Lot 78 & NW 1/4 of Lot 53, Sixth District Written: December 24, 1827 Recorded: December 22, 1828 Jones County, Georgia Deed Book O, page 153 Georgia Jones County This Indenture made this twenty fourth day of December 1827 between Stephen
Reeves of the one part & James Huckaby of the other both of the state & County aforesaid.

Witnesseth that the said Stephen Reeves for & in consideration of the sum of Six hundred dollars to him in hand paid at & before the signing Sealing & delivery of these presents the receipt whereof is hereby acknowledged
hath granted bargained sold & conveyed & by these presents do grant bargain sell & convey unto the said James Huckaby all that tract or parcel of land situate lying & being in the county of Baldwin when surveyed now Jones County Containing two hundred & fifty three acres more or less known & distinguished by lot No. Seventy eight in the sixth district of said Baldwin now Jones County & also North west fourth part of lot no fifty three in said district & County bounded as follows beginning at center on the line between the said lots fifty three to a sasafras stake thence with the Original line the corner between 18 [should be 78] & 53 thence on the line between the said lots to the beginning Corner. To have and to hold said bargained premises with all & singular the rights members & appertenances of or in anywise belonging to the said premises to the said James Huckaby his heirs & assigns to their own proper use benefit & behoof in fee simple and the said Stephen Reeves Against himself his heirs & assigns the said the said bargained premises & all every other person or persons whatever will warrant & defend the right & title to said premises.

In Witness whereof the said Stephen Reeves hath hereunto set his hand & Seal the day & year above written in presence of Thomas Wynn David Slocomb J. P. Stephen Reeves (LS) N.B. Interlined before signed with the words & defend the right & title of said Premises.

Will of Stephen Reaves:
I Stephen Reaves being this day in my proper mind and judgement do make and declare this to be my last will and testament in which I constitute and appoint my wife, Sarah Reaves my Exectrix and Leonard P. Bridlow and John Pratt, Sen, my executors to this my last will and testament. I will that my estate both real and personal be disposed of in the following manner (namely)

Item: First after paying my just debts, I give and bequeath unto my wife Sarah Reaves all my estate both real and personall during her widowhood or lifetime exclusive of the sum of twenty-five dollars (25) to be given to each of my children as they may arrive to the age of Twenty-one years or marriage except my son Henry Reaves, Ashur Reaves, and my daughter Nancy Huckuby, Lydia Mackinvale, and Sarah Moore to whom I have already given the sum of Twenty-five dollars each which estate both real and personall to be kept in the hands of my wife Sarah Reaves during her widow hood or lifetime for the support of herself and the maintaining my children Stephen Reaves, Samuel J. Reaves, Harrel F. Reaves, and Abner L. Reaves.

Item: Second after the death or marriage of my wife Sarah Reaves, I give and bequeath unto my sons William Reaves, Stephen Reaves, and Samuel J. Reaves my lot of land known by (no 239). Two hundred and thirty-nine in the Fifteenth District of originally Muscogee now Talbot County to be
divided in the following (manner) my sons: William Reaves to have seventy-five acres (75) of the west side of said lot the line to run north and south. My son Stephen Reaves to have (75) Seventy-five acres adjoining my son William. The line to run the same direction the balance which is
fifty-two and a half acres being East side of said Lot I give to my son Samuel J. Reaves. Third: I will that my lot of Land known by (no 240) Two hundred and forty in the fifteenth district of original Muscogee now Talbot County be divided into two equal parts by a line running east and west and the West half of said lot I give and bequeath unto my son Harrel F. Reaves and the East half of said lot I give and bequeath to my son Abner L. Reaves.

Fourth: I will that my negros be disposed of in the following manner to wit Toney, Esther, and her child to be equally divided among my children (viz) Henry, Nancy, Asher, Lydia, William, Betsey, Stephen, Sarah, Samuel J., Harrel F., and Abner L. Reaves.

Fifth: After the death or marriage of my wife Sarah Reaves, I will that the balance of my estate be sold by the executors of this my last will and testament and be Equally divided among my Children. In witness whereof I have here unto set my (my is repeated) hand and seal this 26 day of October 1830.

