Generation: 1
1. | Hiram (Hi) WHITAKER was born 27 Aug 1852, Harman, Tazewell Co, VA; died 14 Aug 1928, Baptist Valley, Tazewell Co. VA; was buried , Whitaker Cemetery, Cedar Bluff, VA. Other Events:
- _UID: 5CD08DB7BC8E4DA2B032E8939EFD76C6DDDD
Notes:
He kept bees. Sold honey. Buried his money in jars around the yard. Nancy Whitaker Tate would go with him when he would go get his jar of money.
He would sit on front porch with a fan and visit with folks that came up the road. He kept a gallon jar of his "medicine" of rock candy and whiskey. He would take a sip when for medicinal purposes.
He would bake potatoes in the fireplace ashes and pop popcorn in the fireplace. This was a real treat for the grandchildren.
At Christmas, Nancy Whitaker Tate, his granddaughter, would wake up around 4 AM and go up to house. It was a game to see who was going to wake up first. He was always up when NWT got there. His nickname for her was "Shikepoke."
She spent most of her time with them as a child that she had her own bedroom with a feather mattress.
He would ride his horse and Nancy Whitaker Tate would ride double with him, hanging on the back. She was sent to get the horse, because it would run away if someone else rather than NWT came to get him. He was a brown sorrel horse named Doc. Scared of cars, and he would run away. Nancy Whitaker Tate would ride with no saddle or bridle. If a car came, he would stop and not run if she was on him. Nancy Whitaker Tate was a not yet in school. She would take him to a fence, and he would stand still until she would climb the fence and get on him, Then off the would go. He was used for riding to the mill and the store.
He met his first wife on Whitaker Ridge

Notes:
Otis never married and was killed in 1917 under mysterious circumstances while guarding a railroad bridge at Cedar Bluff in World War I. His death certificate says he was a watchman for the N&W Railroad, but the Clinch Valley News says he was working for the Baldwin-Felts Agency. The family thought his body was placed on the bridge and was run over by the next train.
During World War I, the agency?s talents were given freely to the United States Government for the protection of industries and apprehension of German spies and others considered enemies to the United States. U.S. entry into World War I in 1917 sparked a boom in the coal industry.
The Baldwin-Felts Agency oversaw security operations in the Norfolk & Western Railway?s coalfield district. The company investigated train robberies, wrecks, and thefts as well as providing guards for railway and mine payrolls, as well as to accompany coal trains into the coalfields. Among labor union members of the coal mines, Baldwin?Felts agents were regarded as hired thugs, as evidenced in the shoot out at Matewan, WV, known as the Matewan Massacre. After the agency closed its doors in 1937, most of the company's files were destroyed or lost. The largest collection of extant files is housed at the Eastern Regional Coal Archives in Bluefield, West Virginia.
NEWSPAPER ARTICLE
Clinch Valley News, 6 April 1917
Guardsman Killed
Otis Whitaker, age 23 years, a Baldwin-Felts guard, was run over and killed by train No. 85 near Cedar Bluff Monday morning. Whitaker was one of the guards employed by the railroad company in watching the bridges and tunnels on the Clinch Valley. He went to work Saturday night. An inquest was held yesterday morning, and the investigation developed that from the position in which the body was found he had evidently gone to sleep on the track. His feet and legs were several feet from the rest of his body. A pocketbook containing several dollars in money and a fine watch were found on the track, the watch having stopped at 3:21. Whitaker was placed in charge of three bridges near Cedar Bluff in keeping with the purpose of the N. & W., to use every precaution to prevent the interruption of traffic by enemies of the United States who might be incited to acts of
violence by the declaration of war against Germany. The dead boy is a son of Hiram Whitaker, a well known citizen of
Cedar Bluff.

HARMAN,
v.
UNITED STATES
United States Court of Appeals Fourth Circuit
Argued June 20, 1952
Decided Sept. 25, 1952
J. Raymond Gordon, Charleston, W.Va., for appellant.
Philip A. Baer, Asst. U.S. Atty., Huntington, W.Va. (A. Garnett Thompson, U.S. Atty., Charleston, W.Va., on brief), for appellee.
Before PARKER, Chief Judge, SOPER, Circuit Judge, and PAUL, District judge.
