NC census listed Mary as being born there. Althought Mary has Virginia as a birth place for both her and her father, we don't know who gave the information to the census taker. Like her sisters Emily Jane and Amanda, Mary is unable to read or write. Also like her sister Amanda who is working as a cook in Tazewell Co. VA, she has an infant child. This most likely is Mary Nelson, daughter of Harvey Nelson and Sarah Garrett Nelson, now married to James M. Dancy.

Atwood. She is working as a cook and there is a 3 month old child, John Nelson with her. He is listed as a nephew. Amanda is unable to read or write and has her birthplace as Virginia as well as those of her parents. More than likely this is the Amanda Nelson, daughter of Harvey and Sarah Garrett Nelson. The age is about the same plus Tazewell Co. VA and McDowell Co. WV are next to each other. The child is listed as a nephew, however it is more probable he is Amanda's son. The other possibility is that he is the son of either sister Catherine or Sarah who are living with their mother and stepfather using the last name of Dancy. Amanda and her father were born in NC, but we don't know who provided this information to the census taker saying they were born in VA.

Although her occupation is not listed, the most logical conclusion was either a cook, servant, or housekeeper. Like her older sisters Emily Jane, Amanda, and Mary, she was unable to read or write. This is probably Margaret Nelson, daughter of Harvey Nelson and Sarah Garrett Nelson. She is right age, living in Tazewell Co. VA, which is next to McDowell Co. WV. Like Mary and Amanda, she is listed as being born in VA, but the 1870 census puts her birth as North Carolina, along with her father. We don't know who gave this information to the census taker.

Notes:

Newspaper articles from Morgan Co. KY sent by Gary Whitaker document that Dock was shot around 9 Sep 1904 in West Liberty, KY by Nelson Bishop, a deputy constable, who was arresting him. The shooting took place at the Lee Caskey home near Hazel Green. Dock was shot in his spine and died from his wounds around 12 October 1904. The deputy was arrested and convicted for Dock's death in April, 1908. He was sentenced to two years in the state penitentiary for voluntary manslaughter. Governor Wilson pardoned Nelson Bishop in April, 1909.

Family lore says Dock was in KY on moonshine business for Bill Whitaker.

LOCAL NEWS (TAZEWELL)

There are thirty-five or forty men in Tazewell jail for various offences. Many of them are for drunkenness. Three were added to the number Wednesday night, among them being Bill WHITAKER, of "Busthead" who is familiar with the architectural peculiarities of Tazewell's detention house. WHITAKER was arrested by Sergeant RATLIFF, and was charged with selling ABC liquor.