"Job. July 12, 1776, the committee of observation of the Maryland Council of Safety during the Revolutionary War, reported in part that: . . . "It is said Clarkson bears a very ill character as to holding a communication with & carrying men in his boat to the Tenters. And we have just now been informed that one Job Slacom Jr of this County [Dorchester] will prove that Clarkson endeavored to persuade him & some others to go with him on board the Tenders and join Lord Dunmore, but as the guard was setting off with the Prisoners we could not delay them until we sent a summons for Slacom. There were several other persons apprehended in this County on suspicion of being unfriendly and having a communication with the enemy, but upon our enquiring into their conduct, we could fix nothing

Job Slocum, Jr., was granted land in Dorchester Co. in 1790
and 1792. 'Job Slocumb and Anne Slocumb' gave Deed 13
Oct., 1819, to John Williams, to tracts of land in Worcester Co., Md., called Addition to Handy's Security, Handy's Frolic, and Low Meadows. Whether this is the above Job or his son, is not known to the writer."

May 10th and 31st 1834

At a court called and held for Russell County at the court house on Saturday the 31st day of May 1834 for the trial of the complaint of William Nash against Michajah Burress, Defendant for unlawfully and againt the consent of the complaintant holding from him possession of a certain tenament containing by estimation 20 acres of land with the appurtance lying and being in the county of Russell. Present John Jasper and John Senell, gentlemen justices. This day came as well the plaintiff by his attorney as the defendant in his proper person, and a jury well selected by lot to wit: Lsarah Fuller, Jacob Tool, John Kizer, James Jasper, Samuel E. Gilmore, William Gibson, James Gilmore, John Browning, Archer Jesper, Leonard Shoemaker, John Grey, and Samuel Whitsell who having been sworn to by weather the defendant against the consent of the plaintiff holds possession of the tenement mentioned in the compmlaint filed in this cause weather the said defendant hath so hold possession thereof against the consent of the plaintiff for 3 years next before the exhibition of the said complaint, and weather the plaintiff hath the right of possession in the tenament aforesaid, and to find a true verdict thereon according to the evidence, and having retired from the bar after some time returned into cour with a verdict in these words "We the jury find that the defendant did at the time of the exhibition of the compmlaint filed in this court, hold possession of the tenametn therein mentioned against the consent of the plaintiff, that the defendant hath not so held possession thereof against the consent of the plaintiff for 3 years next before the exhibition of said complaint and that the plaintiff hath the right of possession in the tenement aforesaid" Therefore it is considered by the court that the plaintiff recover against the defendant his ??? by him in this behalf expended whereupn the plaintiff pays a writ to the sheriff of Russell County to be disacted??? to cause him to have possession of the tenement aforesaid, and to him it is granted, returnable here at the next july term. Facts from the records:

1. Micajah and Elizabeth were living together in 1849.

2. There was an Elizabeth Burress living with Micajah according to the 1850 census. Could she be a daughter or a daughter-in-law living with him?

3. Micajah's estate sale was completed by August 13, 1852, and the "Widow Burress'" underage children were bound out to a legal guardian.

Interpetation:

So it is likely they had married after the lewd conduct charge since there was a Widow Burress, and evidently they had lived together for a while as the oldest child in the household was 12 years old.

Women didn't have the legal right to sole custody of their children who were under the age of 21. In the 1850 Census the children living with Elizabeth and Micajah were Tempers Burress age 12; Jane Burress age 9; Rachel Burress age 5; Henry A Burress age 4; Sidney Burress less than 1 year old.

Have a Indictment for Micajah Burress and Elizabeth Francis on March 1849 in the Russell County Law order book 12 page 200, for Lewdness. Assuming this was because they were living together without being married. I know a few researchers assume in the 1850 census that perhaps Micajah was living with a daughter in law, Elizabeth, and the children listed were his grandchildren. Now I'm wondering if this is true. I have never found any record for the children as burress's other then the 1850 census. I think those children must have been Elizabeths from a previous marriage. Does anyone have any thoughts about this?"

"I believe the children listed in the 1850 Russell Co VA Census had to be Micajah's children with Elizabeth Francis. I'm thinking the only way to prove "lewdness" in court is to show that there were children being born to the couple outside of marriage.

It's not inconceivable for an older man to have had kids...in fact, several spry old men in my family who would have been thought to be too old took teenage wives after their first or second wives head died and sired families up into their late 60's.

My guess is that you'll probably eventually find a court order to "bound out" the children to other homes after Micajah's death.

Now, I'm not clear, but I would guess the Widow Burress would be Micajah's widow Elizabeth. The Chilren of Widow Burress and of Sally Holly, doesn't make since except that perhaps the first name isn't Sally and it just looks that way in the writing - could be man Sal maybe? I could only write this down and not make a photo copy of the record when I was in the courthouse, so I can only go by what I wrote unfortunately. Any thoughts?

