29377	Thanks to Find A Grave I was able to finally locate Horatio and Augusta since I couldn't find them in the 1910 census. Christ Lutheran Church Cemetery in Rowan County NC is an abandoned cemetery. Here is the description from the cemetery information; "...... the OLD church near the railroad tracks in Spencer, Rowan Co., NC. This area is now owned by Southern Railway. There are about 75 graves there but the cemetery has not been kept up. Some of the graves have no markers, some of the monuments are toppled and broken, and some have pushed down a steep embankment. The woods and brush are taking over the cemetery and it is in need of a cleanup and restoration." Spiller, Reuben Wright, Reuben Turner, and William Aylett took out a bond payable to Robert M'Kendlish. In 1793 a lawsuit that was brought against Spiller, Reuben Wright, and Reuben Turner in 1793 in the District Court of King and Queen County by Archibald M?Call to whom the said bond had been endorsed. ?The writ was executed by the Sheriff of King William County, on Turner only, and Spiller and Wright were returned "no inhabitants" and William Aylett was deceased. This suit ended with only Reuben Turner brought to court but is mentioned here because the January 1774 date is the earliest mention found for Benjamin C. Spiller of King William County, Virginia. 1774: George Dabney (Caroline Co.) and Benjamin Cluverias Spiller, administrators of William Spiller, Gent vs. Lazarus Yarbrough. Order Bk. 1774-76, p. 44, 48. (Valentine Papers, Vol. I:402) ------------------- 1777: Virginia Gazette, Dixon and Hunter, 19 Dec 1777. To be sold, on the premises, on Monday the 5th of Jan next, if fair, otherwise the next fair day, for ready Money. A tract of land in King William Co., near Aylett?s Warehouse, containing, by the old Survey, 750 acres, there is good Buildings on the said land, with two Plantations, and is subject to my Mother?s dower, also 10 likely Virginia born slaves, the stock of horses, cattle, sheep, and hogs, about 3000 weight of gross pork, the crop of corn, wheat, peas and fodder, with all the plantation utensils. On a motion made, Mr. Carter Henry Harrison reported, from the committee of Propositions and Grievances, that the committee had, according to order, had under their consideration the petition of Benjamin Spiller, to them referred, and had agreed upon a report, and come to a resolution thereupon, which he read in his place, and afterwards delivered in at the clerk?s table, where the same were again twice read and agreed to by the House, as followeth: It appears to your committee, that the petitioner entered into the service in the month of September 1775, and continued therein till January 1776, when he was promoted to a lieutenancy in the 7th Virginia regiment; and in the month of January following, got the command of a company, which command he held till he left the army, which happened in the month of September 1778. Resolved, that it is the opinion of this committee, That the petition of the said Benjamin Spiller, praying that he may be allowed the same bounty in lands as is given by law to a captain in the continental service, is reasonable. Ordered, That Mr. Carter Henry Harrison do carry the resolution to the Senate, and desire their concurrence. p. 84 Mr. Richard Lee reported, from the committee of Claims, that the committee had, according to order, had under their consideration the petition of Elizabeth Lovell to them referred, and had agreed upon a report, and come to a resolution thereupon, which he read in his place, and afterwards delivered in at the clerk's table, where the same were again read, and are as followeth: It appears to your committee, from a certificate under the hand of Mr. B. C. Spiller late a captain in the second Virginia State regiment, that Robert Lovell, (the petitioner?s late husband) was a lieutenant in the said regiment during the late war, and died in the service the 11th ol August 1778, and that he believes there was pay due to him from the 1st of March in the said year. ------------ VA Gen. Soc. Quart., Vol. 28, No. 4, p. 312. Nov. 1788: King William Co., VA. Petition of Holt Richeson, asking that he be relieved of the effects of a judgment againt him for taxes actually collected by another. Names menitoned: Holt Richeson, Colo Jno Hickman, Benjamin C. Spiller. Nov. 14, 1789. Petition of Holt Richeson shows that in Aug 1786, he was