James Burress Indenture/Deed July 16, 1844

This Indenture, made the sixteenth day of July in the year of our Lord, one thousand eight hundred and forty four between James Burrass (sic) and Franky, his wife of the County of Tazewell and State of Virginia of the one part and George P. Thompson of the same County and State of the other part, witnesseth: that whereas the said James Burrass is justly indebted to George W. Browne in the just and full sum of nineteen dollars and forty six cents, the payment of which with interest the said Burrass is willing and desirous, effectually to assure and secure to the said Browne. This Indenture therefore witnesseth, that the said Burrass and Franky, his wife, as well in consideration of the premises aforesaid as of one dollar to him in hand paid by the said Thompson, the receipt whereof is hereby acknowledged the said James Burrass and Franky his wife, have granted, bargained and sold, and by these presents do grant bargain and sell unto the said George P. Thompson, all the right, title, interest and claim of them, the said James Burrass and Franky, his wife, in and to the real estate of Alexander Neel, deceased, the said Franky being a daughter of said Alexander Neel and as such entitled to the eighth part of his estate, with all the appurtenances. To have and to hold the said interest in said parcel of land, with all the appurtenances unto the said Thompson and his heirs, to the sole use and behoof of the said Thompson and his heirs, and the said James Burrass and Franky his wife, for themselves and their heirs, the said right, title and interest in the said parcel of land, with all the appurtenances to the said Thompson and his heirs against the claim of them the said James Burrass and Franky his wife, and their heirs, and all other persons whomsoever shall, will and do by these present warrant and forever defend, in trust, never the less, that if the said James Burrass, his heirs, executors or administrators, do and shall well and truly pay or cause to be paid to the said George W.G. Browne, his heirs or assigns the said sum of nineteen dollars and forty six cents on or before the 16th day of December next together with the expenses of drawing and recording this indenture and the tax thereon, then and in that case, this indenture, and everything herein contained shall become void and of no effect; But if the said Burrass shall fail to pay the said sum of money or any part thereof, on or before the said 16th day of December, next, then it shall be lawful for the said Thompson, and full power and authority is hereby given him to proceed to sell the said interest and claim in said parcel of land with all the appurtenances, so soon after the said 16th December next as he may be requested by the said Browne, at public auction for ready money, to the highest bidder, at Tazewell Court House, having previously advertised the time and place of sale at least twenty days by advertisement affixed for that space of time to the front door of said Court House and the proceeds of such sale after paying thereout all the expenses attaining the execution of this trust including a commission of 5 percent on the amount of sale to the said trustee for his trouble in executing the same shall be applied by the said Thompson towards the discharge and payment to the said Browne of the aforesaid sum of nineteen dollars and 46 cents, with interest on so much of said sum with interest as may remain unpaid, and in further trust, that until such sale shall be made it shall be lawful for the said Burrass and wife, and their heirs, to hold and occupy the said granted interest in said land and premises and to take and receive, the rents, issues and profits thereof to their own proper use and benefit, and also, that the said Burrass his heirs, executors, or administrators, will pay and discharge all taxes, impositions, assessments and other charges, whatsoever which may or shall become chargeable thereon, during his or their possession thereof. And the said Thompson doth covenant on is part, that he will faithfully execute the trust hereby reposed in him. In testimony whereof, the parties hereunto have to these presents set their hands and affixed their seals, the day and year first in this indenture written.

Franky Burress Indenture/Deed September 23, 1845

This indenture, made this twenty third day of September in the year of our Lord one thousand eight hundred and forty five between James Burrass (sic) and Franky, his wife of the county of Tazewell, and state of Virginia of the one part and George W.G. Browne of the other part, witnesseth: that the said James Burrass and Franky, his wife for and in consideration of the sum of forty dollars current money of the United States to them in hand paid, the receipt whereof is hereby acknowledged, do grant, bargain and sell unto the said George W.G. Browne, all their right, title and interest in a certain tract or parcel of land lying and being in the county of Tazewell on the Muddy fork of Wolf Creek, which formerly belonged to Alexander Neel, and in which as the daughter and heir of said Alexander Neel, the said Franky is entitled to one eighth part with all the appurtenances: To have and to hold the said interest in said tract or parcel of land with all the appurtenances unto the said George W.G. Browne, and his heirs, to the sole use and behoof of him the said BrownE and his heirs. And the said James Burrass and Franky his wife for themselves and their heirs, do covenant, with the said George W.G. Browne, that they the said James Burrass and Franky his wife the said interest in said parcel of land, with all the appurtenances unto the said George W.G. Browne, and his heirs, against the claims of them the said James Burrass and Franky his wife, and every other person or persons whatsoever, shall warrant and will forever defend. In witness, whereof the said James Burrass and Franky, his wife have hereunto subscribed their names and affixed their seals the day and year first above written.