I've seen in Russell Co VA records where often several women are listed in the same "binding out" order. I don't think Sally Holly was in any way related to the Burress family, but rather was just in court the same day as the Widow Burress was. Sounds like Micajah ended up making an honest woman of Elizabeth Francis, huh? With first wife Rachel still living up to 1855 over in Pike Co KY, my best guess is that she and Micajah were divorced before 1850 and he became lonely and lived with Elizabeth Francis for a time before maybe eventually marrying her.

It's also possible these children belonged to Elizabeth from another marriage, and were not Micajah's and that they are only listed as his under the census as they were all living together. I have seen that happen many times before. There are really no trace of these children after this time so I'm assuming they all had a different name.

MILITARY RECORDS

On Oct.7, 1777, Henry Co. VA., Moses renounced allegiance to King, swears allegiance to VA. The Library of Virginia in Richmond lists Moses Parsley in the Bedford Co. VA Militia during the Point Pleasant campaign in 1774.

He fought in Lord Dunmore's War under Captain Abraham Penn of Bedford County. Dunmore's War was a conflict between the Colony of Virginia and the Native Americans of the Ohio Valley. Following increased raids and attacks on frontiersmen in this region, the Royal Governor of Virginia, Lord Dunmore, organized a large force of militia and marched to Fort Pitt arriving at the end of August 1774. Dunmore also ordered Colonel Andrew Lewis, commander of the southwestern Virginia militia, to raise an army in the south and meet Dunmore?s force along the Ohio River. Lewis formed militia companies from Augusta, Bedford, Botetourt, Culpeper, Dunmore, Fincastle, and Kentucky counties. After Colonel Lewis' victory at the Battle of Point Pleasant, Dunmore successfully negotiated a peace treaty with the Delaware, Mingo, and Shawnee chiefs that prevented them from settling or hunting south of the Ohio River.

He fought at the Battle of Point Pleasant. This was a conflict between the Native American Confederation under the Shawnee chieftain Keightughqua, or Cornstalk, and the colonial forces under General Andrew Lewis. It was one of the bloodiest, hardest-fought battles ever waged between the early settlers and the Indians.

The Virginians suffered a loss of eighty-one men and one hundred forty were wounded. Chief Cornstalk's fatalities were enormous. He lost two hundred men and had twice as many wounded. The result was a victory for the Virginia colonists and the opening of the area for permanent settlers. This opened the way to rapid western expansion.

Some historians consider the Battle of Point Pleasant the first battle of the American Revolution in spite of the fact that this battle actually took place six months before the documented beginning of the war. However, no one questions the importance of this battle, which thwarted an alliance between Native American forces and British collaborators and established a peace with the Indians for the first three years of the Revolutionary War.

The Shawnee had never given up their claims to western Virginia and interpreted the rapid settlement of whites into the area as acts of aggression. Hostilities reached a climax in 1773 when a group of volunteers from Fort Fincastle raided Shawnee towns. One of the worst atrocities of the conflict was the murder of several family members of Mingo chief Logan. Logan, who had previously lived peacefully with the settlers, killed at least 13 western Virginians that summer in revenge.

The Battle of Point Pleasant, fought between the Long Knives of Virginia and the Shawnee Indians and their allies on October 10, 1774, was the final battle of Governor John Murray, the Earl of Dunmore, and is considered by many to be the first battle of the American Revolution. It is said that when George Washington surveyed the area in the 1740s, he referred to it as the Pleasant Point.

Cornstalk was the principal chief of all the Shawnee sects at this time. He led both the Shawnee warriors and other tribes who joined the Shawnee in this battle. The Shawnee, who had lived in this area for hundreds of years, were hunters and farmers. They burned parts of the forests to make fields, and then they grew maize, beans, and pumpkins. They lived in wigwams, which they made by bending small trees and tying them together, then draping animal skins over them.

Virginia Governor John Murray, Earl of Dunmore, plotted to crush the Shawnee and end hostilities. Dunmore drew up a plan to trap the Shawnee between two armies. The governor personally led the northern army while land speculator Andrew Lewis led a smaller force from the south. But Shawnee leader Cornstalk struck the southern regiment before it united with Dunmore's troops.

On October 10, 1774, Cornstalk's force of approximately 1,200 men attacked Lewis at the confluence of the Kanawha and Ohio rivers at present-day Point Pleasant. After the battle, which resulted in significant losses on both sides, the Shawnee retreated to protect their settlements in the Scioto Valley in present-day Ohio. As a condition of the subsequent Treaty of Camp Charlotte, the Delaware, Shawnee, and Mingo relinquished all claims to land south of the Ohio River. The Battle of Point Pleasant eliminated Native Americans as a force on the frontier for the first three years of the American Revolutionary War, which began in April 1775, clearing the way for peaceful settlement of the region.