high sheriff of King William Co. and gave his bond for the collection of taxes in said County, that in Oct 1786, Col. John Hickman qualified as high sheriff in said county; it being determined that sd Hickman was entitled to the collection of said taxes, the petitioner and one Benjamin Spiller contracted to collect the taxs. John Hickman died on 17 mar 1788. The petitioner had acted as deputy sheriff under John Hickman and had collected taxes in one parish alone. The petitioner has been served with a judgment for the entire amt. of taxes collection. Spiller, Farinholtz land and Tignerzds land and John Catlett?s land. Recorded 4 Mar 1796. Ann Spiller releases her dower, recorded 25 Apr 1796. 1797: Henrico Co., VA. Benjamin C. Spiller, assignee of Robert Pollard, admin. of John White, dec?d va. Smith Blakey, executor of Charles Hundley, dec?d, deft. Judgment for $182 to be discharged by the payment of L63 - 13 -1 with Int. from the 25th of September 1795 till paid and the costs of 5.69. A fi fa issued 8 May 1797 to Shf. of ____ returnable to July dec?d C? - which was returned with this endorsement thereon to wit ?The executor denies that he has any effects in his hands - J. M. Sheppard, Dy Shff.? ---------------- MILITARY SERVICE Mil Ser. BET 1776 AND 1783 4th Virginia Infantry Benjamin "entered into the service in the month of September 1775, and continued therein till January 1776, when he was promoted to a lieutenancy in the 7th Virginia regiment; and in the month of January following, got the command of a company [in the 2nd Virginia Regiment,] which command he held till he left the army, which happened in the month of September 1778." (Va). 2d Lieutenant 7th Virginia, 26th February, 1776; resigned 10th October, 1776: Captain 2d Virginia State Regiment. 9th May, 1777; resigned 12th August, 1778. PUBLIC SERVICE Benjamin C. Spiller served as a deputy sheriff of King William County in 1786, serving under Holt Richeson and then John Hickman. He collected taxes in the upper parish of the county, leaving his tax collector's notebook, which can be seen at the Library of Virginia in Richmond, Virginia. 1800: Elected to the House of Delegates in Lancaster Co., VA. LAND RECORDS In November 1784, Benjamin Spiller presented a petition to the House of Delegates asking to be given bounty lands as provided for by law. His petition was found to be "reasonable" and he was allowed the same bounty lands as given to a captian in the continental service, although he served in the Virginia line, which turned out to be four thousand acres. This land was recorded as being in Ohio but was in the area that is now part of Kentucky. The land was described as being "nortwest of the River Ohio between the Little Miami and Sciota." He divides up this land in his will, giving one thousand acres to each of his two sons from his first marriage and two thousand acres to his youngest son, James Spiller. 1789 The College of William & Mary plat book records the lease of Lot #34 to Benjamin and William Spiller and this lot contained 100 ac. along with the mill called Spiller?s Mill on Governor?s Swamp in King William Co., VA. 23, Oct 1793: a new lease was entered into with the college and the lessees were J. Hickman Spiller, Robert Turner Spiller (?) and William H. Spiller. 1798: Deed Bk 5:318, King Wm. Co., VA. Benj. C. Spiller release to Thomas Frazer in order that Frazer may sell land to Robert Dugar. 1799: Folder No. 25, at University of IL at Urbana-Champaign in IL History and Lincoln Collections, Item No. 42: Item No. 42. Letter to R. C. Anderson from Hickman Spiller. Lands surveyed for Benj. Spiller, have been lost, asking for Anderson to take care of it. May 25, 1799. (Richard Clough Anderson Papers (1784-1904), TAX RECORDS The 1787 tax list of King William County, Virginia shows Bejamin C. Spiller with 615 acres, one tithe (himself) over twenty-one, one white between the ages of sixteen and twenty-one, thirteen male slaves over the age of sixteen, twelve male slaves under the age of sixteen, ten horses, forty-two cattle, and one chair carriage. 