We, Erastas G. Harman and William Cox, Justices of the Peace in the County aforesaid, in the state of Virginia, do hereby certify that Franky Burrass wife of James Burrass, parties to a certain deed, bearing date on the 23rd day of September 1845 and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privately and apart from her husband, and having the deed aforesaid fully explained to her, the said Franky Burress, acknowledged the same to be her act and deed and declared that she had willingly by signed, sealed and delivered the same, and that she wished not to retract it. Given under our hands and seals this 23rd day of September 1845.

Regimental History

29th Regiment, Virginia Infantry

29th Infantry Regiment was authorized in November, 1861, and was to contain seven companies under Colonel A.C. Moore and three companies at Pound Gap. However, this organization never took place. Moore's five companies from Abingdon and companies raised in the spring of 1862 evidently made up the nine-company regiment. It was assigned to the Valley District, Department of Northern Virginia, then moved to Kentucky where it was engaged at Middle Creek. Later it saw action in Western Virginia and for a time served in North Carolina under General French. In March, 1863, it totaled 732 men. Attached to General Corse's Brigade the unit participated in Longstreet's Suffolk Expedition and during the Gettysburg Campaign was on detached duty in Tennessee and North Carolina. In the spring of 1864 it returned to Virginia and took its place in the Petersburg trenches north and south of the James River and ended the war at Appomattox. Many were lost at Sayler's Creek, and only 1 officer and 27 men surrendered on April 9, 1865. The field officers were Colonels James Giles and Alfred C. Moore; Lieutenant Colonels Alexander Haynes, William Leigh, and Edwin R. Smith; and Majors Ebenezer Bruster, William R.B. Horne, and Isaac White.

Mr. Pack an aged citizen has been ill at the home of his daughter, Mrs. Fred Quesenberry, (Cynthia Pack) the past week.

Georgia Maud Quesenberry Maxfield, an 80 year old Tazewell resident (deceased), wrote these recollections of early Tazewell County life as told to her by her great-grandmother and her grandmother. Her Recollections appeared in the Tazewell Newspaper sometime in the early 1980's. Georgia was the daughter of George & Mary Frances Burress Quesenberry.

From the Past: A Massacre end happily

Many years ago, there were a young man and woman who lived somewhere along the banks of the Clinch River with quite a few other settlers. This chapter of Captain John Delong and his wife, Matilda, takes place around the early 1800's.

Late one evening a small band of Cherokee Indians had made camp for the night a short distance from the settlement down by the river. There was no love lost for the Indians by some of the men in the settlement.

These same Indians had been catching their fish in this spot for many years. This made no difference to the men, they wanted to kill them right then.

Captain Delong talked them out of it for the time being. Later that night, these men slipped out of the settlement and killed all the Indians.

The next morning, Captain Delong was told of the slaughter and was asked if he would help bury the indians before their cheif could find out. He said he would.

As the captain and the other men were finishing the clean up, the captain thought he heard a small dog whining in a teepee that had not burned but rather sat there, smoldering. Captain and Mrs. Delong could have no children, but he was found of animals and he hurried to the teepee.

Upon entering, he found, wrapped tightly in a cradle back pack, a beautful Indian baby. Almost overcome with joy, the captain hurried home.

With the glimmer of tears in his eyes, he said, "Tilda, I have for thee a present." Matilda too was overcome with joy.

She fed the baby cow's milk from a bottle that had been used to feed small animals from time to time. When she undressed the tiny being, she discovered it was girl. They kept her and named her Samantha Delong.

In due time, Samantha grew up and married a young man named Jack Pack. As their life progressed, they had a family of three girls and three boys. Their names were Sarah, Cynthia, Ellie, Bill and Flemming. These children grew up while another boy died at birth in the cold, long winter.