I Moses Parsley of the County of Russell and common wealth of Virginia being weak in body, but of perfect sound mind and memory, do this thirtieth day of August in the year of our Lord one thousand eight hundred and thirty one, make this my last will and testament in manner and form following.

I will and bequeath to my loving wife Obedience all my estate real and personal during her natural life to make use of at her discretion for the support of her to have and to hold it without any appraisement or sale.

This my last will and testament revoking all other wills heretofore made by me. In witness, whereof I have hereunto set my hand and seal the day and the year above written.

Big Springs-Upper Clinch, Hancock Co., TN

Enoch and Sarah England Payne were married in late August, 1818. Their marriage bonds are in the records of Scott Co., A. The bonds were dated Aug. 22, 1818, secured by Enoch Payne and George George. In the bond the name Payne is spelled as Payn. George George was a well-known man of Scott County. He was keeper in the early 1800's of the ferry across Clinch River where the river was crossed by the Great Western Road to Cumberland Gap. He was also an officer in Scott Co. militia. There seems to be a close relationship between George and the Payne family. We know that in Tidewater VA there was some connection between the Paynes, the Georges, and Moores before they came down into southwestern VA but we do not know just how.

Enoch Payne was the son of John Payne and Rachel Parker Payne. They were married in WAshington Co., TN on August 6, 1794. John and Rachel Payne evidently bought land and settled in VA near the Clinch River in Lee County (now Scott).

Sarah "Sally" England Payne was the daughter of John England and Mary Parsons. The marriage bonds for John and Mary were dated Feb. 22, 1786, in Amherst Co., VA. In the early 1790's they moved to the area of Lee Co. (later Scott) south of Stickleyville, a little north of the present Tenn/Va line and not far from Clinch River. The area where they settled is still known today as England Valley.

Enoch and Sally Payne very soon after their marriage, possibly in the early 1820's moved to an area a little south of England Valley just across into Tennessee. They were there in the 1830 Hawkins County, TN census. As they established their home and started their family, Enoch began to acquire tracts of land until he had accumulated considerable acreage in the upper northeast corner of present-day Hancock Co. Their lands extended down along the Clinch River, taking in all of the Big Springs area. Most of the tracts of land were in the State of TN but a portion extended into Scott Co., VA. The lands were somewhat remote, even today the roads into them are not very good and are not heavily traveled.

In the 1830's and 40's there was an exodus west from the area. Many people despaired of the difficult life in that remote region and decided to move further on with the hope that life and opportunity would be better. This movement no doubt had much to do with tracts of land becoming available for purchase from time to time.

Enoch and Sally apparently decided to stay where they were and to try to make the most of what they had - with hard work. They did not have very much in the way of personal wealth and assets when they began their life as a family. But, as the tracts of land became available, Enoch somehow managed to add them to his holdings.

"Find attached a copy of the signature portion of fragments of an original land grant to Enoch Payne for fifty acres from the State of Tennessee, dated Feb. 15, 1833, No. 19090, recorded in Hawkins Co." The grant is signed by William Carroll, the governor of TN. The large acreage of land which Enoch and Sally acquired land west and south of lands owned by other families who had settled in that area of present-day Hancock Co: Church, Edens, Roller, Sons, Purcell.

One of the most valuable portions of the Payne properties was the Big Springs. It was a huge spring formation from which may families had water rights. There was then, and still is today, a valley without water resources, known as Dry Valley, not far from Enoch Payne's home. The Big Springs was of great importance to the people who settled there. Even before white men first went into the area, Big Springs was known to the Indians and was a source of water for them. The Big Springs is an unusual, natural formation of great interest even today.

Enoch and Sally and their family were well known in the area, and their children married into the nearby families. They had seven children, possibly eight. Enoch only mentioned seven in his will but there may have been another one.

Among the 34 charter members of Independence Baptist Church, on Nov. 8, 1851, were members of the Payne family: Polly Click, their daughter who married A.Y. Click; William Church, a son-in-law who married daughter Isabel; Henry Payne their son; James D. Payne believed to be their son; William G. Payne their son; Sarah Payne; Elias Roller, a son-in-law who married Elizabeth.

There is a picture Enoch and Sally Payne's home as it was when they lived in it with their family (1800's). The picture is taken from a water color painting by Miss Ida Begley, a Payne great granddaughter. The home was a beautiful two-story log house. It was later restructured about 1900 with white clapboards.