PARKER, Chief Judge
This is an appeal in a proceeding instituted under 26 U.S.C. §§ 2831, 3116 and 3321, for the forfeiture of an automobile truck which it was alleged had been used to convey materials and necessary equipment to an illicit distillery by one Roy Harman. Lucille Harman filed an intervening petition claiming that she was the owner of the truck and that she had no knowledge that it was being used in violation of the internal revenue laws. A jury trial was had, and in response to issues submitted to them the jury found that the truck was used by Roy Harman to haul materials for use in making moonshine whiskey and that Lucille Harman knew or had reason to believe that it was being used for that purpose. Judgment of forfeiture was entered on this verdict and Lucille Harman has appealed
A large moonshine still was discovered by officers near the home of Beverly French Harman in McDowell County, West Virginia, so situated that it could not well have been operated without the use of a truck for the purpose of conveying materials and utensils to a nearby point. Roy Harman was the son of Beverly French Harman and the brother of Newton Harman and Gratin Harman who were definitely shown to have been engaged with David Robert Stevenson in operating the still. There was evidence that Roy Harman was closely associated with Newton Harman, that he made frequent visits to the Beverly French Harman home and that he used a truck to haul sugar, middlings, grain, yeast and other supplies to a point near the distillery. No one connected with the distillery except Roy Harman had the use of a car or truck. The truck in question was bought and paid for by him and he operated it. Although the title was placed in the name of Lucille Harman, a girl whom he was engaged to be married, she paid nothing towards purchasing it and had nothing to do with its operation, except that she frequently rode around in it with him. This evidence was clearly sufficient to take the case to the jury.
Equally lacking in merit is the contention with respect to the examination and testimony of the witness Stevenson. This witness had given a statement to government counsel to the effect that Roy Harman had hauled sugar, middlings, yeast and jugs on a Ford pick up truck to a point about 200 yards above the Harman house in the direction of the distillery. When called to the stand by the prosecution he gave testimony in conflict with this statement, whereupon counsel for the prosecution asked leave to cross examine him as a hostile witness. This was allowed and the witness admitted giving the statement and testified that it was the truth.
There is nothing in the contention that the court erred in allowing the jury to consider the statement as evidence in the case instead of limiting it to impeachment of the testimony of the witness. When the witness testified that the statement was true it became a part of his testimony, and not mere matter of impeachment, and was to be weighed by the jury along with the other testimony he had given.
The third question is whether the proceeding for condemnation must fail because the truck was taken into possession for the purpose of the proceeding, not from Roy Harman or the claimant, but from state officers who had seized and searched it when arresting Roy Harman without a warrant. No question is presented with respect to the admissibility of evidence obtained as the result of an unlawful search and seizure, for no such evidence was offered. Forfeiture is asked not on account of what was found at the time of seizure but of what had occurred prior thereto; and vehicles may be forfeited for violations of law occurring prior to seizure as well as when they are seized flagrante delicto.
The fact that the state officers may have had no authority to seize the truck when arresting Harman is immaterial, for they yielded possession to the federal authorities for the purposes of this proceeding; and it is well settled that 'where property declared by a federal statute to be forfeited, because used in violation of federal law, is seized by one having no authority to do so, the United States may adopt the seizure with the same effect as if it had originally been made by one duly authorized.
We can see no reason for doubting the soundness of these principles when the forfeiture is dependent upon subsequent events any more than when it occurs at the time of the seizure, although it was argued that there was a difference. They seem to us to embody good sense. The exclusion of evidence obtained by an unlawful search and seizure stand on a different ground.
Roy married Lucille Harmon 02 Sep 1953, Welch, McDowell Co. WV. Lucille was born ca 1929, Warriormine, McDowell Co. WV. [Group Sheet]

Born January 17, 1920, in Cedar Bluff, Virginia, he was married for 57 years to his beloved wife Rosa Spencer Whittaker who predeceased him in 2003. He was the son of the late William R. Whittaker and Susie Lee Whittaker both of Tazewell County, Virginia. Mr. Whittaker, a devoted husband, father, grandfather and great-grandfather was a member of Grace Design United Methodist Church in Danville for 51 years. A retiree for the past 29 years, he was employed, during most of his working life, in sales as a regional salesman for Andrew Jergens, Inc., a health and beauty aids company headquartered in Cincinnati, OH. As a regional salesman, he covered south-central Virginia and north-central North Carolina. While employed with Andrew Jergens, Mr. Whittaker was frequently recognized by the company for his exceptional sales results, his work ethic and his customer service initiatives. After retiring from Jergens, he managed several stations for the A. T. Williams Oil Company of Winston Salem.
He is survived by two daughters, Joyce W. Sparks of Danville and Janet W. Swann of Virginia Beach, Virginia; a son, William Donald Whittaker of Rockville, Maryland; five grandchildren, Kerry L. Sparks of Eagle River, Alaska, Scott A. Swann of Boulder, Colorado, Joshua P. Whittaker of Danville, Jeremy R. Swann of Virginia Beach, and Ann W. Harris of Durham, North Carolina; six great-granddaughters, one great-grandson, and one brother, Charlie Whittaker of Windsor, Connecticut. Funeral services for Mr. Whittaker will be held at Grace Design United Methodist Church on Saturday, May 28, 2011, at 2:00 PM with the Reverend Dr. James Siddons, officiating. Interment will follow in Highland Burial Park. The family will receive friends at the church from 1:00 to 2:00 PM prior to the service and will be at the residence on Lansbury Drive after the service for further visitation. OBITUARY
Richmond Times Dispatch, April 11, 2021
Nancy W. Tate, passed away at age 102 on April 7, 2021, after a courageous battle with cancer. She was a caring wife, mother, grandmother, and friend.