1796: Lancaster Co., VA tax list; paying tax on 797 acres of land. 1797: Benj. C. Spiller, Lancaster Co., VA Land Tax List. The 1800 tax list of Lancaster County shows what is definitely this Benjamin C. Spiller. He has two tithes over sixteen, two black slaves from twelve to sixteen, nineteen slaves over sixteen years of age, and ten horses. WILL 26 Mar 1801, codicil 11 Apr 1801, proved 20 July 1801 In the Name of God, Amen I Benjamin Spiller of Lancaster County being sick of body, but of perfect sense and memory do make and publish this my last will and testament in manner and form as followeth. Item. My will desire is that my estate shall remain undivided for the use of my loving wife Ann Spiller and the support of my children (who is to pay no board) for and during the life of my said wife, except my executors, to be hereafter named should think that it would be for the advantage of my estate to divide it sooner or my said wife should again marry in either case my desire is that my loving wife Ann Spiller shall have and receive one third part of my estate both real and personal which she shall have and enjoy as dower, for and during her life. Item. My desire is that should my daughters Susanna, Ann Frazer, Grace, Rockseylany or either of them marry before the death or marriage of my said wife Ann Spiller, that they or either of them shall have and receive her or their share or portion of my estate at such time as they shall choose, which shall be in full of and for their part or parts. And that should either of my children die without lawful issue of their body begotten, that his her or their part or parts of my estate shall then return and go to such child or children of mine, or their heirs, as shall then be living. Item. I lend unto my loving wife Ann my negro woman Hannah & all her children, that she now has or hereafter may have for and during her my said wife?s life, and do hereby give her full power to give or dispose of her the said negro woman Hannah and her future increase among my children as she may think proper. Item. I give unto my two sons William and Hickman Spiller, one thousand acres of land each lying in the state of Kentucky, it being part of my military lands which was granted to me for my services for and under the Commonwealth during the last war, which amounts to four thousand acres which said one thousand acres of land each & what I have already given to them my said sons is in full, of and for their parts in my estate. Item. I give unto my son Benedictus Spiller my dwelling plantation whereon I now live, which land I purchased from Thomas Pinckard [ Indian Creek Farm] provided my said son shall pay unto his brother James Spiller when he comes of age 250 pounds and in case his said brother James shall die before he comes of age, that the said sum of two hundred and fifty pounds shall be paid unto my son Patrick Spiller. Item. I give unto my son Benjamin Spiller all that part of my land I purchased of Mr. Hudson Muse & also my mill I bought from Mr. William Eustace, after death of my said wife. Item. I give unto my son Patrick Spiller my land lying in Northumberland County I purchased from Mr. Tho Hull after death or marriage of my said wife. Item. I give I give unto my son James Spiller two thousand acres of land lying in Kentucky, it being part of the four thousand acres of land before mentioned and which I give two thousand acres of between my two sons William and Hickman Spiller. Item. My desire is that should my executor recover the land that is in dispute between Mr. Peter Tankersley and myself that it shall be equally divided between my two sons Benedictus and Benjamin Spiller. Item. My desire is that my daughters before mentioned shall have a negro girl each out of my estate which my said wife shall point out which shall not be counted in their parts or shears (sic) of my estate. Item. My will and desire is that the balance of my estate not already given shall be equally divided between my following children to wit Benedictus, Benjamin, Susanna, Ann Frazer, Grace, Patrick, Rocksylany and James after death or marriage of my said loving wife Ann Spiller or sooner as aforesaid in the first clause of this my said will. I hereby appoint my son Benedictus Spiller, my friend William Kirk and my friend John Carpenter executors of this my last will and testament. Washington County, Virginia Deed Book 23, page 346 James Snodgrass bought land for $1.00 from Joseph Worsham and wife, Nancy McNew, for a meeting house for free religious worship at the forks of the creek running from James Meadow's and I. N. Logan. This is present day Blackwell's Chapel. 