Michelle Burress' analysis:

This story has some inconsistencies and while I'm I believe there may be some truth to the story, there are a lot of things that are wrong which backed up with fact. I'm not sure if there as confusion regarding the names or a lot of fiction involved with the telling of the story. There is no evidence that a John DELONG married a Matilda, or that John PACK married a Samantha DELONG. Orman Delong and Sarah Reed seem to be the only resonable couple for a child named Matilda Delong that married John Pack. Orman and Sarah, however, also had many other children. John and Matilda did indeed have children named Sarah (who married a William Burress) Flem, Cynthia, Ella and William, but they also had other children. There is no evidence that either John Pack or Orman Delong were Captains in the Military or that any of these couples were unable to have children). However there was a John Delong listed in the military records of Montgomery county, in the same unit as Orman Delong. Have not figured out the connect yet. ~Michelle

STORIES

It was said she was a "red-headed,full-blooded Irish woman," according to contemporary accounts. While her husband, Chapman Elswick, was fighting in the Shenandoah Valley, his family was facing uncertainty and hardships.

Emeline and another lady by the name of Polly Griffiths, wife of Martin Griffiths (29th VA Infantry CSA) dug coal to fill ox carts, and during the summer months, leaving their children behind, drove the carts pulled by oxen and they came down from the ridge [Pleasant Hill, Reynolds Ridge] between Big Creek and Middle Creek from Stinson Ridge to Cedar Bluff, then up to Frog Level, then across the mountain and down the valley to Saltville, Va. (which would have been 40-50 mile), where they traded the coal for salt.

On the way back they would stop and trade the salt for staples and supplies they needed on the farm. They would trade salt for food and vegetables with neighbors who would be able to tend their farms.

It was a long, arduous trip and demonstrated the fortitude and perseverance of women and what they had to do to survive.

BIOGRAPHY FROM FIND A GRAVE

Achillies was born in Virginia. He first married Mary J. Williams of Davidson county, TN. in 1868 in Coffee county, Tn. The family lived in district 6 of Coffee county between 1870 and 1880, Mary died abt. 1878. The couple had 3 children, Mary b. 1871, Margaret b. 1875 and Rowena b. 1878. Mary's widowed mother Evaline Williams and some of Mary's sibblings lived with the family in 1870 and Achilles worked at the flour mill. By 1880, Mary was deceased, living with the newly widowed Achilles and his three daughters is his sister in law Castilla Williams. The last name on official records is variously spelled Callaham, Calloham and Callahan.

Achilles was a confederate civil war veteran. He mustered in at Manchester, Coffee county, TN in 1861 at 25 years of age, as a Corporal and mustered out as a Sargent for the 24th Tennessee Infantry company K. The unit was raised at Coffee county, but due to poor conditions it was moved to Portland, Sumner county, TN. for training the troops. This is probably where he met Mary, her family lived in Davidson and her sister Margaret was engaged to Andrew Carver of Sumner, TN. (previously SC).

He married Jennie Taylor on May 8, 1881 in coffee county, tn. They had at least 3 children: Andrew Clarence Callaham b. 1889, Minnie and Maude. Their son Andrew died Oct. 1926 in Wichita falls, TX,

OBITUARY

Staunton Spectator and Vindicator; 18 May 1906

Mr. Archibald G. Christian, after an illness of two years, in which he several times was thought to be near death's door, died at 7 o'clock Friday night at home near Mt. Spring, in his 72nd year. Mr. Christian was the son of John B. and Jane Christian of Augusta county, and brother of the late Col. Bolivar Christian.

He was educated at Washington College, now Washington and Lee, and served the Confederacy in the 10th Va. cavalry. He was a man of fine natural ability, which he cultivated through life by reading and study, being one of the best informed men in the county. Social, hospitable and generous, he was known and esteemed all over the county. For many years he had been a prominent member of Bethel Presbyterian church.

Mr. Christian married Miss Martha Sproul, who died many years ago. Surviving Mr. Christian are six children from this union: Mr. Lee S. Christian of the county, Mrs. B.F. Cockrell of Nashville, Tenn., and Misses Fannie, Sallie, Mary and Mattie Christian, at home. He was also related to many of the well known families of this county.

The funeral took place Sunday afternoon from Bethel church, and was conducted by Rev. C.L. Altfather, the pastor. A large concourse assembled to pay tribute to a departed friend and neighbor, quite a number attending from this city. The following gentle men acted as pall bearers: Active -- Messrs. John H. McClure, Wilson M. Brown, W.W. King, R.F. Wallace, J. Marshall McClure and Dr. C.W. Roller. Honorary -- Messrs. Samuel F. Pilson, John W. Churchman, J. Alex Bumgardner, R.F. Larew, Frank H. McFarland, Edward T. Pilson and John A. Sproul.

