28052	Some researchers having him as the sheriff of Rutherford Co. and dying at the Battle of Guilford Court House in 1781 during the American Revolution. The problem is there is no record of an Abner Weatherly being killed. If wasn't killed the Revolutionary War, then the Abner Weatherly was elected sheriff of Guilford County NC in 1797 could be him. Otherwise, it may have been his son, Abner Jr. See the information below. Other researchers have his name as Jesse, being born in Maryland in either Dorchester, Somerset or Caroline County, and being killed at the Battle of Guilford Court House. The documentation, evidence and sources for this family aren't complete. NC) for 1797. He received 6 votes, a majority, 7 votes were cast. Thirty-seven deeds were proven in open court this term. Abner Weatherly, sheriff, came into open court and protested against the goal [jail] of this County, the same being insufficient in his opinion, (August 1797, page M) Abner Weatherly was re-elected Sheriff and allowed 30 pounds for year's service. Ordered that the clerk be allowed 22 pounds for his ex- officio services for 1797. (May 1798, page 65.) Abner Weatherly was re-elected Sheriff unanimously at the May Court. William Armfield was appointed Trustee for Guilford County. (May 1799, page 102.) Ordered that Abner Weatherly, sheriff, be fined for swearing. ( Page 234) Thomas Dick, William Ryan and Abner Weatherly, Esqrs., are appointed a committee to arrange and prepare a list of persons qualified to serve as Jurors in the Superior Court of Law hereafter to be held for this county and that they make report of proceedings at present term of this court. (Feb. 1807, page 398.) At this term Abner Weatherly, who had been sluritT ten years, resigned and James Dunning was elected for nine months. This is the right age, same location, so it may be a clue to proving this was her maiden name. He was eminent for his oratorical powers and legal attainments; and bore a strong resemblance to his uncle, President John Tyler. He served often in the legislature and was a strong states rights man. He was father of the authoress, Molly Elliot Seawell. His brother, Machen Boswell, studied at William and Mary College in 1839-40, studied law and was regarded as one of the best chancery lawyers in the state. An uncle was Gen.
