds of Mt. Bethel Church, where he aided his second son, Rev. Samuel Witherspoon Doak, in conducting Tuscirtum Academy, chartered as Tusculum College in 1844.

    In character, Dr. Doak was possessed of rare firmness, dignity and decision', a natural leader of men and a great organizer. Through all the perils and hardships of pioneer life, he remained true to his noble purpose, and justly merits the title "apostle of learning and religion in the West." As a preacher he was original, bold, forcible, even entertaining; and as a teacher he was thoroughly well qualified, a good disciplinarian and a master in Latin, Greek and metaphysics. His creed was thoroughly Calvinistlc, and he taught and propounded it with an earnestness and lucidity calculated to fix its great truths upon the minds of the many young men trained by him for the ministry.

    He was on several occasions delegate and commissioner of his synod, and in 1784 was a member of the constitutional convention of the proposed state of Franklin. He at that time furnished a clause providing for a university to be established by legislative enactment before 1787, and "to be endowed liberally." The degree of D.D. was conferred on him by both Washington and Greenville colleges in 1818. Dr. Doak was married in 1776 or '77 to Esther, daughter of Rev. John Montgomery of Virginia, and had two sons and four daughters. He died in Greene County, Tenn., Dec. 12, 1829.

    She and her aunt Mary Doak are frequently confused with each other. Her aunt married John Tate who lived and died in Augusta Co. She's also confused with her cousin, Mary Doak, daughter of Robert Doak. Cousin Mary married Robert Breckenridge. To make matters worse, Mary is confused with Mary Mitchell who married Col. John Tate of Augusta Co. VA who settled in Russell Co. VA. The two Johns are frequently mixed up.

    It's difficult to untangle the Mary Doaks within these two generations along with the John Tates. Between the brothers, sisters, and cousins having the same names it becomes a knotty mess to sort out.

    Some sources claim that this John Tate married Elizabeth McClanahan, but in the Chalkley's records, it states that "John Tate, Jr." married Elizabeth. According to other sources, including submissions to familysearch, the John Tate that married Elizabeth McClanahan was the son of John Tate and Jane Steele, which would explain the reference to "John Tate, Jr." in the Chalkley's record.

    By a process of elimination, the John Tate Jr who married Elizabeth McClenachan on 27 Feb 1794 must be the son of James2. The other Johns in the 3rd generation are accounted for: John of John2 was not mentioned in a 1814 court case (Finley vs Tate) with his siblings and was probably one of the two unnamed sons who were "since dead under age, unmarried and intestate;" John of William2 went to IN; and John of Robert2 married Nancy Moffett.

    Starting in 1790, John appeared on the Augusta County tax lists as John Tate Jr to distinguish him from his grandfather John Tate Sr and uncle John Tate Esquire. A small holding of 1 white titheable and 1 horse in 1790-93 indicate he was less well off than John Esq who had about a half dozen horses and several slaves. For several years after 1793, John Jr had one or more additional titheables— - one probably being his brother Isaac. After the death of his uncle John Esq in 1802, no John Tates were listed in Augusta.

    Isaac (s/o James) chose his uncle Robert Tate as guardian on 16 Sep 1788; and, with his siblings, was involved in a lawsuit against the executors of his father's will in 1803. It appears that Isaac married first Esther FINLEY and second Mary STEELE. He was found at Green Co. KY on the census of 1810, 1820, 1830, 1840, and 1850.

    Finley vs. Tate--O. S. 280; N. S. 99--Bill by Samuel Finley and Mary, his wife, daughter of John Tate, who died December, 1802, testate. John's son, Isaac, removed to Kentucky. John at death left following children, viz: Oratrix Mary (married at that time). Nancy also married then to Adam McChesney, Ellen, Drusilla, Jane, Elizabeth, Clorinda, one other daughter and two sons, all since dead under age, unmarried and intestate. Nancy McChesney died soon after her father, leaving an only child, Jane Eliza McChesney. Her husband, Adam McChesney, has also died, leaving Jane Eliza his only heir and infant. Ellen is now wife of John Finley of North Carolina. Drusilla has married John D. Ewin of Rockbridge. Jane has married Jacob Vanlear of Augusta.     Joseph Tate, born CA 1777, Russell County, VA was the son of William and Elizabeth (?) Tate. That the two Joseph Tates had a spouse by the name of Margaret or Peggy is shown by deeds. On October 30, 1804, Joseph Tate and Robert Tate sold to Joseph Tate, 75 acres on both sides of Moccasin Creek on a direct course to exclude the house, lower end of a tract of 145 acres which was granted on December 15, 1792 to Joel Hobbs and bequeathed by the last will of William Tate on September 15, 1803 to the sons Joseph and Robert Tate, witnessed by John and Isaac Tate and Richard Davis

    On October 1, 1805 Joseph Tate and wife, Peggy, to Robert Tate, 51 acres. On Big Moccasin Creek adj. Richard Davis and William Hullams. Signed by Joseph Tate, Peggy Tate, witnessed by the same persons.

    On February 3, 1806, Joseph Tate and Margaret Tate of Russell County, VA sold to William Hullams, 70 acres, both sides of Moccasin Creek, direct line so as to exclude the house, lower end of tract granted to Joel Hobbs on December 15, 1792 containing 145 acres which was bequeathed to Joseph and Robert Tate by Will of William Tate September 5, 1803. This family probably left Russell County, VA at that time, however, it is not known by compiler where they settled.

    William Tate, born ca 1779, Russell County, VA, son of William and Elizabeth (?) Tate. They lived on the plantation filed on by Joel Hobbs in 1792, on Big Moccasin Creek. That his wife was Mary and that he was son of William Tate is indicated by deeds and will. On January 16, 1804, William Tate and Mary, his wife, of Russell County, VA, sold to Zachariah Fugate, 72 1/2 acres on both sides of Big Moccasin Creek, it being the upper part of the tract of land granted to Joel Hobbs on 15 December 1792 and conveyed to William Tate, Sr., Deceased, and granted by William Tate, Sr., to his son William Tate, Jr. by will. It was adj. William and Joseph Tate, including the dwelling house, etc.