Following is a brief summary of the lives of Enoch and Sally's children:

(1) Elizabeth, born 1818/1819; married Elias Roller. The family probably moved west in the late 1850's or 60's. Elizabeth was still living at time of 1890 census.

(2) Ann, born 1819/1820; married Christian Begley. They had two sons, James and William. Anne Payne Begley died about 1870. Her sons inherited her portion of Enoch Payne's property, including his home.

(3) Isabel "Ibby", born ca 1821; married ca 1839 William Church and had eight children. Ibby died Dec. 1859. She was buried in a marked grave on the hill above her parents' home.

(4)William G., born 1823/1824; married Mary Anderson, Dec. 16, 1847 and had four children. William died during the 1850's. He was still living Nov. 1851. He was probably buried on the hill with his mother and sister Ibby, and later his father.

(5) Mary "Polly", born 1826/1827; married 11848, Arthur Young Click and had five children. Polly died Nov. 1894. She is probably buried in the Weedon Cemetery very close to her home.

(6) Hiram E., born ca 1825. There is a record in Hawkins Co. dated Feb. 9, 1845 of a marriage of Hiram E. Payne to Mary Anderson. The records also show his brother William as marrying a Mary Anderson. It's possible the names of one of the wives is a mistake (or the brothers married the same woman). We do not know when Hiram died. He is probably buried in the Begley Cemetery very close to his parents' home.

(7) Henry, born ca 1832. According to his father's will, he moved west.

(8) There is some indication that Enoch and Sally had a son named James, born ca 1829, but he is not mentioned in his father's will.

Enoch and Sally were both born about 1796. In the 1850 census the age for each of them was listed as 54. Enoch and Sally did not live to old age, and neither did some of their children. Sally died about 1855. Enoch's will is dated Feb. 24, 1863, and it was proven at the April term, 1863, of Hancock County Court; recorded in Book 6, pg. 3-6. The original will has been preserved by Begley descendants of the Payne family. The recorded copy was lost when Hancock County Courthouse burned in the 1870's.

Enoch and Sally were no doubt buried up on the hill above their home, with their daughter Isabel Payne Church and most likely their son William G. In his will Enoch made the following bequests:

(1) to my daughter Polly all of the lands that ly west east of my dwelling house. (this is the portion of Enoch's land which was in Scott Co., VA)

(2)to my daughter Ann Begley all of my home plantation lying west of the lands I give to my daughter Polly.


(3) to the four minor heirs of my son Wm. G. Payne (dec.)...all my lands west of the lands I give my daughter Ann with the improvements that was nade by my son...my daughter Ann to see to the letting out and collecting the rents and see that the proceeds thereof is secured for them till they shall become of age.

(4) to my son Henry Payne three hundred dollars and some over which he owed me when he left this country and still owes, all of which I give to him.

(5) to the lawful heirs of my daughter Ibby Church two hundred dollars.

(6) to my daughter Elizabeth Roller two hundred dollars.

(7) the remainder of my estate...be equally divided between my son Hiram E. Payne, Ann Begley, and Polly Click.

Enoch Payne appointed James L. Purcell as the executor of his will. James Purcell was a close friend and neighbor.

The home of Enoch and Sally passed down to their two grandsons, James and William Begley. James inherited the Payne home in his part of his mother's estate. He lived the greater part of his life in the home. James was born ca 1847 and died ca 1937. He was the father of 11 children, 10 of whom lived to be grown. James was in his upper teens during the Civil War and was a little young for active military duty but he mined saltpeter to make gunpowder for the Confederate Army. James and his wife Margaret, with other members of their family, are buried in the Begley Cemetery close to the Enoch Payne home.

The restructured home of Enoch and Sally still stands today, a part of which is about 170 years old. The home and lands have now passed into other hands. The name Payne is almost forgotten in the area. Very few today know that the large white house was once known as the Enoch Payne home. The history of the Enoch Payne family is written to preserve the memory of a wonderful good couple who made the most of their lives in the Big Springs area of Hancock County.

Declaration in order to obtain the benefit of the act of Congress passed the seventh day of June 1832. State of Virginia, Scott County.

On this 14th day of February one thousand eight hundred and thirty three personally appeared in open court of the County of Scott now sitting John England a resident of Scott County aged 76 years who being duly sworn according to Law doth on his oath make the following declaration in order to obtain the benefit of the act of Congress passed seventh date of June 1832. That he entered the service of the United States under the following named officers and servedas herein stated.