HISTORICAL RESOURCES

From the History of Oregon: Benjamin was sixth of his father's eight children and was ten years old when they crossed the plains to Oregon.  His duty on the journey was to drive the milch cows on horseback, and he performed his task to the satisfaction of all parties.  After the arrival and settlement on the donation claim he remained at home until he was twenty-one and then went with his brothers to eastern Washington to engage in the stock business, and they took with them 225 head of cattle; because of the severity of the winter they lost nearly all of their stock.  About this time the war broke out, mining began in Idaho, and prices advanced. This naturally benefited them and in time they became wealthy.  Benjamin then went to Polk County and purchased a half section of land off the John Fudge donation claim.  After his marriage the couple resided in Washington for a year and then returned to Oregon and lived on land left him by his mother. He purchased more land by his mothers to total 800 acres.

DISCREPANCY - Monmouth Herald obituary gives birth year of 1835, while death certificate and marker give 1838.

NOTE - His second wife, Adelaide, and two of his children, Glendon Whiteaker and Nellie (Whiteaker) Kantner, are buried at Salem Pioneer Cemetery in Salem, Oregon.

OBITUARY:
The Herald made mention, last week, of the serious illness of B.F. Whiteaker, who was stricken with paralysis while transacting business at Independence. Mr. Whiteaker was taken home and under the care of a physician seemed to rally, but taking a relapse died on Saturday morning, August 24, 1912, and was buried on Monday.

He was born in Illinois, May 25, 1835, and came with his parents to Oregon in 1848. They located in Polk county and the Whiteaker homestead marks their enterprise. He was twice married, his first wife being Narcissa Hamar, and to this union were born W.H. Whiteaker, of Portland; A.J. Whiteaker, of Raymond, Wash.; Mrs. W.O. Cook of Eugene, and Mrs. E. Roe of Enterprise.

After the death of his first wife he married Miss Adelaide Fetzer, to whom were born Mrs. Etta [Nettie] Kantner of Seattle and Frank and Glenn Whiteaker of Cochrane, Ore. Deceased was a man of warm and generous impulses. His friends were numbered by his acquaintance, and he was a fine type of the pioneer. His home was always open and his hand ready to help the suffering and needy. He gave liberally to worthy public enterprises and at the time of his death was engaged with others in drilling an oil well on his extensive farm.

Col. Bolivar Christian, who in his day was prominent in the affairs of this State, died at the Western State Hospital on Tuesday morning, aged about 75 years. Deceased was a son of John B. and Jane T. Christian, and was born at Greenville. Col. Christian is survived by one sister and one brother, Mr. A.G. Christian, of Mint Spring, and Mrs. W.T. Richardson, of Waynesboro.

Col. Christian studied law and in 1849 commenced the practice of his profession in this city, and was elected to the legislature, serving in both branches until the war came on. During the war he was a member of the 52 Regiment serving in the commissary department. After the war he resumed the practices of law, and continued it until his health gave way.

The funeral took place Wednesday at Bethel church, the interment being in the cemetery there by the side of his mother, the services at the grave being conducted by Rev. R.A. Lapsley assisted by Rev. Dr. Geo. W. Finley, of Tinkling Spring. The following gentlemen acted as pall-bearers: Thomas D. Ranson, J.N. McFarland, James Bumgardner, Lewis Harman, Wm. F. Smith and J. McD. McCue.

On the morning of 24 February 1883, just after receiving their regular liquid medications, seven male patients lost consciousness. Four died almost immediately, two died in the next three days, and one recovered. An eighth patient vomited and experienced other ill effects, but recovered in a few days.

A coroner?s inquest concluded that the victims? cups of medicine must have been poisoned while sitting in an unlocked hall cabinet the previous evening. Other patients, taking the same medicine which had not been left in the cabinet, had no problems. Dr. W.W.S. Butler, head pharmacist at the asylum, testified that no poisons were missing from the dispensary.