1858.. Washington County, Virginia.. James and Mary Ann bought a tract of land in Washington County, Virginia on the south side of Little Mountain...bound on east by her brother, Calvin and on the west by Andrew Taylor's place. She was a graduate of Missouri Valley College and received a master's degree in classical languages from the University of Missouri-Columbia. She taught at Stafford High School in Stafford, Kansas; Hardin College in Mexico, Missouri; and was adjunct professor of Latin at Texas Christian University in Fort Worth before her retirement. She lived in Fort Worth since 1956 and was a member of Trinity Episcopal Church in Fort Worth. She was a member of the American Association of University Women. Survivors include a son, the Rev. 29392	The Doak Family migration history is murky and disputed. "The Mathews (Mathes) Family in America" by Ida Christabelle Van Deventer -- Alexander Printing Co., 1925. She writes that Alexander Mathews came with the Doak family in the Scotch-Irish immigration from Northern Ireland to Pennsylvania, with James Doak, his wife Elizibeth, and five children, Samuel, David, John, Robert and Thankful. They all emigrated from North of Ireland to America, landing in Newcastle, Delaware in 1708 and settled in Chester Co., PA. Ralph Doak, a modern historian, disputes this as only a few groups of Ulster Scots emigrated to America before 1718. He cites William Henry Foote, who in 1846 published a work entitled, for the sake of brevity "Sketches of North Carolina:" During the course of this work it is disclosed that Samuel, father of Rev Samuel Doak (1749 - 1840) emigrated "very young." The elder Samuel was born around 1716 in Antrim, Ulster Ireland. So the Doaks migrated after 1720 as James' youngest son, Robert, was born in 1720 in Ireland. The earliest record that may be James is in Lancaster Co. PA which until 1728 was part of Chester Co. The 1728 petition for the creation of Lancaster Co. was signed by Thomas Mitchell (Jane's father, who died in 1734) and a James Doke. ---------- Elaine M Doak Special Collections Librarian/Archivist Pickler Memorial Library Truman State University, Kirksville, MO has put a lot of time into research. "Here's what we've got on the 1st couple of Doak generations in America. There are basically 2 versions of the "transitional" generations. One is that Samuel Doak, who remained in Ireland, had a son James who came to PA w/ wife Elizabeth and several children almost any year between 1720 & 1740 (depending on which source you read). The other version is that Samuel himself was the immigrant, same time span. I have yet to see any PROOF of either version. The truth is that we have no idea who the father of the group I call the "immigrant generation" was. My brother & I went to Chester & Lancaster Cos PA summer before last & came up w/ a lot of nothing -- except more questions. Some records cited by earlier researchers do not exist. Those that do exist do not prove that the Doak family in that area during the 1720-40 time period was the same Doak family to later settle in Augusta Co VA. There are some similarities of given names which COULD indicate they are our Virginians, but they could also indicate they are the Doaks who are to be found a few years later further north in PA. We did find a James Doke who signed a 1729 petition to create Lancaster Co out of Chester Co. This was the only reference to James we found. It's curious that while Doaks seem to repeat given names over & over, there are no Jameses in the Augusta Co group. That's not proof of anything; it's just an observation. Some published sources cite a 1727 Chester Co Orphan's Roll which mentions Elizabeth Doak & son David. The County Archivist tells us that all records where were extant as late as about 1900 are still there but this particular entry could not be found. What was the REAL source of the original citation? Also, if Elizabeth's husband was James why would she & her son appear on an orphan's roll 2 years before he signed the 1729 petition? BTW, an orphan is a child whose father is deceased; the mother could still be living. We found a 1726 tax roll listing John Doak & Mother (again, no father?), but the name Elizabeth does not appear there or on any record we could find in either county. The "immigrant generation" of siblings was Samuel, John, David (the youngest, probably born here), Thankful, Mary, Ann, & Robert. I think there may be a couple more names added to various versions; I seem to have forgotten to