That about 12 or 15 months before the battle at the siege of York he was a citizen of Goochland County Virginia when he was drafted to go to the Shirley hundred between York and Norfolk, that he commenced his march from same under Colonel Fleming, Capt. Edward Smith, Lieut. Hodges, and
Ensign William Hodges who was afterwards killed at the siege of York for that place, that he marched, on through Richmond, Virginia to that place that when they arrived at the Shirley hundred they found there a considerable number of men under the command of Col. Snodgrass, that they all remained stationed at the Shirley hundred about three months during which time they remained there in the
vicinity of the place as guards under Col. Snodgrass and Fleming, that they had no fighting nor did they do anything but spy about, that at the end of the three months they were discharged.

That some short time after his return home from the first tour but he cannot say certainly how long he was again drafted and went again from the same place under the same Colonel and Captain and that he marched to the Pigeon and Mobbin's Hills and remained there under the same officers during the tour, that there was no other troops there during that time but Fleming's men, that they remained there
guarding the place did nothing else till they were again discharged by the same Colonel and Captain.

That about four or five months before the battle of York he was again drafted and marched from the same place to Norfolk under the same officers Fleming and Smith, that when they arrived at Norfolk there was a considerable army there of the militia from different counties that that he does not recollect which officers commanded them, that he remained there during the tour under the same officers as he
recollects but he can't recollect the name of the other officers where that they did nothing but lie there in readiness for any call that might be made for them until the third tour was out when they were again discharged, that about 30 days before the siege of York he was drafted on a fourth tour of three months and marched from the same place under Capt. Joseph Leak and marched from Goochland to Hobbs Hole where they were attached to Col. Nathaniel Dandridge's regular Regiment from Hanover County Virginia from which place they marched under the same Col. Dandridge to York where they found the two armies, the Americans under Washington and Lafayette, Morgan, and Wayne, the British were penned in York under Cornwallis and Tarleton, that he was there as he now recollects almost during the
siege he thinks it commenced but a few days before he arrived there and as he now recollects it lasted
something like 40 days, that during his stay there they were constantly engaged fighting raising breastworks and entrenchments, that the Americans were scattered around the town and the French guarded the river, that they had prepared to blow up the town which they would have done in a short time if they had not surrendered, that when they surrendered the whole army were taken prisoners and marched to Winchester, Virginia, that he remain at York for some time after the siege ended say two or three weeks when he was discharged from his fourth tour of three months, that the prisoners were kept at Winchester sometime when they were taken from there to Albemarle and barracks were built there to keep them in, that the whole British Army that is to say Cornwallis and his men, Tarleton, Howe, Clinton, and Burgoyne and were kept until they were exchanged but he does not recollect how long, that they were guarded while there by militia captains and their companies, that as a guard of these prisoners he also served two three-month tours under the same Captain Joseph Leak, that was drafted in them both for that purpose and went the first one shortly after the prisoners arrived there and before the
barracks were finished, that when he arrived there, there was a company there commanded by Holdman Rice from the same County of Goochland that he went home and Leak took the command of both companies, that the prisoners while there fared exceedingly well in every respect, that he remained
there guarding them for three months and was discharged, that during his first tour there one Abram Prewett robbed or stole some whiskey and was sentenced to run the gauntlet for it, which he did running through about 50 men all of whom gave him a tap, that after his return home from this tour sometime he was again drafted to go to the same place for the same purpose another three months tour and that he went again under the same Capt. Joseph Leak, that when Leak and his company left there the first time Capt. Rice took the command and kept it until Leak and his company returned a second time, that they remained there the second tour of three months and were again discharged sometime before the prisoners were exchanged, that he got written discharge at the end of every tour but has lost them all by negligence, that it was not his practice in those days of his youth to take care of any papers whatever, thus having served three tours under Capt. Smith and Col. Fleming, one at Shirley hundred, at Pigeon and Mobbins hills, and one at Norfolk and one tour under Captain Joseph Leak and Colonel
Dandridge at York and two tours under Capt. James Willson McClung wrote about his family home, he called the old home of Samuel Willson: "1 mile east of Brownsburg on the road leading to Fairfield, built in 1740 by John Skeen. He says this home has been in the possession of Andrew A McClung and his son since 3 Jan 1861. Andrew served for the 4 full years, and for the most of time in the 14th Virginia Infantry, Co. H, and for a while in the Commissary Department. He surrendered his arms at Appomattox in 1865. He had 4 brothers who served in throughout this war, and his wife had 3 brothers in service. Her youngest brother, James Willson, was a Color Bearer and was the last man killed in this war, having been shot from the rear, after the surrender. It appears that he was a little slow in dropping his flag, and was shot down."