Autopsies were performed, and University of Virginia chemistry professor John W. Mallet used the latest forensic techniques to analyze three of the victims? stomachs and their contents. Mallet concluded that the poison used was aconitia (also known as aconitine), an extremely toxic extract of the aconite or monkshood plant, and the coroner?s jury agreed. The asylum pharmacy had a bottle of highly diluted ?tincture of aconite,? but Mallet thought it was not strong enough to cause sudden death, and local drug stores did not stock any drugs derived from aconite.

The superintendent of the asylum, Dr. Robert S. Hamilton, suspected the poisonings were politically motivated, intended to discredit him and the Readjuster-Republican coalition administration of Governor William E. Cameron. Cameron had made heavy use of his patronage power, including the appointment of a new asylum board of directors who in turn had appointed Hamilton and replaced most of the former staff. To investigate the case, Hamilton, with Cameron?s approval, hired the famed Pinkerton?s National Detective Agency. Two Pinkerton agents interviewed druggists in Richmond, Alexandria, Washington, Baltimore, and Philadelphia to see which ones had sold aconitia, but found no good leads.

F. M. Smiley, a 27-year-old Pinkerton investigator with two medical degrees, went undercover in the asylum for over two months, posing as a patient suffering from ?melancholia? (depression). Soon the case had as many suspects as an Agatha Christie novel. Hamilton?s initial suspects were two melancholia patients: Charles J. Armistead, a former theology student who had once attempted suicide by drug overdose, and Bolivar Christian, a lawyer and former Confederate officer. Both were, in Hamilton?s words, ?sharp, shrewd, highly educated and were also strong adherents of the opposition [Democratic] party and were bitterly opposed to the present management of the Institution.?

Armistead was, according to Hamilton, ?a thorough chemist? familiar with drugs. Christian had previously accused Dr. Butler of tampering with his own medicine. Both had access to the hall at the time when the medicine was poisoned. Detective Smiley, playing his part well as a patient who had occasional ?bad spells? but was generally rational, gained the confidence of Armistead, Christian, and a third suspect, a supervisor named Hull who disliked Hamilton and, in the investigator?s opinion, ?would stoop to any low cussedness.? Smiley also heard rumors that Dr. H. S. Crockett, Hamilton?s second-in-command, was ?working his hardest to ruin Dr. Hamilton.?

Some people found it suspicious that Crockett?s uncle William B. Byars, who had been under treatment for melancholia at the asylum for three and a half years and who had unusual access to the pharmacy because of his family connection, was discharged three weeks after the poisonings and soon moved to Texas. ?The general opinion is that Dr. C. furnished the ?aconitia? and that his uncle used it? to kill the victims, wrote Smiley.

Asylum attendant Duet Andrews, one of the few remaining Democrats on the staff, told the detective that he thought the poisoning ?was done to beat the d[amne]d readjusters and I wouldn?t squeal if I knew? who did it. Smiley suspected Andrews may have conspired with another attendant and with a former attendant, a ?dirty mean scamp? who had been fired but returned to Staunton the day before the poisonings. On the other hand, the Democratic editor of the Staunton Telegram newspaper believed the poisonings were not murders, but accidents caused by Dr. Butler?s carelessness.

Pinkerton superintendent R. J. Linden?s final report dismissed the possibility that a patient or staff member could have caused the deaths, concluding only that ?the poisoning resulted from no carelessness or lack of precaution on the part of the faculty, but was evidently? perpetrated by parties outside of the institution, whom it is unnecessary and would also be injudicious to name at this time.? Tantalizingly, Dr. Hamilton said ?I have reason to believe that the detective had other information than that reported, and that he had other information which led him to suspect a certain individual.? For whatever reason, no charges were brought.

While the asylum board of directors considered themselves and Hamilton to be vindicated, their political enemies thought otherwise. John N. Opie, Democratic member of the House of Delegates for Augusta County and Staunton, demanded an investigation of ?gross mismanagement? at the asylum.

Spurred by the committee report and by other complaints, the General Assembly?s 1883-1884 session passed acts removing the boards of all state hospitals as of 15 April 1884, and putting the choice of new boards in the hands of the Board of Public Works instead of the governor. Soon Hamilton and his entire management team were out the door, and the old administrators from before the 1881 election were back in charge. There was one new staff member: clerk C. J. Armistead, one of the former inmates and suspects! The opponents and supporters of the ousted administrators agreed on only one thing: ?the whole affair is still shrouded in doubt and mystery.? Over 130 years later, the mystery endures.