bring the list w/ me today. Of that group, we found POSSIBLE mention of John & Samuel in PA. We were unable to find Thankful's marr to John Finley which is supposed to be there, but PA didn't require marr licenses or bonds till the 1850s, so if the record is there it's probably in some church's files. It would be impossible to cover all of these lines, so I'm going to stick to ours. It is highly unlikely that "Immigrant Sam", as we call him, and Jane Mitchell were married during the voyage from Ireland as is so often reported. If the Doaks in Lancaster Co were ours, they were there as early as 1726 when John & mother appeared on the tax roll. (We're assuming, of course, that this John and our Sam were brothers.) John also appears on 1733 & 1734 grand jury panels. The earliest record we found of Samuel was 1737, when he also was on the grand jury, so it's possible he immigrated as late as 1736 (even tho this was a lot later than mother & brother). Sam's wife was Jane (confirmed by his Will), supposedly the daughter of Thomas & Eleanor Mitchell of Lancaster Co (not proved). If Jane was, in fact, Thomas & Eleanor's dau, evidence exists to suggest she was unmarried & living in her father's home in Lancaster at the time of his death--still unmarried AFTER the voyage. Thomas's Will (Lancaster Co Will Book A, Vol 1, pg 17) does not say she is unmarried, but seems to imply such by naming part of the family's livestock as hers, not her husband's. It also does not list her w/ the Doak surname. All this is strictly circumstantial, of course. The Will written 14 May 1734 lists the following family members: "...son John Mitchell & my Wife Elloner Mitchell...Elldest Daughter Martha..Second Daughter Mary ...[to] third Daughter Jean one two year Old mear and one year old Heffer and all the sheep Called her own...Fourth Daughter Jenat...my brother John Mitchell..." 1736 has been reported as Sam & Jane's marriage date; that seems to be in the ball park (their first child was born ca 1738) but it would have been in PA, not aboard ship. This is likely an unprovable date, as are their dates of birth. The Sam on the grand jury in 1737 had to have been at least 21, therefore born no later than 1716. Sam & Jane moved to VA ca 1739; he sold his property in Lancaster no later than May of that year and began to appear in August Co records as early as 1740. His August Co property in Beverley Manor borders the west side of the present-day village of Greenville. Sam died there between 5 Nov 1771 and 19 May 1772, the dates his Will were written & proved in Court (Augusta Co Will Book 4, pg 497). The Will lists the following family members: "Jane my Dearly beloved Wife...Daughters viz Elinor, Mary & Isabel...son John...oldest son David...son Robert...daughters Jane and Elizabeth...son in law William Brown...brother in law John Finley..."You may read in the course of your research about a controversy over the wording of Sam's Will as copied to the Will Book, which reads "brothers in law John Finley and John Tate". While the word brother is plural, the "s" is in a different handwriting & different ink. Some say the plural proves the marriage of Sam's sister Mary to John Tate. When or why the "s" was added I don't know, but added it was. Since the original Will no longer exists, we don't know if the addition was an honest attempt to correct to record book to the actual wording of the Will or if it was added at a later date to prove the Doak-Tate marriage (as some suggest). Lyman Chalkley did not pick it up in his 1911 abstracts which gives one the idea it may have been added during the 20th Century." 29399	The Family of Thompson and Sophronia Dunnegan, compiled by Carol E. Vaughan, Lexington, KY Thompson lived with his father, Absalom, and remaining family members in White or Warren Counties, TN until around 1835 when he started his own family. His mother apparently died before 1830. Thompson married Sophronia Elizabeth Tate, daughter of Alexander Tate and Delilah Henderson. She was born around 1810 in VA or TN. It was said that Sophronia was "born with a veil" which, according to Appalachian folklore, could mean that she may have had an extra sensory "gift" or "powers." Certainly, she was held in high esteem since two of her granddaughters were named for her. Thompson and Sophronia had seven children, six of which were born in TN. Thompson and Sophronia made their home in Warren