James W. McClung's 5 Mar 1938 Works Progress Administration of VA Historical Inventory #352, for the Glebe Burying Ground, includes data on his Willson kin since Col. John Willson is buried there. Col. John Willson's "...son, James Willson was born about the year 1750 and died about the year 1811. James Willson's son, Samuel was born in Augusta County, Va, on May 2, 1787 and died Jun 28, 1866."

NOTES ON CHARLES DUKE AND HIS FAMILY by Douglas P. Reid

Charles had a son by a first marriage who was a small boy in 1800 and witnessed his wedding to Nancy Elliott. Charles lived near the young families of James, Robert, and William Duke in Walton Co., Georgia in the 1820's. These men, as well as men named Thomas Duke and David Duke (son of John P. Duke) were probably all closely related to him; all except Robert appear on land records together with Charles. When Charles bought land from Henry White of Clarke County in 1826 - land adjacent to William Beard - Thomas and James Duke acted as testators. (These men both may be his sons or brothers). In 1830, Charles Duke is shown in Morgan County, while his son James was in Walton County where he had married Minerva Hightower in 1829.

Charles Duke seems to be related to John P. Duke who died in 1829 in Morgan County. Charles was at the estate sale, and later, drew for the orphans of John P. Duke in a land lottery in 1832. Other Duke relatives at this sale were Edmuond Duke (administrator), Thomas Duke, Sr. (son of John Taylor Duke), Thomas Duke, and John Duke, Sr.

The commonality of these men show that most of them were descended from the same family of John Taylor Duke, son of Captain Henry Duke and Elizabeth Taylor of Prince George County, Virginia. (The "tobacco Dukes" were also descended from John Taylor Duke). John Taylor Duke and his sons, Henry, Thomas, James, and Edmond moved to Georgia (Wilkes Co.) in the 1770's and 80's. These son were in their forties by then, with families of their own. It is known that Henry and Thomas both had sons named Charles Duke. Our Charles Duke was likely the son of James, Edmond, Thomas, or possibly Henry, and the grandson of John Taylor Duke. (See Evelyn Duke Brandenberger's "The Duke Family" for more on these men and their ancestry).

The records are silent as to where Charles Duke was in 1840. He was probably in Floyd County. By then his son, David D. Duke, and Thomas Duke, (who may also have been his son) were in Floyd. Thomas and David had married sisters - Mary Ann and Martha White - in Walton County in 1829 and 1835. By the 1850's Charles and Nancy along with James, John, Nancy, and her husband (whom she married in Floyd County in 1842). David, and Green R. were all in Floyd County, along with Thomas Duke. Thomas left soon after 1850. The children of Thomas Duke (born about 1803), and Mary Ann White (born about 1807), who married in Walton County on 2 August 1829, were Martha (b-1830), James R. (b-1833), Mary A. (b-1835), Lousana (b-1837), Charles M. (b-1849), David W. (b-1843), Edmond I. (b-1845), and John T. (b-1849).

James Duke was appointed Administrator of Charles Duke's estate on 7 April 1856. Charles was remembered as a "big, stout, tall man," and was knwn to his grandchildren as "Grand-Sir."

DEATH

The Times & News, Ezekiel's obit. gives his birth date in Hancock Co., Georgia; says he went to Jones Co. Georgia with his family at an early age. When he was 18 yrs old he moved to Ft. Gaines, Georgia. He moved again with his father and family into Alabama, but after a few years moved back to Jones Co. and married his 1st wife Edna Dawson, who was the mother of all his children. He was afterwards married two times. He changed his residence to Dale Co. Alabama, then to Pike Co., Alabama and in 1834 to the home in Barbour Co., in which he died.

