Notes:

WILL

In the name of God Amen I Kemp Hurst of Wiccomoco [sic] parish in the County of Northumberland and Colony of Virginia being Sick and weak in Body but in perfect sense and Memory thanks be to god and Calling to mind the mortality of my Body do make Constitute and ordain this to be my Last will and Testament in manner and form following

Imprimis I bequeath my Soul to god who Gave it me in hopes of a future reward and my body to the Earth to be Buried According to the Direction of my Exet. hereafter Named and my worldly Estate I dispose of in the Following manner and form.

Item. I give and bequeath unto my Daughter Betty Kemp Hurst my Negroe Girl Nanny to her and her heirs forever after the Decease of Loving mother or day of marriage.

Item. I give and bequeath unto my Daughter Sukey Hurst my Negroe Girl Letty to her and her heirs forever after the Decease of her Loving mother or day of Marriage.

Item. I give and bequeath unto my Son Kemp Hurst my Negroe Boy Solomon to him and his heirs forever after the Decease of his Loving mother or day of Marriage.

Item. I give and bequeath unto my son Isaac Hurst my Negroe Boy Emanuel to him and heirs forever after the Decease of his Loving mother or day of marriage.

Item. I give and bequeath unto my son Willis Hurst my Negroe Boy Jesse to him and heirs forever after the Decease of his Loving Mother or day of Marriage.

Item. I give and bequeath unto my son Thomas Hurst the Plantation I now live on together with all the appurtenances to him and his heirs forever.

Item. My will and Desire is that my Beloved wife Sukey Hurst Shall have and possess my whole Estate of Lands and Tenements Negroes and all my other Estate of what nature or [illegible] Dower it be that my beloved Wife Sukey Should have and Enjoy the whole use of the same During her Widowhood.

Item. I give and bequeath all the rest of my Estate Except the Legacies before mentioned of Negroes and other Personal Estate to be Equally Divided between my Six Children, Thomas, Kemp, Isaac, Willis, Betty Kemp, and Sukey Hurst to them and their heirs at the Loving mothers Death or
marriage.

Item. my will and Desire is that my Estate be not appraised but be Inventor?d by my Extr. hereafter named.

Item. I do nominate and appoint my beloved wife Sukey Hurst and my Brother Thomas Hurst Extr. of this my Last will and Testament. In Witness Whereof I have hereunto set my hand and afixed my Seal this 24th June 1782.

At a Court held for Northumberland County the 16th Day of October 1782.

This Last will and Testament of Kemp Hurst deced was presented in Court by Sukey Hurst and Thomas Hurst the Executrix and Executors therein named who made oath thereto according to Law and the same was proved by the oaths of John Sutton Charles Lattimore Junr. and Benjamin Bustle Those of the Witnesses thereto and Admitted to record and on the motion of the said Executors Giving Security a Certificate is granted them for obtaining a probate thereof in due form. Teste Catesby Jones Ct. Cur.

In the name of God Amen. I Thomas Hurst of Wicocomoco in the County of Northumberland and Colony of Virg.a being sick and weak in body but in perfect since & memory thanks be to God and Calling to mind the Mortality of my body, do make Constitute and ordain this to be my last will and

Item. I Give and bequeath unto my Loving Wife Elizabeth all my whole Estate of Lands, Negroes and whatever Estate also I am now possessed of during her Natural life: And after her decease I give and bequeath as follows.

I Give and bequeath to my Son Thomas Hurst one Negroe Girl Milly & one Negroe boy Dick to him & his heirs, with the Increase.

Item. I Give to my Daughter Elizabeth two Negroes. Viz.t a Girl Chloe & a boy Jarvis & the Increase.

Item. I Give to my Son Kemp Hurst the Plantation I now live on and the Plantation I purchased of Eliz.a Waddy adjoining it to him and his heirs forever.

Item. I Give to my Son Isaac Hurst the Plantation he now lives on, which I Purchased of John Berry Containing One hundred & forty eight Acres to him & his heirs forever.

Item. I Give and bequeath all the rest of my Estate of Negroes, and Personal Estate to be Equally Divided (after the decease of my loving Wife) amongst my four Children, Kemp, Isaac, Thomas, and Elizabeth Hurst.

Item. It is my Will and Desire that in Case that either my Son Thomas or my Daughter Eliz.a Should die before they attain to the age of Twenty one or day of Marriage, that the Negroes that I bequeath to them as Legacies go[to] the survivors.

Item. It?s likewise my desire that in Case that either of my four Children Should die without heirs or attain to the age of Twenty one years or Marriage that that part of Estate which I Bequeathed amongst them, that it should be Equally Divided amongst the Survivors.

Item. It?s my Will and desire that my Estate be not appraised but be Inventoried.

Item. I do Nominate and appoint my loving Wife Elizabeth the Excrx. & my two Sons Kemp and Isaac Hurst Excrs. of this my Last Will & Testament. In Witness whereof I have hereunto set my hand fixed my Seal this 24th day March 1760.

At a Court Held for Northumberland County the 12th day of August 1765. The Last will and Testament of Thomas Hurst decd was Presented in Court by Kemp Hurst and Isaac Hurst two of the Exors therein named, who made Oath thereto according to law, And being Proved by the Oath of Thomas Gaskins Gent. one of the witnesses thereto was Admitted to Record. In the Name of God Amen October the 27th 1718 I Thomas Hurst of the County of Northumberland and Colony of Virginia
or planter, being of Sound and perfect memory thanks be to almighty God for it and calling to mind the uncertainty of this life do make ordain Constitute appoint this and only this to be my last Will and Testament [illegible] and making voide all other wills and Testaments by me formerly made Either by words or Writing First I give and bequeath my Soul to God that gave it me trusting in the Pure mercies of my blessed Savior Jesus Christ who made all Souls [illegible] me and all mankind [illegible] trusting in his Son the redemption of my immortal Soul and my body to have Christian burial and for what worldly goods it hath pleased God to bestow on me I give and bequeath as Followeth

Item I give and bequeath unto my Son Jno. Hurst fifty acres of lands where formerly my Father lived from the River upwards with its priveledges belonging thereinto to him said John and his heirs lawfully begotten of his body for ever.

Item I give and bequeath to my Son Thomas Hurst the plantation where I now live together with all the remainder of my land with all its priveledges belong thereunto to him the said Thomas and his heirs lawfully begotten of his body for Ever and my Will and desire is that my beloved Wife Elizabeth should have the whole mannagement of my moveable Estate as long as she remains a Widdow and Further my Will and desire that my Son in law Thomas James should have the working on the Fifty Acres of lands that I here bequeath unto my Son John and his strength for the term of thirteen years to the dates hereof. InWitness hereof I have hereunto Sett my hand the Day and year above written.