County, TN in the Civil District 2 community of Campaign. He appears on the Tax Lists of 1836 and 1838 which show him as having 100 acres of land. The only record of land transactions found in TN was a Trust Deed dated April 25, 1838 in which a George Cole pays off a debt Thompson owed to Miller and Pennen for interest and possible sale of property. They lived in Warren County at the time of the 1850 Census but moved to Missouri shortly after that count. Their seventh child, Leander was born in MO in 1854. In the 1860 Census they are shown living in Iron County, MO with all seven children. By 1870, the family had settled in the town of Greenville in Wayne County, MO. Jane, Mary L., and Irvin were still living with them. James Elgin and William Samuel were married and living in Iron County. Sarah C. had married George B. Wallace by that time. The 1870 Census shows a Samuel Spears, farm laborer from TN, living with Thompson and Sophronia. We believe that Samuel was the son of Nancy Dunnegan and James Spears. At this time, Nancy is thought to have been Thompson's sister. The dates and places of death for Thompson and Sophronia are unknown. The last record of Sophronia is shown on a deed dated March 22, 1879 in which she and Thompson sold a parcel of land in Wayne County to Emmanuel Lovelace. In another deed dated June 22, 1880, Thompson and his second wife, Sarah (Sallie) E. Foquaide sell a parcel of land to Irvin George Dunnegan. No evidence has been found to pinpoint the date of his death...only that he was still living in 1880. Nor, have any cemetery records been found showing their burial in Wayne or Iron Counties. There is a possibility that both were buried in a part of Old Greenville, located on the St. Francis River, which has been under water since the creation of Wappapello Dam. A record of Thompson's marriage to Sarah E. Foquaide was found in Iron County. They were married April 14, 1880. The 1880 Census shows Thompson as head of household, 70 years old, farmer from VA, with his wife Sarah, 48 years old from TN. Also are listed two children, John (17) son, and Frances (11) daughter. The surname Dunnegan is shown for these children, but I do not believe that Thompson adopted them since their real names show up on later records. It is possible that Thompson died in St. Louis. 29400	The Family of Thompson and Sophronia Dunnegan, compiled by Carol E. Vaughan, Lexington, KY Thompson lived with his father, Absalom, and remaining family members in White or Warren Counties, TN until around 1835 when he started his own family. His mother apparently died before 1830. Thompson married Sophronia Elizabeth Tate, daughter of Alexander Tate and Delilah Henderson. She was born around 1810 in VA or TN. It was said that Sophronia was "born with a veil" which, according to Appalachian folklore, could mean that she may have had an extra sensory "gift" or "powers." Certainly, she was held in high esteem since two of her granddaughters were named for her. Thompson and Sophronia had seven children, six of which were born in TN. Thompson and Sophronia made their home in Warren County, TN in the Civil District 2 community of Campaign. He appears on the Tax Lists of 1836 and 1838 which show him as having 100 acres of land. The only record of land transactions found in TN was a Trust Deed dated April 25, 1838 in which a George Cole pays off a debt Thompson owed to Miller and Pennen for interest and possible sale of property. They lived in Warren County at the time of the 1850 Census but moved to Missouri shortly after that count. Their seventh child, Leander was born in MO in 1854. In the 1860 Census they are shown living in Iron County, MO with all seven children. By 1870, the family had settled in the town of Greenville in Wayne County, MO. Jane, Mary L., and Irvin were still living with them. James Elgin and William Samuel were married and living in Iron County. Sarah C. had married George B. Wallace by that time. The 1870 Census shows a Samuel Spears, farm laborer from TN, living with Thompson and Sophronia. We believe that Samuel was the son of Nancy Dunnegan and James Spears. At this time, Nancy is thought to have been Thompson's sister. The dates and places of death for Thompson and Sophronia are unknown. The last record of Sophronia is shown on a deed dated March 22, 1879 in which she and Thompson sold a parcel of land in Wayne County to Emmanuel Lovelace.