James Burress Indenture/Deed July 16, 1844

This Indenture, made the sixteenth day of July in the year of our Lord, one thousand eight hundred and forty four between James Burrass (sic) and Franky, his wife of the County of Tazewell and State of Virginia of the one part and George P. Thompson of the same County and State of the other part, witnesseth: that whereas the said James Burrass is justly indebted to George W. Browne in the just and full sum of nineteen dollars and forty six cents, the payment of which with interest the said Burrass is willing and desirous, effectually to assure and secure to the said Browne. This Indenture therefore witnesseth, that the said Burrass and Franky, his wife, as well in consideration of the premises aforesaid as of one dollar to him in hand paid by the said Thompson, the receipt whereof is hereby acknowledged the said James Burrass and Franky his wife, have granted, bargained and sold, and by these presents do grant bargain and sell unto the said George P. Thompson, all the right, title, interest and claim of them, the said James Burrass and Franky, his wife, in and to the real estate of Alexander Neel, deceased, the said Franky being a daughter of said Alexander Neel and as such entitled to the eighth part of his estate, with all the appurtenances. To have and to hold the said interest in said parcel of land, with all the appurtenances unto the said Thompson and his heirs, to the sole use and behoof of the said Thompson and his heirs, and the said James Burrass and Franky his wife, for themselves and their heirs, the said right, title and interest in the said parcel of land, with all the appurtenances to the said Thompson and his heirs against the claim of them the said James Burrass and Franky his wife, and their heirs, and all other persons whomsoever shall, will and do by these present warrant and forever defend, in trust, never the less, that if the said James Burrass, his heirs, executors or administrators, do and shall well and truly pay or cause to be paid to the said George W.G. Browne, his heirs or assigns the said sum of nineteen dollars and forty six cents on or before the 16th day of December next together with the expenses of drawing and recording this indenture and the tax thereon, then and in that case, this indenture, and everything herein contained shall become void and of no effect; But if the said Burrass shall fail to pay the said sum of money or any part thereof, on or before the said 16th day of December, next, then it shall be lawful for the said Thompson, and full power and authority is hereby given him to proceed to sell the said interest and claim in said parcel of land with all the appurtenances, so soon after the said 16th December next as he may be requested by the said Browne, at public auction for ready money, to the highest bidder, at Tazewell Court House, having previously advertised the time and place of sale at least twenty days by advertisement affixed for that space of time to the front door of said Court House and the proceeds of such sale after paying thereout all the expenses attaining the execution of this trust including a commission of 5 percent on the amount of sale to the said trustee for his trouble in executing the same shall be applied by the said Thompson towards the discharge and payment to the said Browne of the aforesaid sum of nineteen dollars and 46 cents, with interest on so much of said sum with interest as may remain unpaid, and in further trust, that until such sale shall be made it shall be lawful for the said Burrass and wife, and their heirs, to hold and occupy the said granted interest in said land and premises and to take and receive, the rents, issues and profits thereof to their own proper use and benefit, and also, that the said Burrass his heirs, executors, or administrators, will pay and discharge all taxes, impositions, assessments and other charges, whatsoever which may or shall become chargeable thereon, during his or their possession thereof. And the said Thompson doth covenant on is part, that he will faithfully execute the trust hereby reposed in him. In testimony whereof, the parties hereunto have to these presents set their hands and affixed their seals, the day and year first in this indenture written.

Franky Burress Indenture/Deed September 23, 1845

This indenture, made this twenty third day of September in the year of our Lord one thousand eight hundred and forty five between James Burrass (sic) and Franky, his wife of the county of Tazewell, and state of Virginia of the one part and George W.G. Browne of the other part, witnesseth: that the said James Burrass and Franky, his wife for and in consideration of the sum of forty dollars current money of the United States to them in hand paid, the receipt whereof is hereby acknowledged, do grant, bargain and sell unto the said George W.G. Browne, all their right, title and interest in a certain tract or parcel of land lying and being in the county of Tazewell on the Muddy fork of Wolf Creek, which formerly belonged to Alexander Neel, and in which as the daughter and heir of said Alexander Neel, the said Franky is entitled to one eighth part with all the appurtenances: To have and to hold the said interest in said tract or parcel of land with all the appurtenances unto the said George W.G. Browne, and his heirs, to the sole use and behoof of him the said BrownE and his heirs. And the said James Burrass and Franky his wife for themselves and their heirs, do covenant, with the said George W.G. Browne, that they the said James Burrass and Franky his wife the said interest in said parcel of land, with all the appurtenances unto the said George W.G. Browne, and his heirs, against the claims of them the said James Burrass and Franky his wife, and every other person or persons whatsoever, shall warrant and will forever defend. Harman and William Cox, Justices of the Peace in the County aforesaid, in the state of Virginia, do hereby certify that Franky Burrass wife of James Burrass, parties to a certain deed, bearing date on the 23rd day of September 1845 and hereunto annexed, personally appeared before us in our County aforesaid, and being examined by us privately and apart from her husband, and having the deed aforesaid fully explained to her, the said Franky Burress, acknowledged the same to be her act and deed and declared that she had willingly by signed, sealed and delivered the same, and that she wished not to retract it. In the end, it was more convenient and less costly for them just to forget the lawsuit.]
