In this course, the death of one of the complainants, J. J. Tate, was suggested and admitted in open court, and it being admitted in open court that Elizabeth Tate, F. M. Tate, R. D. Tate, J. S. Tate, E. M. Tate, W. M. Tate, J. A. Tate, Mary Creighton, and V. L. Tate as the children, and Agness Boyd, Fannie Nunley, Mary Northcutt and Lucy Northcutt are the grandchildren and only heirs at law of the said J. J. Tate, deceased and Frank Boyd is the husband of Agness Boyd and John Creighton is the husband of Mary Creighton and J. J. Nunley is the husband of Fannie Nunley, on motion of K. P. Pearson, solicitor of complainant, this suit is filed in the name of the above mentioned parties as heirs at law of the said J. J. Tate, and the cause ordered to stand in the same plight and condition as it was at the time of the death of the said J. J. Tate. (No date given. Page and book not readable.)

Son of Major James and Ruth Davidson Tate. His family emigrated shortly to Smith County, TN, but it became Warren County, TN in 1807 where he grew up. His family settled near Collins River, McMinnville, TN. He married Sally. Her parents were born in VA. References: Family data, Federal Census 1850 Grundy County, TN, pages 686-92; 1860 pages 435-172. Dennis Tate records; James Striegel Tate records; Buddy Duke stated that they moved to Livingston County, KY in 1880 with Vance Lockhart's family. Bible owned by Maggie Savage of Palmer, TN in 1972.

Surveyed June 3, 1837 for Robert Tate, 5000 acres by entry dated May 15, 1837, No 4438 on the waters of Collins River and Brush Creek on the left hand fork of Collins River below Wm. Knight's, it being the NE corner of a 5000 acre survey in the name of Elan Tate, also the beginning corner of a 5000 acre survey in the name of John G. Tate, crossing Hills Turnpike Road, waters of Brush Creek, crossing Hills Turnpike, including and platting out 62 1/2 acres of older title. James Tate and John Tate, CC. The above survey was transferred to Stephen Haight. Isaac Hill, DS, June 21, 1837. Sent on June 27, 1837 by W. Sims.
