Full text
In the name of God amen, I Thomas Hurst of Northumberland County andstate of Virginia being in perfect sence [sic] do make ordain and constitute this instrument of writing to be my last will and testament.
Item I give and bequeath unto my son James Hurst my plantation that I now live upon together with Swamp land (I purchased from George Cameron) to him and his heirs (and it is my will and request my two daughters Jane & Sukey shall have a home as to their own persons on my aforesaid plantation to live in the dwelling house and to have
a room upstairs over the dining room to be for their use without interruption and that they are to find themselves as long as both or either of them remain single and I also give to my son James Hurst, one horse (first choice) two feather beds & furniture (third choice) one yoke
of oxen (first choice) Cart & Wheels, two Cows (first choice) one Sow & Eight shotes (second choice) [illegible] of Sheep, one young colt and fifteen pounds cash to be raised out of my estate, not herein given which said property I give to him and his heirs.
Item I give and bequeath unto my daughter Jane Hurst the following property /Viz.t Harry, Mathew, Mary (and her young child Sarah) two feather beds & furniture (first choice) one horse (second choice) two Cows (second choice) and four head of sheep, to her and her heirs, also I give to my daughter Jane one Negro boy George to her & her
heirs.
Item. I give and bequeath unto my daughter Sukey Hurst the following property Viz.t Mary Ann (and her young child Stephen) Tom (Conger) Edy and James, two feather beds & furniture (second choice) one horse (3rd choice), two Cows (3rd choice) & four head of sheep to her and her heirs.
Item. I give and bequeath unto my Grand daughter Julet Ann Hurst the following property Vizt: [illegible] and Levina to her & her heirs lawfully begotten of her body (but for want of such an heir the aforesaid Negroes with their increase if any, is to return back into my estate at her
decease and be equally devided [sic] amongst my lawful heirs) and she the said Julet Ann Hurst, is to have no more of my estate.

Item I give and bequeath unto my two Grandsons Chatham C. Hurst and Warner Hurst, the following negroes Vizt. Samuel, Darien, and Fanny to them and their heirs provided my estate should not be subject to a debt contracted by their father in his lifetime and my self bound as his security to James Henry if my estate should be subject to pay the aforesaid debt or any part thereof the aforenamed Negroes thereof as will be sufficient must be sold for that particular purpose and whatever part of the Negro increase that shall or may be undisposed of when the two boys, Chatham and Warmer comes of age equally divided between them or their heirs lawfully begotten, but if either of them
should die without heir lawfully begotten, the surviver [sic] shall be sole heir to the deceased and neither of my two aforesaid [grandsons] shall have any other part of my estate.
Item. I give and bequeath unto my daughter Elizabeth Lee and the female children of her body the following property vizt. Rose (and her younger child) Beck, Ellen & Mima. also I give and bequeath unto my granddaughter Sally H. Lee one feather bed & furniture all of which aforesaid property in Negroes I leave in the possession of and care of my two
sons Thomas Hurst & James Hurst & my Nephew Thomas Hurst and I do hereby appoint them my lawfull [sic] trusties for the particular purpose of taking care of aforesaid property for the only use of my aforesaid daughter & her female children and their heirs.
Item. I give and bequeath unto my son Thomas Hurst the following property Vizt. Kendall, Judah, Molly, Andrew, Solomon, Mittey and Polly, also one hundred pounds to be raised out of my personality heretofore given to him and his heirs.
Item. I give and bequeath unto my four children Thomas Hurst, Jane Hurst, James Hurst and Sukey Hurst the balance of my estate not heretofore given to them and their heirs to be equally divided amongst them paying all my Just debts.

Lastly I do hereby constitute and appoint my two sons Thomas Hurst, James Hurst and my Nephew Thomas Hurst executors of this my last will and testament as signed by myself at the foot of every page. As witness my hand & seal this 28th of January 1807.

At a Court of Monthly session held for Northumberland County at the Courthouse on Tuesday the 14th of April 1807.
This last will & testament of Thomas Hurst decd. was proved by the oaths of Thomas W. Hughlett and Roger W. Hughlett witnesses thereto, and ordered to be recorded. James Hurst and Thomas Hurst (son of K.) named executors in the said will came into Court and refused to take upon themselves the burden of the executorship.