Nancy was born in Tazewell County, Va. to Newton and Ella Pack Whitaker. After graduating from high school, she began her life of travel, first in Welch, W.V., Savannah, Ga. and eventually the world. She met her late husband, Paul Tate, a handsome U.S. Marine, and became a consummate military wife. After his retirement, they settled in Richmond and she began her career as a medical receptionist for Drs. Wyndham and Frank Blanton until her retirement. She enjoyed taking her children and grandchildren on her travel adventures in the U.S., Europe, Aruba, Malta and Mexico.
Nancy was active in Masonic organizations including being the past Royal Matron of the Order of the Amaranth, Virginia Court Number 1, and the past Worthy High Priestess of the Old Dominion White Shrine Order of Jerusalem. She also served the community by being a charter member of the Ladies Auxiliary of the Fleet Reserve, and a past member of the James River and the Brandon Woman?s Clubs. She exemplified the motto of her Masonic organizations, ?Let us love one another, for love comes from God.?
Her parents; sisters, Addie Minton and Rosa Shepherd; brother, Roy Whitaker; and husband predeceased her. Nancy?s survivors include daughters, Cheryl Duke (Bill) and Paula Place (Steve); grandchildren, Paul Duke, Caitlin Duke, Anna Matney (Chris) and Deborah Place; nephew, Michael Blanton; and cousins, Joe Whitaker, Frances McGlothlin and Shirley Puckett.
The family wishes to thank Three Pillars Senior Home Care, especially the owner, Kevin Angone, for providing loving care and for adopting Nancy as his grandmother. Capital Caring Hospice was outstanding in their compassionate support of our loved one.
Visitation will take place on Saturday, April 17, at the West Chapel of Bennett Funeral Home, 11020 W. Broad Street, from 2 to 4 p.m. A graveside service will be held 2 p.m. Monday, April 19, in Quantico National Cemetery. A memorial service will take place later in the summer.

63. | Sherrill (Shaun) NIELSEN (28.Charlie3, 4.William2, 1.Hiram1) was born 10 Sep 1943, Montgomery, AL; died 10 Dec 2010, Cullman, AL; was buried , Cathedral in the Pines Cemetery, Tyler, TX. Other Events:
- _UID: C41280456FAF47F7A2E94C5479CD1E60E6BF
Notes:
Sherrill started his singing career at the age of 4 singing in his local Nazarene Church in Montgomery, AL, where Mom and Dad Speer attended. Sherrill started his professional music career at the tender age of 14. He won the Mr. America Youth Singer at the Coliseum in Montgomery, AL. At age 15, he cut his first solo LP ? A Name I Highly Treasure.
He attended Trevecca Nazarene College in Nashville, TN. He then proudly served his country serving in the Air Force with the Air Force Strategic Command Band, Omaha, NE.
In 1961, he joined the Singing Speer Family. While with the Singing Speer Family he was inducted into the Gospel Music Hall of Fame. This was the stepping stone for his legendary 50 plus year career in Southern Gospel Music. Sherrill teamed up with Jake Hess and formed the Illustrious Imperial Quartet, which won him another induction into the Gospel Music Hall of Fame.
In late 1966, Sherrill moved to California and re-joined the Songfellows Quartet headed up by Bob Jones, Sr. He then moved on to the Plainsmen who was working with Gov. Jimmie Davis. Then had a solo career and later put together a group that Elvis later named VOICE. He was singing at the Grand Ole Opry when he got the call from the Elvis Presley Assn. to become Elvis? backup singer. He stayed with Elvis, as a solo act, up until Elvis? death in 1977.
Sherrill Nielsen (1975 - 1977) - sang with both the Imperials and Voice (see above), and in 1975 began backing Elvis on stage, often as a "guest lead vocal", like on "O Sole Mio / It's Now Or Never", and "Softly As I Leave You". He was also present at Elvis' last Graceland recording sessions (October 29 - November 1, 1976).
In 1990, Sherrill moved to his grandfather?s homeland of Denmark and stayed there for 14 years. While residing in Denmark, he began writing gospel music; he introduced Southern Gospel Music to the churches, performed concerts and traveled all over Europe. In 2004, he got a life changing e-mail from Houston, TX and moved to Houston in June, 2004. The life changing message was from his first love, Brenda Hall, whom he married in December 1963.
